AUTHORIZATION
Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on January 17, 2024, and
in consideration of application fee in the sum of$1250.00 paid by Andrew Pace and subject to the Terms and
�4 Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits the
following:
Wetland Permit for the existing 4'x55'wood walkway from dwelling to IV'shaped 4'x8'..wood landing to 3.5'x3'
wood stairs to a 5'x7'wood landing to a 3'x15'adjustable wood ramp to a 6'x20'floating dock with two(2)8"
diameter pilings securing the float in an'ILI'configuration;existing electric pedestal,electric recep and water line f
with faucet;as-built 9'x7.5' hot tub on existing 19.7'x17.6'(346.72sq.ft.)deck;expand existing deck an additional
n 8.Tx19.7'(171.39sq.ft.)for a combined 518.11sq.ft.deck; remove existing bulkhead,landing,staircase and portion of
walkway;temporarily remove wood ramp and floating dock; relocate existing 8:3'x20.2':shed;remove,seven(7)
e` trees;construct a new vinyl bulkhead in the same location as the existing with an elevated height of 18"above I =
existing;total length of bulkhead 198.5 linear feet inclusive of the proposed landward boat basin bulkhead to create

of 8'to the south and parallel to the bulkhead at 10'distance;remove existing anchor pilings and install two(2)new
` 8"diameter pressure treated anchor pilings;install 3'x15'(wood or aluminum)adjustable ramp in new location;
plant seven(7)2"-3"caliper red cedars along south property line;establish and perpetually maintain a 10'wide
vegetated non-turf buffer area along the landward edge of the bulkhead from southern property line to bulkhead
basin,and a gravel non-turf buffer area within the area seaward of stairs with retaining wall on northern side of .
basin;with the condition that the floating dock be pulled in against the bulkhead;and as depicted on the revised site
plan prepared by M.A.Kimack,received on January 22,2024,and stamped approved on January 22,2024.

TERMS AND CONDITIONS
The Permittee, Andrew Pace, residing at 205 Gull Pond Lane Greenport New York as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or-claims for damages;of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said_Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 36 months,which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.

3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the-work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.

8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain,all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

Dear Mr. Kimack:
The Board of Town Trustees took the following action during its regular meeting held on Wednesday,
January 17, 2024 regarding the above matter:
WHEREAS, Michael Kimack on behalf of ANDREW PACE applied to the Southold Town Trustees for a
permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the
Town of Southold, application dated October 27, 2023, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the
Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent
with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy of the Local Waterfront Revitalization Program to
the greatest extent possible through the imposition of the following,Best Management Practice
requirements: issuing a permit for the structures, planting additional trees; and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
December 13, 2023 and January 17, 2024, at which time all interested persons were given an opportunity
to be heard, and
WHEREAS, the Board members have personally viewed and are familiar with the premises in question
and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted concerning this
application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town
Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and
general welfare of the people of the town,
NOW THEREFORE BE IT,

RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement
imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront
Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of ANDREW PACE for the existing 4'x55'
wood walkway from dwelling to"L" shaped 4'x8'wood landing to 3.5'x3'wood stairs to a 5'x7' wood
landing to a 3'x15' adjustable wood ramp to a 6'x20' floating dock with two (2) 8"diameter pilings securing
the float in an "L"configuration; existing electric pedestal, electric recep and water line with faucet; as-
built 9'x7.5' hot tub on existing 19.7'x17.6' (346.72sq.ft.)deck; expand existing deck an additional
8.7'x19.7' (171.39sq.ft.) for a combined 518.11sq.ft. deck; remove existing bulkhead, landing, staircase
and portion of walkway; temporarily remove wood ramp and floating dock; relocate existing 8.3'x20.2'
shed; remove seven (7) trees; construct a new vinyl bulkhead in the same location as the existing with an
elevated height of 18" above existing; total length of bulkhead 198.5 linear feet inclusive of the proposed
landward boat basin bulkhead to create off canal boat dockage slip with a 15' north return and 10' south
return; if necessary a one-time incidental dredging within a 10'wide area along new bulkhead to reclaim
lost fill during reconstruction; excavate±350 cubic yards of soil to create the basin, of which ±100 cubic
yards to be used to backfill along the landward side of the new vinyl bulkhead to reestablish the slope; the,
remainder of the excavated material (±250 cubic yards)to be disposed of off-site; the proposed basin
bulkhead to be raised an additional ±30", about 14.5' landward of the seaward point of the northerly slip
opening to adjust for the grade change; construct a 3-tread (4'x3'with (4) 8" risers) staircase; construct 8

