Town of Southold , Town Hall Southold,New York 11971 �— - Attetion:Bruno Semon RE:Hal&Doric Sutherland 3715 Stillwater Ave. Cutchogue SCTM#1000-136-2-12 Dear Mr. Semon: In your letter to me of July 13,regarding the above project,you stated that you believed that the Sutherlands violated their building permit. Please let me state why I do not believe that my clients are in violation of the building permit,and should not be required to farmsh further documentation regarding this project. To be found in violation of the permit,they must have been found to have done work beyond that specified in the approved plans, I do not believe that the scope of work has been changed enough to satisfy this requirement. During the project I visited several times,and on Sunday July 15, 1 inspected the premises to determine if there had been any change in the scope of work,as set out in the approved plans. I was unable to find any significant work in excess of what the plans had indicated. I know you are aware that we reduced the scope of work in this project before approval of the plans,so that there would be no question as to whether it complied with the'501/6'improvement requirement. Mr.Fischetti,PE did an extensive analysis based upon the plans and specifications we have all been working with,submitted to and examined by your department,to demonstrate that indeed the project was within the prescribed limits. According to Mr.Fishchem's analysis,which your department accepted,the Suthertands should be able to file for,and complete, the work for their handicapped access ramp and deck,and still be within the FEMA guidelines. Since they have a handicapped friend who visits regularly,they had been planning on carrying out that phase of the work as well. It would be a terrible thing if they should have to forego the ramp. From our discussion on the telephone,I was led to believe that you might now be considering the replacement of the furnace by the preceding owner,some years prior to the present work,as now being part of the scope. But that work was replacement of failed egwpmem,which had broken down,and replacement was a normal course of maintenance. It should not be included now in the scope of work of the new owners. (Certainly you issued no warning to us that work done by the prior owners which could be seen prior to the beginning of the current project would be considered)I myself saw the existing furnace,and I am sure Mr.Fish noted it as well when he first reviewed this project. That being the case,I do not see how you can now discredit Mr.Fischetti's analysis,which was used to document the relative percentages of work done,atter having accepted it as a basis for issuing the permit in the first place. Over the course of a building's life,many items will be replaced periodically,and such replacements are maintenance not`improvements'. If it were the intent of the law to consider such items as`improvements',a complete log of every bit of work done over the years would have to be kept. Eventually,a final coat of paint might bring the total list over the 50•/1 threshold. Then,it would seem,if any wok requiring a building permit were to be done,no matter how insignificant,full compliance with FEMA would be required? I don't believe that is the intent of the law. V st9, 2001 Page 2 odic replacements of items such as roofing,hot water heaters,furnaces,plumbing fixtures,painting,and over longer periods of time,windows,flashing and siding,must all be considered as maintenance items. When such work does not occur in conjunction with other major work(such as might require filing for a building permit),it is not subject to FEMA guidelines. And it cannot be construed to be part of the value of later work done by a different owner. The furnace in question was installed by the prior owner. All new work complies with FEMA in that none is below the 8-foot elevation. All work complies with the plans as approved by your department,which you found at the time to be in compliance with FEMA guidelines. Certainly,this project has complied with the intent of FEMA,which is to prevent new construction work,subject to flood damage,from being done willy-nilly in flood prone areas. All the new work is above the 100 year flood level. In as much as the work complies with the approved plans,which had been determined by your department to be in compliance with FEMA,I am asking that you accept the work as done(and quite nicely I might add)and issue the Sutherlands a Certificate of Occupancy. These are some of the reasons that we recommend that you have the premises inspected just before Closing by a licensed Professional Engineering firm specializing in pre-purchase home inspections. Otherwise, you are taking a risk regarding problems that develop between the time of the initial inspection and the time of Closing, as well as problems that are in locations blocked by personal property, debris, furniture, and stored material. UTILITIES AND STRUCTURE: A. FURNACE AND HEATING: This 1-zone, oil fired, forced hot air, Intercity Products system has a rating of 105,000 BTUs per hour. This should be sufficient for the production of heat considering rough estimates of the size of the premises, insulation present, window heat loss, and other heat losses. However, as mentioned earlier, the furnace was not operational at the time of our inspection. Make sure that the furnace is demonstrated to your satisfaction prior to Closing. Before Closing, have a heating contractor test the air in the ducting to make sure that the unhealthy products of combustion (which normally go up the flue) are not infiltrating the ducts and contaminating the fresh air. This is a test which is important but which is beyond the scope of this walk-through inspection. Make sure the heating contractor checks for cracks on the heat exchanger on the interior of the system. Have the results put in writing and given to you. If you do not do this, you take the risk that you will experience this type of problem after you move in. If you cannot have the system checked prior to Closing, make sure that you have a heating contractor do it for you immediately after you move in since it involves hazards to health. A heating contractor should be called to provide an efficiency test. This will help indicate what must be done internally to upgrade the system and/or help determine if there are any internal blockages in the flue or furnace. Internal blockage can result in the buildup of dangerous gases in the house. If you leave the house vacant during the winter do not turn the heat down to save fuel unless you are willing to risk frozen pipes and the floods which can result. In our opinion this is too big a risk since the damage from cracked and flooding pipes can be immense in relation to the fuel saving. RICHARD L. HEWER, P.E., P.C.
