Upon the application of Henry F. Santacroce, Jr., filed pursuant to 19 NYCRR 450 on February 21, 2001 and
upon all other papers in this matter, the Department makes the following determination:
NATURE OF GRIEVANCE AND RELIEF SOUGHT
The petition pertains to the installation of a heating system in an existing building with a new addition of an Al
(one-family) occupancy, two stories in height, of type 5 (wood frame) construction, approximately 3,100 square feet
in area, located at 2520 Pinetree Road, Cutchogue, Town of Southold, County of Suffolk, State of New York.
The petitioner is seeking relief from:
9 NYCRR 717.3(e)(4), which requires that heat producing equipment located within a below grade space
opening directly to a garage shall be installed on a non-combustible platform not less than 18 inches above
the floor. [The petitioner requests relief to allow an oil fired boiler and hot water heater to be installed within a
below grade space opening directly to a garage less than 18 inches above the floor.]
FINDINGS OF FACT
1. The cellar in the building that is the subject of this petition is located below grade and is connected to the
garage by way of a stairway.
2. The petitioner has enclosed the stairway with construction of at least% hour and has provided a second rated
self closing door at the bottom of the enclosure.
3. The petitioner has agreed to construct a masonry wall 18 inches in height around the perimeter of the heat
producing equipment which will be connected to the existing poured concrete foundation wall.
4. The petitioner proposes to provide venting in the lower panels in the garage doors to aid in the evacuation of
any possible fumes.

5. The petitioner proposes to provide a hard wired smoke and fire detecting device in close proximity to the heat
producing equipment in the cellar.
6. The local Code Official has been consulted in this matter and does not object to the granting of a routine
variance under the provisions of 19 NYCRR 450.6.
CONCLUSIONS OF LAW
Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a

DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 717.3(e)(4), to permit
an oil fired boiler and hot water heater to be installed within a below grade space opening directly to a garage less
than 18 inches above the floor, be and is hereby PROPOSED TO BE GRANTED with the following conditions:
1. That a 18-inch high masonry wall is constructed around the heat producing equipment as stated above.
2. That the additional venting is installed in the lower panels of the garage doors.
3 That a hard wired smoke and fire detecting device be installed in close proximity to the hent producing devices.
4. That the installation of the heat producing devices meets all other applicable sections of the Uniform Code.
This DECISION is issued under 19 NYCRR 450.6. Unless objected to by the petitioner in la writing received by
the Department the decision shall become FINAL after fifteen days of receipt of the decision by the parties
This decision is limited to the specific building and application before it, as contained within the petition, and
should not be interpreted to give implied approval of any general plans or specifications presented in support of this
