SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 14, 2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION:The relief, permit,or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, 20,608.82 square feet, .47 acre, irregular-shaped parcel located in the R-40 Residential Zoning District,measures 20.52 feet and 130.00 feet fronting Lester's Road, a narrow private unimproved road, along a curve and continues 169.56 feet along a residentially developed lot to the north, then runs south 79.28 feet along a residentially developed lot to the east and returns 109.16 feet and 20.05 feet along a residentially developed lot to the south and then continues to the roadway 96.03 feet along a second residential neighbor to the south. The property is improved with a one-story, wood frame residence with two entry stoops, an accessory inground swimming pool and a frame shed as shown on the survey prepared by Jason D. Leadingham, Licensed Land Surveyor and dated June 29, 2023. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15;Article XXIII,Section 280-124; and the Building Inspector's September 5, 2023, Notice of Disapproval based on an application for a permit to demolish (as per Town Code definition) and reconstruct a single family dwelling and an accessory garage,and to legalize the location of an existing shed(under 144 sq.ft.);at; 1)dwelling is located less than the code required minimum front yard setback of 40 feet; 2)accessory garage located in other than the code permitted rear yard; 3) accessory shed is located less than the code required minimum rear yard setback of 10 feet; 4) accessory shed is located less than the code required minimum side yard setback of 10 feet; located at: 230 Lesters Road, Mattituck, NY. Page 2,November 16,2023 #7843, White SCTM No. 1000-114-7-5.1 RELIEF REQUESTED: The applicant requests four variances for the `technical' demolition per Town Code (value of proposed alteration of the existing structure exceeds 50% of the construction value of the present one,not including land value, as presented by the applicant's architect)of a single-family residence maintaining a 32.3 feet front yard setback for a covered porch entry where a minimum of 40 feet is required; constructing an accessory garage in a side yard where such structures are required to be sited in a compliant rear-yard location; legalizing an `as built' accessory shed in a compliant rear-yard location with a reduced side yard setback of 5.9 feet and rear yard setback of 6.6 feet where a minimum of 10 feet is required for each. ADDITIONAL INFORMATION: The applicant provided a site plan and architectural drawings labeled SD-1 through SD-6, prepared by Anthony M. Portillo, Registered Architect and dated August 16, 2023. During the public hearing,the applicant provided the Zoning Board of Appeals with copy of the applicant's Suffolk County Department of Health Services approval dated October 13, 2023, for the installation of a new sanitary system. The Board of Health approval is for a maximum of 6 bedrooms;Fujiclean, Innovative and alternative onsite water treatment system. The document is labeled SP-101.00 prepared by Anthony M. Portillo, Registered Architect, and dated September 28, 2023. Improvements on the subject parcel are covered by the following Certificates of Occupancy: #Z-2512 dated August 31, 1966 covering a new, one family dwelling. #Z-4842 dated October 4, 1972 covering an accessory storage building. #Z-40584 dated August 2, 2019 covering additions and alterations to a one family house. #Z-41313 dated August 3, 2020 covering electric service to an accessory shed. #Z-41345 dated August 11, 2020 covering an accessory inground swimming pool with fence. The subject property is the beneficiary of relief under the following Zoning Board of Appeals applications: #5038 dated January 2, 2002 granting a waiver of merger recognizing the lot to the west. #7201 dated October 23, 2018granting a front yard setback of 27.5 feet where a minimum of 40 feet is required. While relief.was granted under file#7201 in 2018 the work permitted was not completed. No member of the public or an immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 2, 2023 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law N67-W)(b M. Grant of the requested variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The other homes along Lesters Road have non-conforming front yard setbacks with homes, other improvements and driveways located close to the road. There are not many homes along Lesters Road, which is private, narrow, and unpaved (gravel and dirt). Three homes to the north are on creek front property. Expansion of the existing home, . Page 3,November 16,2023 #7843, White SCTM No. 1000-114-7-5.1 part of a technical demolition, will allow the property owner to modernize the small residence and functionally update it, adding a second floor and maintaining existing setbacks. Likewise, accessory garages are often found in non-compliant side yards in the immediate Breakwater neighborhood as a result of hilly terrain,and the original siting of the primary residence. Uncommon to the community are sheds with non-conforming setbacks from rear or side yard lot lines, however,the shed exists and the reduced setbacks are not readily apparent. 