Pagliarulo Property Darien, CT 06820 East End Rd, Fishers Island SCTM #1000-3-3-7 Dear Mr. Pagliarulo: In response to your request for a freshwater modification for the property identified above, the New York State Department of Environmental Conservation has determined that the proposed project to construct a single-family dwelling, sanitary system, tennis court, pool, patio with fencing and limits of clearing as shown on the survey prepared by Chandler, Palmer & King dated October 15, 1999 is more than 100 feet from regulated freshwater wetlands. Therefore, no permit is required under the Freshwater Wetlands Act (Article 24 of the New York State Environmental Conservation Law). Additionally, the proposed relocated path as shown on the survey will not require a permit under Freshwater Wetlands provided the ground area cleared for construction of the path is limited to a maximum width of four feet and the cover material used for the footpath is limited to natural wood/bark chips, stone, gravel or sand. Please note that any additional work, or modification to the project as described, may require authorization by this Department. Please contact this office if such are contemplated.
