(Code requires minimum of 15 ft. and 20 ft. for each side, plus a total of 35 ft. for both sides.) PROVISIONS APPEALED FROM: Article XXIV, Section 100-244. RELIEF REQUESTED: Addition squaring off the northwesterly corner of existing one-story frame house, which slighting reduces the side yard setback to the west to 14'7", while maintaining the present conforming sideyar.d at 17 feet at the southwesterly corner of the existing house. The reduction is less than a foot based upon the present code requirement (20 ft.), and a total of 2417" for both sides, instead of the required 35 ft. REASONS/FINDINGS: Variance is not substantial. Difficulty is due to the location of the dwelling at an "off center" point on the property and the westerly property line, as located. MOTION MADE. BY: James Dinizio, Jr. . SECONDED BY: S. A copy of this determination has been transmitted to the Town Building Department pertaining to the owner's pending building permit application request. However, it may still be necessary for you to contact the Building Department (765-1802) to be sure your application request is in complete form and returned to the shelf for �7 re-activation and processing. As you know, construction activities are not permitted until all other permits have been issued and received.
