THIS INDENTURE, made the 1 st day of September, in the year 2023

CARMELA SCHIAVONI, a widowed woman, residing at 329 Second Street, Greenport,
New York 11944
party of the first party,
and
FRANK SCHIAVONI, as Trustee of the CARMELA SCHIAVONI TRUST dated August
31, 2023, residing at 325 Second Street, Greenport, New York 11944
party of the second part,
WITNESSETH, that the party of the first part, in consideration of the sum of Zero
Dollars and Zero Cents ($0.00) and other good or valuable consideration, if any, paid by
the party of the second part, does hereby grant and release unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain piece, parcel or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being in the Village of Greenport, Town of Southold,
County of Suffolk, State of New York, generally bounded and described as follows:
Northerly by land now or formerly of Johanna Warner, Easterly by Second Street;
Southerly by land now or formerly of Joseph Cherepowicz,

and Westerly by land now or formerly of K. Grayewski; containing about one-eighth of an
acre more or less.
Being and intended to be the same premises conveyed to the party of the first part by deed
dated January 15, 1997, and recorded in the Suffolk County Clerk's Office on January 24,
1997.
SAID premises being known as and by street address 325 Second Street, Greenport, New
York 11944.
TOGETHER with all right, title, and interest, if any party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all estate and rights of the party of the first part
in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to be applied first for the
purposes of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
AND the party of the first part covenants as follows: that said party of the first part is
seized of the said premises in fee simple, and has good right to convey the same; that the
part of the second part shall quietly enjoy said premises;
THAT the said premises are free from incumbrances, except as aforesaid; that the part of
the first part will execute or procure any further necessary assurance of the title to said
premises; and that said part of the first part will forever warrant the title to said premises.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.
