Grace For a Variance to the New York State PETITION NO.2000-0795 Uniform Fire Prevention & Building Code ---------------------------------------------------------- Upon the application of James N. Grace, filed pursuant to 19 NYCRR 450 on July 24, 2000, and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to additions and alterations to an existing building of Al (single family)occupancy, two stories in height, of type 5 (wood frame) construction, approximately 2800 square feet in area, located at 190 Willow Terrace Lane, Orient, Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: 9 NYCRR 711.2(b), which requires that bathrooms, toilet rooms, kitchenettes, corridors and recreation rooms shall have a minimum height of seven feet; and 9 NYCRR 713.1(c)(2), which requires that there shall be no variation exceeding one-eighth inch in the height of risers in any one run of stairs. [The petitioner requests relief to allow a bathroom built into the roof area of the second story with a ceiling height of less than 7 feet on one side and to allow a variation of 1/4 inch within a rise of stairs.] FINDINGS OF FACT 1. As part of proposed alterations, a bathroom is to be constructed into the roof area of the second floor of the building that is the subject of this petition. 2. The ceiling height in the bathroom is 8 feet 0 inches at the flat potion of the ceiling and 6 feet 10 inches at one wall. 3. With the placement of the fixtures, the ceiling height is adequate for normal usage. 4. The petitioner has proposed to install a fire and smoke detecting device in the second floor as required by the Uniform Code. Although the risers in the stairs that are the subject of this petition have a variation of/<- i , there is no variation greater than 1/e- inch between any two consecutive risers. Therefore, virtually unperceivable and should not create an undue hazard. +� 6. The local Code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 450.6. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.2(b)and 713.1(c)(2), to allow a bathroom built into the roof area of the second story with a ceiling height of less than 7 feet on one side and to allow a variation of%- inch within a rise of stairs; be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That fire and smoke detecting devices be installed in the second story in conformance with the Uniform Code. This DECISION is issued under 19 NYCRR 450.6. Unless objected to by the petitioner in a writing received by the Department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties. This decision is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application.
