between MARSHA SHELDON, AS TRUSTEE OF THE RICHARD EDWARD MARTINEZ
CREDIT SHELTER TRUST, having an address of 111-03 75th Road, Forest Hills,New York 11375,
party of the first part, and
AMY MARTINEZ having an address of 111-08 75th Avenue, Forest Hills, New York 11375 and
CHRISTOPHER C. MARTINEZ, having an address of 546 Fourth Avenue, Apt #513, Brooklyn, New
York 11215, as tenants in common,
party of the second part;
WHEREAS, Marsha Sheldon, as trustee of the trust (the "Credit Shelter Trust") created under Article
THIRD of the Last Will and Testament of Richard E. Martinez (the "Will") is a 50% tenant-in-common
owner of the Property(as defined below); and
WHEREAS,Articles THIRD (d)and FIFTH of the Will provide that upon the death of Marie C.Martinez,
any remaining principal of the Credit Shelter Trust shall be divided into such number of equal shares as
shall provide one such equal share for each of his children, Christopher C. Martinez, Amy Martinez and
Matthew C. Martinez, who is then living and one share for the issue of each child who is then deceased;
WHEREAS,Marie C. Martinez died on November 4, 2022; and
WHEREAS, Matthew C. Martinez died on September 28, 2016 without issue; and
WHEREAS,Amy Martinez and Christopher C. Martinez are the only surviving children of the Richard
E. Martinez;
WITNESSETH, that the party of the first part, to whom letters of trusteeship were issued by the
Surrogate's Court of the State of New York, Queens County on July 26, 2017, and by virtue of the power
and authority given in and by the Will, and in consideration of No Dollars and No Cents ($0.00) paid
by the ar of the second part,does hereby Rant and release unto the par of the second part,the
distributees or successors and assi ns of the party of the second part forever;
AN undivided fifty percent (50%) interest as tenants in common in those certain plots, pieces or
parcels of land, with the buildings and improvements thereon erected, situate, lying and being in the
Incorporated Village of Greenport, in the Town of Southold,County of Suffolk, State of New York as more
particularly described on Schedule A attached hereto and made a part hereof(the"Property");

Being the same premises conveyed to the grantors herein by Deed dated March 21, 2018 and
recorded in the Office of the Suffolk County Clerk on June 8, 2018 in the Suffolk County Records Office
in Liber: D00012964,Page 757. This condo is intended for residential use only.
TOGETHER with an undivided fifty percent(50%) interest as tenant in common in the Common
elements for the condo unit;
TOGETHER with an undivided fifty percent(50%) interest as tenant in common in all right, title
and interest, if any, of the party of the first part in and to any streets and roads abutting the above described
premises to the center lines thereof;
TOGETHER with an undivided fifty percent (50%) interest as tenant in common in the
appurtenances, which the party of the first part has or has power to convey or dispose of, whether
individually, or by virtue of said will or otherwise;
TO HA VE AND TO HOLD the premises herein granted unto the party of the second part,the heirs
or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to receive
such consideration as a trust fund to be applied first for the purpose of paying the costs of the improvement
and will apply the same first to the payment of the cost of the improvement before using any part of the
total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

and being a part of a Condominium in the Inc. Village of Greenport, Town of Southold, County
of Suffolk and State of New York, known and designated as Unit No. 11 together with a 1/34
