For a Variance to the New York State PETITION NO. 1999-0032 Uniform Fire Prevention & Building Code ------------------------------------------------------- Upon the application of Donald A. Denis R.A., filed pursuant to 19 NYCRR 450 on January 20, 1999, and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to the construction of a new Al (one family dwelling) occupancy, one story in height, of type 5 (wood frame) construction, approximately 2,952 square feet in area, located at Arbor Lane, Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: 9 NYCRR 717.3(e)(4), which requires that floor-mounted fuel-burning heat-producing equipment within a garage located below grade, or within a below-grade space opening directly into a garage, shall be installed on a noncombustible platform not less than 18 inches above the floor. [The petitioner requests relief to allow floor-mounted fuel-burning heat-producing equipment located within a below-grade space opening directly into a garage, be installed on a noncombustible platform 16 inches above the floor.] FINDINGS OF FACT 1. A raised poured concrete platform was constructed on the slab of the cellar for the installation of fuel-burning heat-producing equipment for the new dwelling that is the subject of this petition. The cellar opens directly to a garage that is located below grade. 2. The poured concrete platform was only constructed to a height of 16 inches. This error was not realized until the equipment was installed and the building was ready for final inspection. 3. At this time the petitioner states that the cost to extend the platform would be excessive at this point. 4. The housing for the fuel-burning, heat-producing equipment that is located on the poured concrete platform is made of non-combustible material and is constructed in a manor that raises the actual burner and fuel Ci printed on recycled paper Petition No. 1999-0032 Page 2 connection to more than 18 inches above the floor which would satisfy the intent of the Code. 5. An interconnected fire-and smoke-detecting alarm device has been installed on the ceiling in close proximity to the fuel-buming, heat-producing equipment in question. 6. The local Code Enforcement'Official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 450.6. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 717.3(e)(4), to permit floor-mounted fuel-burning heat-producing equipment located within a below-grade space opening directly into a garage to be installed on a noncombustible platform 16 inches above the floor; be and is hereby PROPOSED TO BE GRANTED. This DECISION is issued under 19 NYCRR 450.6. Unless obiected to by the petitioner in a writing received by the Department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties.
