For a Variance to the New York State PETITION NO. 2001-0965 Uniform Fire Prevention & Building Code ------------------------------------------------------- Upon the application of North Bay Properties, Inc., filed pursuant to 19 NYCRR 450 on October 23, 2001 and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to a new building of Al (one family)occupancy, two-stories in height, of type 5 (wood frame)construction, approximately 5,500 square feet in total gross area, located at 8869 Oregon Road, Cutchogue, Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: 9 NYCRR 711.2(b), which requires that the height of non-habitable space be a minimum of 7 feet 0 inches. [The petitioner wishes that a toilet room with a ceiling that slopes to a height of less than 7 feet 0 inches high be permitted.] FINDINGS OF FACT 1. The subject toilet room annexes a bedroom on the second story and is located under a sloping roof where the height below the finished ceiling varies from 8 feet to about 5 feet. 2. The toilet room contains a lavatory and a water closet. The toilet room will have a minimum headroom clearance of 6 feet at the bathroom fixtures. 3. In that the toilet room is located within a dwelling unit and is to be used by individuals accustomed to their surroundings, it does not appear that the height of the toilet room ceiling would have a substantial negative effect on health or life safety. 4. At least one more toilet room is located within the subject dwelling which meets the ceiling height requirements of the code. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.2(b), to permit a toilet room with a ceiling that slopes to a height of less than 7 feet; be and is hereby PROPOSED TO BE GRANTED. This DECISION is issued under 19 NYCRR 450.6.
