BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Dear Mr. Verity, I left a voice mail after my 9/26/01 conversation with Mr. Smith that he would discuss the existing Walk in Closet in the floor area below the mezzanine with you during your 9/28/01 meeting. I also offered to take it out if it is creating a problem for your department. Mr. Smith mentioned that I should not remove it until your meeting. I left the closet in place because it was an original portion of the floor area below and would prefer to keep it. At our 9/25/01 meeting with the inspector I provided backup information to include Section 705.1 of the NYS Code along with memos and letters reflecting various meetings leading up to agreement that the mezzanine floor area would be 105 square feet. Dear Mssrs. Forrester and Verity, Attached is the approval of Trustees to build the above addition. Mr Verity and I agreed that, in order to avoid a conflict for the town, a statement would be made to the effect that, °The living area should not exceed one third the dimensions of the area below the addition." Please let me know if that has changed before issuing the permit. It may sound like a small matter but having the floor area significantly reduced after a series of reviews by different individuals at the building department leaves little for a viewing area. I would appreciate it if the permit was mailed to the above address. It has been a long and frustrating process. I hope the matter is finally resolved and thank those who helped me. The people at the front desk were particularly helpful in going out of their way to help during a difficult time. I would like to clarify some minor points we discussed. 1. The permit is subject to approval of the addition by the Town Trustees. 2. There was a question of the square footage. The number was derived from Richard Smith's 8/7/00 FAX showing 21'6" X 166" addition dimensions. One third of the total square footage of 333 square feet equaled 111 square feet. The105 square foot figure was agreed at our October meeting and confirmed in my 10/24/00 letter to Mr. Forrester that I specifically requested be put in the file. 3. The 35' height to the structure is incorrect. The measured height from the plan is 28' but I requested 30' to be on the safe side for planning. The permit request was submitted to the Town Trustees and will be on the February agenda. Dear Mr Richter, Thank you for taking the time to go over the revision to my Application For Building Permit dated 9/30/99. The engineer will be revising the plan using the following guidelines you provided in our discussion: 1. The interior square footage must be less than 80 square feet that doesn't include open space to the second floor such as the stairway. 2. The ceiling elevation from the floor must be under 7' 6". 3. The new criteria will result in a much smaller room but the basic engineering remains the same. 4. Extending Dormers over the 2nd floor(3)to the East end of the house will remain the same. 5. Town records show the house was built in 1940 and renovated over the years with all COs updated as of April 1998. I delivered an attached survey with the application. The house is at Cedar Beach which is in an"A"Flood Zone and was grandfathered prior to the 1977/83 FEMA restrictions. The addition will cost far less than the 50%percent restriction.
