I am the vice president and secretary of WG WOODLYN, INC., a corporation with its principal place of business at P.O. Box 1304, Cutchogue, New York, 11935, which corporation is the owner of Unit number 34 in the Pheasant Run Estate Condominium, which unit is also known as 34 Caleb's Way, Greenport, New York. 2. 1 make this affidavit at the request of the Town of Southold Building Department to establish the buildings and structures in existence at the time of the issuance, on February 2nd, 1999, of Certificate of Occupancy number Z-26256. 3. 1 am familiar with Moores Landing Holding Corp., the builder and original owner of Pheasant Run Estate Condominium. 1 am aware of how the condominiums were originally built and the situation regarding the deck or decks which were attached to Unit number 34 a/k/a Unit number 34J a/k/a 34 Caleb's Way, Greenport, New York. 4. Most, if not all, of the units at Pheasant Run Estate were originally built with one deck. Some units, including the unit at 34 Caleb's Way, were, because of their location and configuration, originally built with two (2) decks - a rear deck and a side deck. At the time of the issuance of Certificate of Occupancy number Z-26256 on February 2nd, 1999, the unit at 34 Caleb's Way(which, on the Certificate of Occupancy, is known as house number 935 J34) contained two (2) decks: a rear deck measuring 8' x 15' and a side deck measuring 8' x 16'. Those decks, in their original sizes, still exist at the unit at this time. It is my further understanding that the words "and deck" in Certificate of Occupancy number Z-26256, either referred to the additional deck(the second deck) on Unit 34J, or should have read"and decks". 5. 1 make this affidavit knowing that the Building Department of the Town of Southold will rely on same to establish the fact that at the time Certificate of Occupancy number Z-26256 was issued on February 2"d, 1999, Unit 34J contained two (2) decks - a Apr 39 2010 4: 54PM Edward J.
