HomeMy WebLinkAboutLP-11/14/2023 LAND PRESERVATION COMMITTEE MEETING Minutes & Discussion Notes from Meeting held Tuesday, November 14, 2023 at 7:00 p.m. This Regular Meeting was held in the Annex Executive Board Room, located on the 2nd floor at Southold Town Hall Annex, 54375 Route 25 (Main Road), Southold, New York. The public had access to view and listen to the meeting as it was happening via Zoom. If an attendee did not have access to a computer or smartphone, there was an option to listen in via telephone. Comments from the public may not be solicited nor received without an appointment. It is expected that the Committee will enter into Executive Session* at some point after opening the Regular Meeting for the purpose of discussing applications regarding proposed acquisitions of real property where publicity would substantially affect the value thereof. Committee Minutes and Administration • Acceptance of LPC meeting minutes from October 3, 2023 MOTION made by Eric Keil, seconded by Sam McCullough, to accept the October 3, 2023 LPC meeting minutes. Motion carried: 4/0 (Will Lee and Kim Krupski abstained) • Next LPC Meeting Date: November 28, 2023 General Preservation • PDR Program Changes— Update re: Code Committee Meeting and 11/8 Town Board Work Session The Committee agreed to take this item out of order and revisit after Executive Session. Inquiries/Applications for Uses or Structures on Preserved Property • None Stewardship and Management • Richard Principi Jr. Further North Farm LLC SCTM# 1000-108.4-1.3 and 1.4 — Potentially Improper Storage of Equipment Unrelated to Agricultural Production on Easement Area A neighbor reported to Eric that Mr. Principi was storing non-agricultural equipment on DRS land. On November 6, Eric observed the easement area from a neighboring farm with permission from the owner. Eric explained that he observed and photographed roughly 15 pieces of equipment unrelated to agricultural production on the northern end of the easement area, including a screening plant, multiple boats, and several trucks that appeared to be unregistered. Committee members recalled that, during the Committee's March 2023 site visit, they observed several pieces of heavy machinery on the DRI portion of the property. Mr. Principi acknowledged that he was storing the equipment until it could be shipped overseas. The Committee also discussed their concerns that Mr. Principi may be removing topsoil from the easement area but noted that it is difficult to investigate that claim. The Committee determined that the use of the easement area that Eric observed is unrelated to agricultural production and violates the terms of the Town's easement. The Committee also discussed their belief that the use violates other provisions of the Town Code and directed Lilly to refer the matter to the Town Attorney's office and Code Enforcement for follow up. Should Code Enforcement determine that Mr. Principi's storage of equipment violates other provisions of the Town Code,the Committee recommended that Code Enforcement ticket each piece of equipment separately. Land Preservation Applications & Potential Applications: • EXECUTIVE SESSION- Proposed Acquisitions of Real Property Where Publicity Would Substantially Affect the Value Thereof MOTION made by Kim Krupski, seconded by Anne Murray, to enter into EXECUTIVE SESSION. Motion carried: 6/0 The LPC members entered into EXECUTIVE SESSION at 7:27 p.m. Meeting locked. o Lillian McCullough, Land Preservation Executive Assistant, gave updates on inquiries, new applications, appraisals and current applications. MOTION made by Anne Murray, seconded by Eric Keil, to exit Executive Session. Motion carried: 6/0 EXECUTIVE SESSION ENDED at 8:39 p.m. Land Preservation Applications & Potential Applications -OPEN SESSION General Preservation • PDR Program Changes— Update re: Code Committee Meeting and 11/8 Town Board Work Session Lilly reviewed the Town Board's discussion about allowing processing on DRS land from the 10/26 Code Committee meeting and 11/8 Work Session. The Town Board discussed allowing one processing building on DRS land up to 1.5%of the lot size, capped at 3,000 square feet. Any outdoor processing would count toward the building's square footage. The Town Board also discussed allowing storage of processed agricultural products on the easement area in a single building up to 2,000 square feet. The Committee also discussed several issues requiring follow up, including the impact these additional uses will have on the value of development rights, that any changes to Chapter 70 would amend some existing easements to allow processing and any other uses of DRS land added to the Code, and how the County calculates sanitary flow on preserved farmland. The Committee expressed concern that the County's approach may be inconsistent with state law. Sarah also confirmed that the Town Board is not considering allowing retail on DRS land at this time. The Town Attorney will draft code that reflects the Board's discussion on 11/8, which will be provided to the Land Preservation and Agricultural Advisory Committees for comment.
