No. 4795- CHARLES BRIENZA 1000-15-9-1.5 Location of Property: 1240 Latham Lane, Orient Date of Public Hearing: April 6, 2000 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The subject property is a 41,346 sq. ft. waterfront parcel located on the Long Island Sound. The lot has 135 ft. frontage along the north side of Latham Lane and lot depth along the east/southeast side of 193.38 ft. The property is unimproved and a rock wall exists at the northeast comer (along the stone beach) as shown on the February 10, 2000 site plan prepared by Fairweather-Brown Design Associates. BASIS OF APPEAL- Building Inspector's Notice of Disapproval dated January 20, 2000, denying an application for a permit to build a dwelling because it will be setback less than 100 feet of the bluff(rock wall) as required by Code Section 100-239.4A(1). RELIEF REQUESTED: Applicant requests a variance authorizing a dwelling with deck areas in a location 102 feet from the mean high water line and 60+-feet from the bank(near rock wall). REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) An undesirable change will not be produced in the character of the neighborhood or a detriment to nearby properties because building envelope as proposed is in keeping with the neighboring home locations in reference to the distance from the mean highwater line as approved by the Town Trustees. (2) The benefit sought cannot be achieved by some method, feasible for the applicant to pursue other than a variance because compliance with the code would render the lot unbuildable and moving the envelope would require further variances. (3) The amount of relief requested is not substantial. (4) The variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. (5) The action set forth below is the minimum necessary and at the same time preserves and protects the character of the neighborhood and the health, safety and welfare of the community. The parcel fronts the Long Island Sound. The-Flood Insurance Rate Map(FIRM)for Suffolk County, New York Panel 36103CO086G dated May 4, 1998 indicates that the flood zone is VE (el 13). The applicants surveyor places the landward limit of the VE zone at or about the 8 foot contour. Landward of the VE zone is Zone X. The location of the proposed house would place it entirely within Zone X according to the FIRM. However, portions of the house as proposed would be -seaward of the 13"contour, placing it at risk to flooding. My office.in Albany.has informed me that because we have a flood elevation, the vertical elevation is what matters, not the placement of the horizontal limit to the flood zone found on-the FIRM. If the structure isnot in compliance with the appropriate VE zone standards the premium for a flood insurance policy could be as high as 50 cents for every dollar of coverage. What I suggest is-you-inform the applicant in writing not only of the flood code requirements as you normally'would, but also of the mandatory purchase requirement which may result, and the high premium potential. This letter would not be unlike that used when a variance is.issued to the flood code. Valley flashing to extend not less than 7" on each side of center of valley on slopes 6 in 12 or more and not less than 10" on either side on slopes less than 6 in 12. 3. METAL GUTTERS Scope: Gutters and leaders 1. Provide 3 3/4"x 4" white aluminum half-round seamless gutters and leaders as appropriate. Location of leaders shall be coordinated with Architect. GYPSUM WALLBOARD Scope: Gypsum Wallboard Partitions and Ceilings 1. Gypsum wallboard shall be eased edge type, conforming to ASTM C36, and shall be "Sheetrock SW" by U.S. Gypsum Co., or equal as approved by the Architect. Gypsum wallboard thicknesses shall be as indicated on drawings. 2. Fire-rated gypsum board shall be installed where indicated, and in accordance with manufacturer's recommendations to provide required fire separation. 3. Water resistant Gypsum wallboard, to be used in all bathrooms, shall conform to ASTM C36 and be "Sheetrock W/R" as manufactured by U. S. Gypsum Co., or equal as approved by the Architect. Cement board to be used on all shower walls. 4. Joint reinforcing tape, adhesive and laminating materials shall conform to the "Standard Methods of Testing Joint Treatment Materials for Gypsum Wallboard Construction", ASTM C474. 5. Metal cornerbead and edge trim shall conform to ANSI Standards A971 and shall be "Dur-a-bead" and "USG Metaltrim - No. 200 Series and No. 400 Series" as manufactured by U.S. Gypsum Co., or equal as approved by the Architect. WOOD FLOORING Scope. New wood floors as indicated on finish schedule. 