Permit to construct and complete project will expire three years from the date the permit is signed. Fees
must be paid, if applicable, and permit issued within six months of the date of this notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

I met you last Thursday in your office. I just sent email to explain our concerns of our neighbor's project.
I have no experience and It is the first time I wrote something like this. Mr. Maxwell used taking care of these
but unfortunately he passed away on 8/10/2023 due to long Covid. As you see it is very difficult time for our
family and My complete heartbreak

Dear board of trustees,
Our house located at the end of Gull Pond (next to Mr. Paces property).The canal gets narrower when comes to the
end.There are 4 homes sharing this last part of canal. In order to get our boats in and out,we need enough room to be
able make U-turn.According to Mr. Pace Project,the size of his future floating dock(6x20 ft) is too long in length and
too much out, blocking in the middle of the canal, make it harder for our boat getting in and out especially make U-turn.
When we share this canal,we should leave space and convenience for our neighbors instead of selfishly occupying the
waters and causing dangerous hazards.
Due to years of dredging and management and maintenance, his pier has formed a large pit that is 15 feet wide and 20
yards long (along the pier block) and at least 15 feet deep.Years of garbage have been piled inside,affecting
environmental protection and sanitation More importantly, It is very dangerous`and people can easily fall in when
walking on it.Starting last year,the large hole continued below our deck.Will his planned excavation and construction
affect the loosening and collapse of our decks?This requires professional and technical personnel to evaluate this. If an
accident occurs and our deck becomes loose or collapses,who will be responsible for the consequences?
Such a large project requires someone to go to the site to supervise and manage it. Will MrPace be at home to ensure
the safety of his own property and that of his neighbors?
MrPace has been using this property to make money as an AirB&B for many years.We suffer from years of noise,
accidental barbecue fires,dogs pooping in our yards,children running around in dangerous pier collapse areas, and
parents simply ignoring them.We informed Mr. Pace that this was too dangerous, but he didn't care at all. He said that
he had put up a sign on the pier and that if there were any casualties,the tenant would be responsible for the
consequences.There are three elderly people in our family who are over 80 years old.They are seriously ill and need to
rest.One time I had to call the police... We don't know what his house will be used for in the future.,for safety,we do
not want Mr. Pace build any path or staircase around our border due to our bad experience with him.

)wood ramp, 5 ft. x 7 ft. ( 35 SF )wood landing, 3.5 ft. x 3 ft.( 10.5 SF )wood stairs, 4 ft. x 55 ft.
( 220 SF )wood walkway w/4 ft. x8 ft ( 32 SF ) L wood landing and 8.3 ft. x 20.2 ft. (167.66 SF
), Elec. Pedestal , elec. Recep and water line w/faucet. Legalize 9 ft. x 7.5 ft. ( 67.5 SF ) hot tub
on deck and existing 19.7 ft.x 17.6 ft. deck( 346.72 SF ).
Remove existing wood bulkhead. Remove landing, staircase and portion of walkway. Remove
wood ramp and store on site for reuse, if feasible. Relocate existing shed on site as shown.
Relocate existing floating dock a min. of 8 ft. southerly and parallel to new bulkhead at 10 ft.
distance. Remove existing pilings and install two ( 2 ) 8 "diam. pressure treated pilings to
anchor dock. Remove seven ( 7 ) hardwood trees of various species and diameters as shown
on site plan.
Construct a new vinyl bulkhead in the same location as the existing, but at an elevated height
of 18 "greater than existing,with a total length of 198.5 LF, inclusive of the landward inset
bulkhead to create off canal boat dockage slip and two ( 2 ) returns. Construct 8 If. Of
retaining wall adjacent to staircase.The landward inset section would require an excavation
of approx. 350 cu. yds.Approx. 100 cu.yds to be used to backfill landward of the new vinyl
bulkhead to reestablish the slope.The remainder of the excavated material ( 250 cu.yds. +/-
)to be disposed of offsite.The inset bulkhead would be raised an additional 30 "+/'-about
14.5 ft. landward of the seaward point of the northerly slip opening to adjust for the grade
change. Construct a (3 )tread staircase @ 4 ft. x 3 ft.w/(4 ) 8" risers ( 12 SF ). ) Install a 5
step float step aluminum dock ladder as shown on plan. Install elec. pedestal and water line
with faucet to serve inset bulkhead as shown.
Reconstruct portion of removed walkway, deck and staircase in kind and in same location.
Install wood ramp or replace with aluminum ramp ( 3 ft.x 15 ft. ) at owner's discretion.
Proposed 8.7 ft x 19.7 ft. ft. ( 171.39 SF ) addition to existing deck (Total deck : 518.11 SF )
Establish a ten ( 10 ) ft. vegetated non turf buffer from southerly property line to bulkhead
inset and a ( 13 ft.) gravel non turf buffer area northerly of inset bulkhead as shown on the
site plan.
Plant seven ( 7 ) 2—3 "diam. caliper red cedars as shown on site plan

