No. 4845— ROBERT FRENTZEL STREET & LOCATION: 1900 Old Orchard Lane, East Marion 1000-37-2-9.1 DATE OF PUBLIC HEARING: August 10, 2000 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The applicants' property comprises 22,500 sq. ft. located on the west side of Old Orchard Lane, East Marion with 150 feet of lot depth and 150 ft. of road frontage. It is improved with a single-family dwelling with garage, set back 32.5 feet from Old Orchard Lane, 11.63 feet from the northerly property line (not including a small protrusion that is to be removed) and about 75 feet from the rear property line. BASIS OF APPLICATION: Building Inspector's June 22, 2000 Notice of Disapproval denying a permit to expand the house for the reason that the proposed addition would have a rear setback of in violation of the 50-ft. requirement of Code Section 100-2448. AREA VARIANCE RELIEF REQUESTED: Applicant requests a variance to locate proposed construction that will add a second floor to the existing house and a near two-story addition with a rear setback of 36'4" in violation of the 50 ft. requirement of Code Section 100-244B. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) The existing house is small and the owners wish to enlarge it for year-round occupancy. They testify that the only practical direction for expansion is westerly into the rear yard, because the southerly and southwesterly yards are planted in mature gardens and have some significant topographical irregularities. Because this lot is over 20,000 sq. ft., Code Section 100-244 requires a rear yard of 50 feet. The current rear yard is about 75 feet; applicant proposes a rear yard of 364". Applicant also proposes a northerly side yard that continues the existing nonconforming setback of 11.63 feet for the entire length of the addition. The required side yard setback under Code Section 100-244 is 15 feet. (2) The proposed project will result in a much larger house than now exists, with two stories rather than one and a much larger footprint. The proximity to the northerly and westerly property lines raises a serious possibility that the property will appear crowded and the house will intrude on the neighbors. Because the project is in the planning stage, applicant is in a position to revise the plan to allow for greater setbacks. (3) The Board concludes that with greater setbacks as set forth below, the project will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. Work involved in this contract is to be located at the Frentzel residence, Old Orchard Lane, East Marion,N.Y. 2. The Owners referred to in these specifications are Robert and Mella Frentzel. 3. Contractor(s) shall furnish and install all material and equipment shown, listed, or described on the drawings or in these specifications, subject to qualifications, conditions, or exceptions as noted. Contractor shall furnish all labor, scaffolding, and tools necessary to complete the work. 4. Dumping fees shall be charged as a direct reimbursable expense to the Owners. 9. Contractor shall be responsible for providing and maintaining the following temporary provisions: a: Temporary water supply, including lines, valves, hose, and similar equipment for construction purposes. b: Temporary light and power, including wiring, lamps, and connections as required for the completion of the work. c: Temporary heat, as needed during cold and wet weather for the purpose of protecting and drying construction and materials. 10. All subcontractors shall be approved by the Owner prior to start of work. 11. The contractor shall, at all times, provide protection against weather, rain, wind, storms, frost, or heat, so as to maintain all work, materials, apparatus, and fixtures free from injury or damage. Sand shall be natural, clean, washed, hard particles of mineral origin containing less than .06%chlorides, otherwise conforming to ASTM C 144. 9. Water shall be potable. 10. ABOVE GROUND DRAINAGE PIPING, with the exception of finished connections at fixtures shall be of the following materials: e. Polyvinyl Chloride Pipe (PVC)(ASTM D1784) with corresponding fittings and joint cement (ASTM D 2564). Dimensions shall comply with ASTM D2665. f. ABS Schedule 40 plastic piping (ASTM D1788) with corresponding fittings (ASTM D2661) and joint cement (ASTM D2235). Dimensions shall comply with ASTM D2661. g. Cast Iron Drainage Piping (ANSI A40.5) where required by code shall consist of extra-heavy, uncoated cast iron soil pipe and fittings. h. All valve parts of same manufacture, size and type shall be interchangeable. All hand operated valves shall be designed to open in a counter-clockwise direction. Unless otherwise shown, all valves installed in water piping systems shall be built for 125 psig WSP. 1. NON-FREEZE WALL HYDRANTS shall be 3/4" straight inlet connection similar or equal to Wade W-8604. in. CLEANOUTS shall be installed in drainage piping where shown and/or specified.