1. Wood Flooring shall be 3/4" x 2-1/4" tongue and groove Red Oak strip flooring, No. 1 grade, installed over red rosin paper. Fill and sand flooring, and finish with three (3) coats clear high-gloss water-based polyurethane. CERAMIC TILE FLOORING AND WALLS Scope: Ceramic tile floors and walls as indicated on finish schedule, and drawings. 1. Grout color and width to be determined by owner and architect. 2. Tops of tile walls shall receive bullnose top trim pieces. PAINTING Scope: Painting or staining of all surfaces, including but not limited to: A. Exterior Siding and Trim (inc. Columns) B. Gypsum Wallboard C. Interior Woodwork 1. Painting contractor shall not apply any paint or finish to surfaces not in proper condition for finishing. The Contractor shall notify the Architect of any surface which is not in satisfactory condition. Painting or finishing of any surface will be considered acceptance of that surface by the Painting Contractor. 2. Paint droppings shall be removed, and any damaged surfaces shall be restored to a condition satisfactory to the Architect. 5. Contractor shall properly prepare all surfaces before painting or staining by cleaning, filling, removing rust, sealing knots, etc., to ensure smooth and uniform surfaces without blemishes, dirt and mildew to insure maximum durability of the finish. All surfaces must be well cured, clean and dry, all nail holes to be countersunk, spot primed and putty flush to surface prior to finishing. 6. Flow the finishes on smoothly, with the proper thickness, without runs, skips, sags, or defects. Paint neatly around glass and other terminating edges. 7. If stains, discolors, or undercoats show through final coat, work shall be covered by additional coats until finish is of uniform color satisfactory to the Architect. 8. All exterior paints and stains to have mildew retardant added in accordance with manufacturers specifications. 9. Back prime any exterior trim, not already factory primed, prior to installation. 10. All exterior wood trim and siding shall be primed with Cabots problem solver 48011 primer and stained with 2 coats of Cabots solid stain(color to be selected). 11. Interior wood trim, paneling and doors shall be painted with one (1) coat of approved latex enamel undercoat and sealer and two(2)coat of semi-gloss latex enamel paint. 12. HVAC systems will include, but are not limited to installation of new oil-fired Buderus boiler, venting, all system related piping, ductwork, valving, controls, etc. as required for a new Three (3) zone hybrid hot-water forced-air heating system, with 5 tons total air conditioning, through 3 air handlers. Provide fourth zone for Buderus hot water storage tank. 2. All work shall conform to the requirements of the New York State Uniform Fire Prevention Building Code and the Suffolk County Department of Health. In the event of conflict,the more stringent requirements will apply. 3. All equipment, controls, accessories, etc., shall conform to the New York State Environmental Conservation Law with regards to energy conservation. All equipment will be U.L. approved. All Sheetmetal ductwork shall comply with SMACNA Standards. 4. Workman's Qualifications: All work on the HVAC system shall be performed by or under the direct supervision of an experienced Heating, Ventilating, and Air-Conditioning mechanic with proven experience on the type of system specified. 5. The Contractor shall obtain, submit and pay for all permits, certifications, licenses and inspections as required by state, local and federal authorities, and any other applicable jurisdiction. 6. Provide any cutting and patching that may be required, to be performed by mechanics skilled in this type of work. Core drilling is to be used for all concrete cutting. 7. This includes, but is not limited to scheduling, routing, equipment layouts, space requirements, and mounting details. All material shall be installed in a workmanlike manner, square, plumb, and tight. a. BOILER shall be Buderus G205, size 34, 104,000 BTUh net rating , or approved equal. b. CIRCULATORS for each zone shall be B & G, or approved equal, series 100, sized for appropriate gpm with settable flow check. Pipe size is to be 1-1/2 inch. Seals to be suitable for glycol solution C. THERMOSTATS shall be programmable five (5)day/two(2) day with day/night setback, as manufactured by Honeywell or approved equal. d. FUEL TANK shall be new, 275 gallon capacity oil fuel tank to be located in basement. e. CONTROL WIRING to be furnished and installed by the HVAC contractor. Line voltage wiring to be by the Electrical contractor. f FILTERS shall be Space Gard model 2200, or approved equal, high-efficiency units. Filters to be supplied for each zone and sized for its design CFM. g. HUMIDIFIER to be Auto Flow Model 