Pace Project Description
Legalize existing 6 ft. x 20 ft. ( 120 SF ) floating dock w/( 2) 8 'diam. pilings, 3 ft. x 15 ft. (45 SF
wood ramp, 5 ft. x 7 ft. ( 35 SF )wood landing, 3.5 ft. x 3 ft.( 10.5 SF )wood stairs, 4 ft.x 55 ft.
( 220 SF )wood walkway w/4 ft. x 8 ft (32 SF ) L wood landing and 8.3 ft. x 20.2 ft. (167.66 SF
), Elec. Pedestal, elec. Recep and water line w/faucet. Legalize 9 ft. x 9 ft. ( 81 SF ) hot tub on
deck.
Remove existing wood bulkhead. Remove landing, staircase and portion of walkway. Remove
wood ramp and store on site for reuse, if feasible. Relocate existing shed on site as shown.
Relocate existing floating dock a min. of 8 ft. southerly along same plane. Remove existing
pilings and install two ( 2 ) 8 "diam. pressure treated pilings to anchor dock. Remove seven ( )
hardwood trees of various species and diameters as shown on site plan.
Construct a new vinyl bulkhead in the same location as the existing, but at an elevated height
of 18 "greater than existing,with a total length of 198.5 LF, inclusive of the landward inset
bulkhead to create off canal boat dockage slip and two ( 2 ) returns.The landward inset
section would require an excavation of approx. 350 cu.yds. Approx. 100 cu. yds to be used to
backfill landward of the new vinyl bulkhead to reestablish the slope. The remainder of the
excavated material ( 250 cu. yds. +/- )to be disposed of offsite.The inset bulkhead would be
raised an additional 30 "+/'-about 14.5 ft. landward of the seaward point of the northerly
slip opening to adjust for the grade change. Construct a (3 )tread staircase @ 1 ft. x 12 ft. w/
(4) 8" risers ( 36 SF ). ) Install a 5 step float step aluminum dock ladder as shown on plan.
Install elec. pedestal and water line with faucet to serve inset bulkhead as shown.
Relocate existing floating dock a min. of 8 ft. southerly along the same plane. Remove existing
anchor pilings and install two (2) 8" diam . pressure treated anchor pilings.
Reconstruct portion of removed walkway, deck and staircase in kind and in same location.
Install wood ramp or replace with aluminum ramp ( 3 ft.x 15 ft. ) at owner's discretion.
Establish a ten ( 10 ) ft. non turf buffer f bulkhead inset and a ( 15 ft.) stone paver area o/a as
a non turf buffer northerly of inset bulkhead as shown on the site plan.
Plant seven ( 7 ) 2—3 "diam. caliper red cedars as shown on site plan
Reclamation dredging area as may be required as shown on site plan

Michael Kimack on behalf of ANDREW PACE requests a Wetland Permit for the existing 4'x55' wood
walkway from dwelling to"L" shaped 4'x8' wood landing to 3.5'x3' wood stairs to a 5'x7' wood landing to a
3'x15' adjustable wood ramp to a 6'x20' floating dock with two (2) 8" diameter pilings securing the float in
an "L" configuration; existing electric pedestal, electric recep and water line with faucet; remove existing
bulkhead, landing, staircase and portion of walkway; temporarily remove wood ramp and floating dock;
relocate existing 8.3'x20' shed; remove eight(8)trees; construct a new vinyl bulkhead in the same
location as the existing with an elevated height of 18" above existing; total length of bulkhead 198.5 linear
feet inclusive of the proposed landward boat basin bulkhead to create off canal boat dockage slip with a
15' north return and 10' south return; if necessary a one time incidental dredging within a 10' wide area
along new bulkhead to reclaim lost fill during reconstruction; excavate ±350 cubic yards of soil to create
the basin, of which ±100 cubic yards to be used to backfill along the landward side of the new vinyl
bulkhead to reestablish the slope; the remainder of the excavated material (±250 cubic yards) to be
disposed of off-site; the proposed basin bulkhead to be raised an additional ±30", about 14.5' landward of
the seaward point of the northerly slip opening to adjust for the grade change; construct a three (3)tread
staircase (1'x12' with (4) 8" risers); install a five (5) step float step aluminum dock ladder; install an electric
pedestal and water line with faucet for boat basin; reconstruct the portion of removed walkway, landing
and staircase in-kind and in same location as existing; relocate existing "L" shaped floating dock a
minimum of 8'to the south; remove existing anchor pilings and install two (2) 8" diameter pressure treated
anchor pilings; install 3'x15' (wood or aluminum) adjustable ramp in new location; install a 15' wide stone
paver area as a non-turf buffer area north of the new basin; and to establish and perpetually maintain a
10'wide non-turf buffer area along the landward edge of the bulkhead. Located: 205 Gull Pond Lane,

