Goehringer SOUTHOLD, L. !., N.Y. 11cJ~1 TELEPHONE (516) 765-1809 MINUTES SOUTHOLD TOWN BOARD OF APPEALS MARCH 31, 1980 A special meeting of the Southold Town Board of Appeals was held on Monday, March 31, 1980 at 4:00 o'clock P.M. at the Southold Town Hall, Main Road, Southold, New York 11971. Present were: Charles Grigonis, Jr., Chairman; Terry R. Tuthill; Gerard P. Goehringer. Absent were: Serge Doyen, Jr. and Robert J. Douglass. On motion by Mr. Grigonis, seconded by Mr. Tuthill, it was RESOLVED, that the following appeals be scheduled and adver- tised for a public hearing to be held at the next regular meeting of this Board, to wit, April 10, 1980 in addition to those previ- ously scheduled: 8:45 P.M. 8:55 P.M. Appeal No. 2682. Application of ROBERT L. BOGER for a Variance to the Zoning Ordinance, Article III, Sec. 100-31 for permission to construct dwelling with insufficient front and~rear yard setbacks. Location of property: North Side of Willow Point Road, Arshamomaque, Southold, NY. Appeal No. 1 (Flood Plain Elevation). Applica- tion of ROBERT L. BOGER for a Variance to the Flood Damage Prevention Law of the Town of Southold, Sections 46-15 and 46-19B(1) for permission to construct basement below the restricted base flood elevation in a V-4 Zone. Location of property: North side of Willow Point Road, Arshamomaque, Southold, NY. Vote of the Board: Ayes: Messrs. Grigonis, Tuthill and Goehringer. Absent: Messr. Doyen and Douglass. -- S~uthold Town Board of Appeals -2- March 31, 1980 On motion by Mr. Grigonis, seconded by Mr. Tuthill, it was RESOLVED, that in the matter of ROBERT L. BOGER in Appeal No. 2682, this Board has received information from the Suffolk County Department of Health Services that public water should be available to service the proposed project, and that special consideration will be given to the sewage disposal system due to poor soils in_the area, and that the Board of Appeals has received their suggestion to proceed with the variance applica- tion and if same is approved that a condition be added subjecting it to Suffolk County Health Services Department approvals; and WHEREAS, this Board has received a "Tidal Wetlands Notifica- tion Letter Approval" from the N.Y.S. Department of Environmental Conservation, dated 3/18/80 in which they state that it will not be necessary to file a permit application with the D.E.C. to erect a one,family dwelling on Lot 25, Map of Lots at Willow Point, on the north side of Willow Point Road, the subject of this application, and that the Board of Appeals has received their suggestion that the house shall be set back a minimum distance of 35 feet from mean high water line, and cesspool or leaching rings shall be located at least !00 feet from mean high water line; and WHEREAS, this Board has been advised from the Suffolk County Planning Commission that the Planning Commission will not consider this application until after this Board has made its final deter- mination and has submitted copies of all documents pertaining to this matter, NOW, THEREFORE, this Board has determined after review of the Environmental Assessment Form which has indicated that no significant adverse effects to the environment were likely to occur, submitted with the subject application, and after review of the documents submitted therewith, that this matter is classi- fied as a Type II Action, not having a significant effect upon the environment, pursuant to Section 617.13 of the New York State Environmental Quality Review Act, and Section 44-4 of the Southold Town Code.