200-P, or approved equal, power unit with its own humidistat. h. DUCT WORK shall be fabricated in accordance with SMACNA Standards including transitions, bends, take -offs, etc., designed for minimum static losses. Duct material to be galvanized sheet metal of 26 gauge up to 24 inches wide and 24 gauge above 24 inches wide. Seams and joints shall be such that leakage is not more than 2%. Ducts shall have rigid fiberglass acoustical and thermal liners, one inch thick for supply, and 1/2 inch thick for return. Round duct shall be unlined. Round duct shall have a minimum of 8' lined rectangular duct downstream of fan for noise control. i. DIFFUSERS AND GRILLS: Wall and ceiling units shall be Hart& Cooly, Air Guide, or approved equal with adjustable opposed blade dampers, adjustable discharge vanes and enamel finished trim. PLUMBING Scope: Furnish all labor, materials, equipment, plant, tools, and services necessary and required for proper and complete installation of all Plumbing Systems and related work including, but not limited to: water supply and distribution pipes, drainage piping„ valves, traps, waste and vent piping, including all their respective connections, devices, appurtenances within the building lines of the premises. Plumbing fixtures shall be furnished by owners and installed by contractor. 1. All work shall conform to the requirements of the New York State Uniform Fire Prevention Building Code and the Suffolk County Department of Health. CHROME PLATED PIPE, FITTINGS, AND TRIM shall have a minimum thickness of 0.00002" chromium deposited over a minimum thickness of 0.0002" nickel plating. All pipe, fittings, and trim shall be thoroughly cleaned and polished before plating. C. VAPOR VENT PIPING shall be ABS plastic schedule 40 (ASTM D2661-74) or PVC plastic (ASTM D1784) where concealed. Exposed vent piping to be copper or copper enclosed. Offsets in vent systems shall use 45 degree fittings. d. FLASHING MATERIAL shall be sheet lead, weighing not less than 4 pounds per square foot. All lead shall be 99.5%pure. i. FITTING MATERIALS shall conform to the type of piping material used. j. UNIONS shall have metal ground joint seats. In copper piping or copper tubing 2" or smaller, unions shall be cast bronze 150 lb. class with bronze to bronze seats and with screw ends, brazing ends, solder ends, or with adapters, as required. All other unions shall be cast flanged unions of materials and of working pressure to correspond with pipe. k. VALVES shall be first quality, free from all imperfections and defects. All valve parts of same manufacture, size and type shall be interchangeable. All hand operated valves shall be designed to open in a counter-clockwise direction. Unless otherwise shown, all valves installed in water piping systems shall be built for 125 psig WSP. 1. NON-FREEZE WALL HYDRANTS shall be 3/4" straight inlet connection similar or equal to Wade W-8604. in. CLEANOUTS shall be installed in drainage piping where shown and/or specified. PANELBOARDS: Main ratings and branch circuit breaker ratings shall be of size and number as indicated or required. Local Panelboard centers shall be plug-on type construction. All current carrying parts of the buss assembly shall be plated. Terminals for feeder conductors to mains and branch neutral shall be UL listed as suitable for the type conductor specified. The load center bus assembly shall be enclosed in a steel cabinet. The size of the wiring gutters and gauge steel shall be in accordance with UL standards No. 67 and 50. Fronts shall include door and flush tumbler type lock with all panels keyed alike. Panelboard boxes and fronts shall have corrosion resisting phosphate treatment and baked enamel finish. Load panelboard centers shall be UL listed, Square 'D' Type QO, or equal. b. BRANCH CIRCUIT BREAKERS: Panelboards shall be equipped with quick-make, quick-break thermal-magnetic trip indicating, and have common trip on all multi-pole breakers. Trip indication shall be clearly shown by the breaker handle taking position between ON and OFF when the breaker is tripped. Breakers shall be plug-on type Branch circuit breakers feeding convenience outlets shall have sensitive instantaneous trip settings of not more than ten times the trip rating of the breaker to prevent repeating arcing shorts resulting from frayed appliance cords. Single pole 15 and 20 amperes circuit breakers shall be UL listed as "Switching Breakers" at 120V AC and carry the SWD markings. Circuit breakers shall be UL listed. Single pole breakers with handle ties not acceptable. C. GROUND RODS (ELECTRODES) shall be 5/8" x 8' copper weld and meet all requirements of the applicable provisions of the NEC. d. At least