Michael Kimack on behalf of ANDREW PACE requests a Wetland Permit for the existing 4'x55'
wood walkway from dwelling to "L" shaped 4'x8' wood landing to 3.5x3'wood stairs to a 5"x7'wood
landing to a 3'x15' adjustable wood ramp to a 6'x20' floating dock with two (2) 8" diameter pilings
securing the float in an 1" configuration; existing electric pedestal, electric recep and water line with
faucet; remove existing bulkhead, landing, staircase and portion of walkway; temporarily remove
wood ramp and floating dock; relocate existing 8.3'x20' shed; remove eight (8) trees; construct a
new vinyl bulkhead in the same location as the existing with an elevated height of 18" above
existing; total length of bulkhead 198.5 linear feet inclusive of the proposed landward boat basin
bulkhead to create off canal boat dockage slip with a 15' north return and 10' south return; if
necessary a one time incidental dredging within a 10' wide area along, new bulkhead to reclaim lost
full during reconstruction; excavate±350 cubic yards of soil to create the basin, of which±100 cubic
yards to be used to backfill along the landward side of the new vinyl bulkhead to reestablish the
slope; the remainder of the excavated material (±250 cubic yards) to be disposed of off-site; the
proposed basin bulkhead to be raised an additional ±30", about 14.5' landward of the seaward point
of the northerly slip opening to adjust for the grade change; construct a three (3) tread staircase
(1''x12' with (4) 8" risers); install a five (5) step float step aluminum dock ladder; install an electric
pedestal and water line with faucet for boat basin; reconstruct the portion of removed walkway,
landing and staircase in-kind and in same location as existing; relocate existing "L" shaped floating
dock a minimum of 8'to the south; remove existing anchor pilings and install two (2) 8" diameter
pressure treated anchor pilings; install 3'x15' (wood or aluminum) adjustable ramp in new location;
install a 15° wide stone paver area as a non-turf buffer area north of the new basin; and to establish
and perpetually maintain a 10' wide non-turf buffer area along the landward edge of the bulkhead.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Basedupon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with LWRP Policy 6.3 and therefore, INCONSISTENT with
the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent,and other lands under their-jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
The as-built structures were constructed without Board of Trustee review or permit.
The existing trees proposed to be removed (other than the leaning one shown) should be to
further Policy 6. Mature trees provide many functions and benefits.
Minimize turf, fertilization, and irrigation on parcels adjacent to this low-flushing water body.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

At the meeting of the Southold Town Conservation Advisory Council held on Wed.,
December 6, 2023, the following recommendation was made:
Moved by Carol Brown, seconded by John Stein, it was
RESOLVED to SUPPORT the application of ANDREW PACE to remove and replace
wood bulkhead with new vinyl bulkhead at an elevated height of 18" greater than existing,
with landward inset for off canal boat slip. Relocate existing shed, and relocate existing
floating dock a min. of 8' southerly along same plane. Remove existing pilings and install
two (2) 8" dia. pressure treated pilings to anchor dock. Remove eight (8) hardwood trees
of various species and diameters. Inset bulkhead to be raised an additional 30" about
14.5' landward of the seaward point of the northerly slip opening to adjust for the grade
change. Construct a (3) tread staircase at 1'X 12' with (4) 8" risers (36 sf.) and install a 5'
step float step aluminum dock ladder. Reconstruct portion of removed walkway, deck and
staircase in kind and in same location. Install wood ramp or replace with aluminum ramp
(3'X 15') at owner's discretion, and establish a 10' non-turf buffer.