2. Town Law V67-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue,other than an area variance. The existing dwelling has a non-conforming front yard setback of 35.5 feet,where the code requires a minimum of 40 feet. As such, any addition to the front fagade of the residence will require a variance. Furthermore, as a result of the lots topography, proposed septic location, irregular lot-shape and location of other improvements such as the inground swimming pool, the accessory garage cannot be located in a compliant location, or attached to the home, without substantial and detrimental site disruption. While the shed could be moved to a compliant location, the `as built' shed is setback approximately 6 feet from both the side and'rear yard lot lines and is not discernable to be non-compliant. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 19.25% relief from the code relative to the front yard setback; 100% relief from the code relative to the garage in a side yard and 40%relief from the code relative to the side yard setback and rear yard setback of the shed. However, when the house was originally cori'structed, the required minimum front yard setback was 35 feet which the house conforms to, despite the code-required setback being increased to a minimum of 40 feet. The 7.5 feet proposed setback will not be visibly recognizable as other homes in the immediate area are sited close to the private, unimproved dirt road. In addition,the front property line is not parallel to the house so the proposed front parch addition will actually have a conforming setback on one side. While a garage in a side yard is not common in the immediate area, garages are a common accessory to single family residences throughout the Town of Southold. As a result of the topography, site limitations and the residence's floor plan the applicant has limited location to site a functional, small garage. Lastly, the `as built' shed was placed erroneously close to the side and rear yard lot lines and has no visibly recognizable adverse impacts. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and install an IWOTS sanitary system. 5. Town Law V67-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law V67-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of alterations and additions to a single-family home with a front yard setback of 32.5 feet,the construction of a garage in a side yard and the recognition of an `as built' shed with reduced side and rear yard setbacks while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 4,November 16,2023 0 #7843, White SCTM No. 1000-114-7-5.1 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Lehnert, and duly carried, to GRANT the variances as applied for, and shown on the site plan and architectural drawings labeled SD-1 through SD-6, prepared by Anthony M. Portillo, Registered Architect and last revised September 8, 2023. 2023. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall install,per the Suffolk County Department of Health Services File#R-23- 1248, an Innovative Advanced(I/A) OWTS sanitary system. . 2. The proposed covered porches shall remain unenclosed and unconditioned. 3. The proposed garage shall contain ONLY basic electrical for lighting and a single hose bib for access to water. The garage may not be conditioned in anyway. 4. The proposed garage shall not be used for anything other than the storage of an automobile or for the storage of common residential items associated with an accessory garage, unattached to a residence. 5. If the `as built' shed is ever replaced or expanded in size, it shall be relocated to code compliant rear and side yard setbacks. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The other homes along Lesters Road have non-conforming front yard setbacks with homes and driveways located close to the road. There are not many homes along Lesters Road, which is private, narrow, and unpaved (gravel and dirt). Three homes to the north are on creek front property. The subject dwelling and property are in need of repair and the proposed improvements will enhance the home and the neighborhood. The existing basement level garage will be eliminated for more living space and there are no plans to build a garage at this time. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue, other than an area variance. The existing dwelling has a non-conforming front yard setback of 35.5 feet, where the code requires a minimum of 40 feet; so any addition in the front yard area will require a variance. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 31.25% relief from the code. However, due to the house being sited at an angle to the road, the southerly end of the proposed open porch addition is set back at a more conforming 34.2 feet,and the dwelling is set back a conforming 44.5 feet at the southerly corner. Moreover the proposed addition wills have no visible impact on the neighbors properties due to the distance and various angles at which other homes are sited from the subject property and the existence of fencing and heavy vegetation along the side yards. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.