that's what should happen, but then the lawyers get involved. On the surveyor's -map,does the*VE zone cross any part of the footprint? If so,then it is an.easy solution: the house is in the VE zone and must be built to the 13'elevation. If that isn't the case (the-footprint is completely outside of the surveyor's V zone), is there any disturbance of the property anyplace in the V,zone? If so,they need a floodplain development permit,.and the local community should require building to the•bfe. Now, here's.the,tricky part., If the V zone boundary on the surveyor's map is waterward of any disturbance on the'property, a lawyer may argue that the flood map is a zoning map and a community may not regulate in areas not covered by the"zone." ''This is an ongoing issue in Westchester County where a map incorrectly placed a property outside of the flood zone when It was•in by elevation. The local community did not require elevations. FEMA.says they're in and non-compliant and the property owner got a mandatary purchase requirement as such. Lawsuits are underway. Al Knapp,Is involved as a consultant. FEMA will argue that Its in by elevation, but state law may hold that its out-by the map. The bottom line: the developer would be a fool not to build to the appropriate V zone specification. Law sults will certainly ensue. If the surveyor is right,the FIRM is wrong, but the flood elevations are still right: The owner•will not only be at'risk,.but will probably get a"submit to rate"on their insurance. 'Thousands of dollars per-year, One tool for the local building inspector: the Flood Insurance Study is accepted by the community along with'the FIRM. It Is therefore.a legal document and if it says the bfe is 13 feet, it is the ultimate authority. I would argue that the-local community may use that as its authority, especially given that the map is based on the FIS and that mapped flood zone boundaries,due to the inaccuracies inherent in topographical mapping,will always contain some inaccuracies. If the local administrator questions the surveyor's map, it is within his rights (model law, 4.4-1(3), he may require additional'data. After all, even licensed surveyors (and engineers)make mistakes. Item B: Permittee's Contractors to Comply with Permit The permittee is responsible for informing its independent contractors, employees, agents and assigns of their responsibility to comply with this permit, including all special conditions while acting as the permittee's agent with respect to the permitted activities, and such persons shall be subject to the same sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee. Item C: Permittee Responsible for Obtaining Other Required Permits The permittee is responsible for obtaining any other permits,approvals,lands,easements and rights-of-way that may be required to carry out the activities that are authorized by this permit. Item D: No Right to Trespass or Interfere with Riparian Rights This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. GENERAL CONDITIONS General Condition 1: Facility Inspection by the Department The permitted site orfacility,including relevant records,is subjectto inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL.Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. General Condition 2: Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify,supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. General Condition 3: Applications for Permit Renewals or Modifications The permittee must submit a separate written application to the Department for renewal, modification or transfer of this permit. Such application must include any forms or supplemental information the Department requires. Any renewal, modification or transfer granted by the Department must be in writing. The permittee must submit a renewal application at least: a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES), Hazardous Waste Management Facilities(HWMF), major Air Pollution Control (APC) and Solid Waste Management Facilities (SWMF),and b) 30 days before expiration of all other permit types. Submission of applications for permit renewal or modification are to be submitted to: NYSDEC Regional Permit Administrator, Region 1, SUNY Bldg#40, Stony Brook, NY 11790-2356 General Condition 4: Permit Modifications, Suspensions and Revocations by the Department The Department reserves the right to modify, suspend or revoke this permit. The grounds for modification, suspension or revocation include: a) the scope of the permitted activity is exceeded or a violation of any condition of the permit or provisions of the ECL and pertinent regulations is found; b) the permit was obtained by misrepresentation or failure to disclose relevant facts; c) new material information is discovered; or d) environmental conditions, relevant technology, or applicable law or regulation have materially changed since the permit was issued. If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State,the owner may be ordered by the Department to remove or alter the structural work,obstructions,or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be completed,the owners, shall,without expense to the State,and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. 