At this time the Pace application has been deemed incomplete. There are multiple issues with the plans and project
description. The shed needs to be permitted therefore the size of the shed is required on the plans and
description. What is the"easement area"?and what is the area to be seaward of the proposed steps, decking,
vegetated non-turf buffer area,other?This needs to be added to the plans and description. The dock, deck,steps and
walk are not permitted,the dimensions need to be added to the plan and description for each section of the
structure. Not all of the proposed bulkhead sections lengths are shown on the plans,this needs to be updated. Also,
what is"marine grade top board"? Is that pressure treated lumber or a fiberglass/plastic type material? It is being
proposed for the top cap. Will there be any water/electric proposed to be relocated or installed? That too needs to be
noted on the plans/description.
Please submit the revisions by end of day next Tuesday. If it is not received the application will have to be postponed to
January.

PROJECT DESCRIPTION FOR: Michael Kimack on behalf of

LOCATED: 205 Gull Pond Road, Greenport. SCTM# 1000-35-4-28.45
For a Wetland Permit for the existing 4'x55' wood walkway from dwelling to "L"
shaped 4'x8' wood landing to 3.5'x3' wood stairs to a 5'x7' wood landing to a
3'x15' adjustable wood ramp to a 6'x20' floating dock with two (2) 8" diameter
pilings securing the float in an "L" configuration; existing electric pedestal,
electric recep and water line with faucet; remove existing bulkhead, landing,
staircase and portion of walkway; temporarily remove wood ramp and floating
dock; relocate existing 8.3'x20' shed; remove eight (8) trees; construct a new
vinyl bulkhead in the same location as the existing with an elevated height of 18"
above existing; total length of bulkhead 198.5 linear feet inclusive of the
proposed landward boat basin bulkhead to create off canal boat dockage slip
with a 15' north return and,10' south return; if necessary a one time incidental
dredging within a 10' wide area along new bulkhead to reclaim lost fill during
reconstruction; excavate ±350 cubic yards of soil to create the basin, of which
±100 cubic yards to be used to backfill along the landward side of the new vinyl
bulkhead to reestablish the slope; the remainder of the excavated material (±250
cubic yards) to be disposed of off-site; the proposed basin bulkhead to be raised
an additional ±30", about 14.5' landward of the seaward point of the northerly
slip opening to adjust for the grade change; construct a three (3) tread staircase
(1'x12' with (4) 8" risers); install a five (5) step float step aluminum dock ladder;
install an electric pedestal and water line with faucet for boat basin; reconstruct
the portion of removed walkway, landing and staircase in-kind and in same
location as existing; relocate existing "L" shaped floating dock a minimum of 8'
to the south; remove existing anchor pilings and install two (2) 8" diameter
pressure treated anchor pilings; install 3'x15' (wood or aluminum) adjustable
ramp in new location; install a 15' wide stone paver area as a non-turf buffer area
north of the new basin; and to establish and perpetually maintain a 10' wide non-
turf buffer area along the landward edge of the bulkhead.

1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold.Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency.-,*Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A pr000sed" action.'will be. evaluated. as- to its si ificant
beneficial!and`adverse effects upon the coastal area(which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each ans` .er must'be explained 'in detail, listind both supporting and non-

Pace Project Description
Remove existing wood bulkhead. Remove deck, staircase and portion of walkway. Remove
wood ramp and store on site for reuse, if feasible. Relocate existing shed on site as shown.
Relocate existing floating dock a min. of 8 ft. southerly along same plane. Remove existing
pilings and install two ( 2 ) 8"diam. pressure treated pilings to anchor dock. Remove eight
8) hardwood trees of various species and diameters as shown on site plan.
Construct a new vinyl bulkhead in the same location as the existing, but at an elevated height
of 18 "greater than existing, with a total length of 198.5 LF, inclusive of the landward inset
bulkhead to create off canal boat dockage slip and two ( 2 ) returns.The landward inset
section would require an excavation of approx. 350 cu.yds. Approx. 100 cu. yds to be used to
backfill landward of the new vinyl bulkhead to reestablish the slope.The remainder of the
excavated material ( 250 cu.yds. +/- )to be disposed of offsite.The inset bulkhead would be
raised an additional 30"+/ '-about 14.5 ft. landward of the seaward point of the northerly
slip opening to adjust for the grade change. Construct a (3 )tread staircase @ 1 ft. x 12 ft.w/
(4) 8" risers ( 36 SF ). ) Install a 5 step floatstep aluminum dock ladder as shown on plan.
Relocate existing floating dock a min. of 8 ft. southerly along the same plane. Remove existing
anchor pilings and install two (2) 8" diam . pressure treated anchor pilings.
Reconstruct portion of removed walkway, deck and staircase in kind and in same location.
Install wood ramp or replace with aluminum ramp ( 3 ft.x 15 ft. ) at owner's discretion.
Establish a ten ( 10 )ft. non turf buffer as shown on the site plan.
