APPLICATION FOR CERTIFICATE OF OCCUPANCY
\. This application must be filled in by typewriter OR ink and submitted to the building
inspector with the following: for new building or new use:
1. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
.. 4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of I% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6.Submit Planning Board Approval of completed site plan requirements.
.i. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and
"pre-existing" land uses:
1. Accurate survey of property showing ali property lines, streets, building and
unusual natural or topographic features.
2. ,% properly completed application and a consent to inspect signed by the applicant.
If a Certificate of Occupancy is denied, the Building Inspector shall state the
reasons therefor in writing to the applicant.

Matter of CIPITELLI BROS. REALTY. Varianc~ to the Zoning
Ordinance Article XXIII, Section 100-239d, A.1, for permission
to construct a one family .dwelling with insufficient setback and
within 100 feet from Long Island Sound in this R-40 Zone
District. Location of Property: 90 Petty's Drive, Orient,
County Tax Map No. 1000, Section 14, Block 2, Lot 24.
WHEREAS, a public hearing was held and concluded on
September 21, 1989 in the matter of the Application of CIPITELLI
BROS REALTY, under Appeal No. 3849; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning,, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the east of
Petty's Drive, Town of Orient, and is identified on the Suffolk
County Tax Maps as District 1000, Section 14, Block 2, Lot 24.
2. This is an application for Variances from the Zoning
Code Article XXIII, Section 100-239d A.1, for permission to
construct a one family dwelling, proposed construction will be
within 100 feet of the Sound.

3. Article XXIII, Section 100-239d A.1, requires all
building located on lots adjacent to Long Island Sound and upon
which there exists a bluff or bank landward of the shore or
beach shall be set back not less than one hundred (100) feet
from the top of such bluff or bank.
4. The subject premises for the one family dwelling is
known and referred to as being built within the building
envelope, as identified on the site plan from Ward Associates,
also a copy of the Survey from Roderick Van Tuyl, Dated 4/17/89.
5~ In considering this application, the Board finds and
determines:
{a) that the circumstances of this application are
uniquely related to the premises and its established
nonconformities;
(b) that there is no other method for appellants to
pursue, and placing the proposed dwelling in any other location
on the premises will require other variance relief;
(c) that the area chosen for the dwelling is not
unreasonably located;
(d) that the variance will not in turn cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town;
(e) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the variance, as applied conditionally noted below.

RESOLVED, to GRANT a Variance in the matter of the
application of CIPITELLI BROS. REALTY as applied under Appeal
No. 3849, SUBJECT TO THE FOLLOWING CONDITIONS:
1. That there not be any~construction that includes
decks, swimming pools (Building Envelope), not be any closer
than 60 feet to the top of the bank.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
and Dinizio, (absent Serge Doyen, Fishers Island and Joseph
Sawicki). This resolution was duly adopted.

with indicating and lockiqg quadrant whether or not shown on drawings, at each
form main duct at each duct take-off, and at each neck to individual diffuser or
register in supply, return or exhaust ducts,
14. ACCESS DOORS - Provide access doors as required for coils, filters, dampers, and
other equipment that require periodic services, Doors shall be of the same
material as the duct work and constructed so as to miminize leakage.
15, HEATING AND AIR CONDITIONING SYSTEM - Heating and air conditioning system shall
be complete with all necessary components and items normally supplied.
Substitutions of equipment shall be approved by the Architect/Engineer. System
operational check-out, including demonstration to Owner. All appropriate
operational and maintenance manuals shall be provided. Contractor to provide
one year full guarantee of complete system.
16. COMPLETION - At the completion of the work all equipment complete with their
fittings shall be properly cleaned and left in first class working condition.
All duct work shall be left clean to prevent system distribution of dust and
dirt, System shall be left with clean filters,
ELECTRICAL
1, GENERAL - Furnish all labor, materials, equipment, plans, tools, and services
necessary and required for proper and complete installation of all Electrical
Systems and related work to include, but not limited to, wiring, l~ghting,
services, feeders, distribution and protection equipment, connections of
appliances, grounding,iand including all connections and devices within the
scope of the work as shown on this applicable drawings and as normally specified
in this type of project.
2. CODES - All work shall conform to the requirements of the New York State Uniform
Fire Prevention Building code, New York State Conservation Construction Code,
requirements of the Suffolk County Department of Health and the National
Electrical Code NFPA No, 70-1984 (NEC),
3, SERVICE ENTRANCE AND EQUIPMENT - Single phase 120-240 Y 3-wire 400-amp service,
underground type.
a. The underground service shall be complete with service feeder from the
utility company's service pole to a meter pocket box on the exterior
surface of the building and a main service disconnect switch within the
building, The underground service cables may be of the multi-conductor
direct burial type or of individual conductors enclosed in rigid steel
galvanized or rigid PVC conduit. The termination at the service poles with
or without a property line or service and box shall be in accordance with
the requirements of the utility company. The direct burial cable shall be
installed in conduit where it rises above the ground at the service pole
and at the meter socket box. Slack cable of 30 feet in length shall be
left at the service pole for the utility company's use for final
connections,
4. PANELBOARDS - Panelboard boxes shall be standard to the trade of code gauge
sheet metal with standard trim and door for surface or recessed panelbox
mounting. The box and trim shall have:
a, Corrosion resisting phosphate treatment and finished with factory baked on
gray colored enamel paint. The door shall have concealed hinges, cylinder
lock and a framed directory chart under clear plastic on the inside of the
door, The panel sections shall be mounted away from the back of the box,
gutter spaces shall be on both sides, top and bottom in keeping with code
requirements. The branch circuit breakers shall be of the plug-on types
with standard A.I.C, ratings for the service voltage. Breakers for
convenience outlet circuits shall have sensitive instantaneous trip
settings of not more than 10 times the breaker trip rating to prevent
repeated arcing of frayed app)iance cords.
5. CIRCUIT BREAKERS - Single pole 15 and 20 ampere circuit breakers shall be UL
listed as "Switching Breakers" at 120 V a.c. and carry the SWD markings,
Circuit breakers shall be UL listed. Single pole breakers with handle ties not
acceptable.
6. GROUND RODS - Ground rods shall be 5/8" x 8' copper weld and meet all
requirements of the applicable provisions of the NEC,

use ~" square cast aluminum boxes and finished weatherproof covers.
10. SWITCHES - Switches, pressure-sensitive type, 15 amp, 120/277 volt, back and~,
side wired. Single pole, double pole, three-way and dimmer type as required:
11, DUPLEX RECEPTACLES - Provide 15 amp 125 volt back and side wired duplex
receptacles on all multi-receptacle 15 and 20 ampere circuits. Provide 200 amp