2. The State of New York shall in no case be liable for any damage or injury to the structure orwork herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. 3. Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission, consent or approval from the U.S.Army Corps of Engineers,U.S.Coast Guard, New York State Office of General Services or local government which may be required. 4. All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 5. Any material dredged in the conduct of the work herein permitted shall be removed evenly,without leaving large refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. 6. There shall be no unreasonable interference with navigation by the work herein authorized. 7. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall,without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 8. If granted under 6NYCRR Part 608,the NYS Department of Environmental Conservation hereby certifies that the subject project will not contravene effluent limitations or other limitations or standards under Sections 301, 302, 303, 306 and 307 of the Clean Water Act of 1977(PL 95-217)provided that all of the conditions listed herein are met. 9. At least 48 hours prior to commencement of the project,the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be signed and returned, along with photographs of the completed work and, if required, a survey. 10. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the applicant or his agent as part of the permit application. The toe armor shall consist of 5-ton stone, minimum weight. A 30 foot no disturbance buffer zone shall be established landward of the toe armor to protect the values of the tidal wetland. 2. Any debris or excess material from construction of this project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for disposa). No debris is permitted in tidal wetlands and or protected buffer areas. 3. During construction, concrete or leachate shall not escape or be discharged, nor shall washings from transit mix trucks, mixers, or other devices enter tidal wetlands and or protected buffer areas. 4. No excavation of the beach is authorized for the purpose of obtaining fill or stone materials. 5. Equipment operation below apparent high water is strictly prohibited. 6. Necessary erosion control measures i.e.,hay bales,silt fencing,etc.are to be placed on the downslope edge of any disturbed area. This sediment barrier is to be put in place before any disturbance of the ground occurs and is to be maintained in good condition until thick vegetative cover is established. The parcel fronts the Long Island Sound. The-Flood Insurance Rate Map(FIRM) for Suffolk County, New York Panel 36103CO086G dated May 4, 1998 indicates that the flood zone is VE (el 13). The applicants surveyor places the landward limit of the VE zone at or about the 8 foot contour. Landward of the VE zone is Zone X. The location of the proposed house would place it entirely within Zone X according to the FIRM. However, portions of the house as proposed would be .seaward of the 13' contour, placing it at risk to flooding. My office.in Albany.has informed me that because we have a flood elevation, the vertical elevation is what matters, not the placement of the horizontal limit to the flood zone found on-the FIRM. If_ aby portion of th meted seawa a 13 contour you m uIld�— Otherwise FEMA will say y r community is non-compliant.with the National Flood Insurance program which could result in sanctions. In addition',the property in question will get a mandatary purchase requirement. This means that.flood insurance will be required in order to secure a federally backed mortgage. If the structure isnot in compliance with the appropriate VE zone standards the premium for a flood insurance policy could be as high as 50 cents for every dollar of coverage. What I suggest is-you-inform the applicant in writing not only of the flood code requirements as you normally•would, but also of the mandatory purchase requirement which may result, and the high premium potential. This letter would not be unlike that used wher!a variance is.issued to the flood code. 1 have attached a sample variance letter for your use.
