SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 14, 2023, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available,to me, it is my recommendation that the proposed two-story addition is INCONSISTENT with the Policy Standard 4 and therefore is INCONSISTENT with the LWRP. This determination is based upon the following: 4.1 Minimize losses of human life and structures from flooding and erosion hazards. ]. Move existing development and structures as far away from flooding and erosion hazards as practical. y Maintaining existing development and structures in hazard areas may be warranted.- a. arranted:a. structures that functionally require a location on the coast or in coastal waters. The single-family residence does not require a location on the coast. The location places it seaward of the Coastal Erosion Hazard Area (CEHA) line in an environmentally sensitive coastal area. The CEHA line/area marks an area where erosion from storm events over time is most likely. The structures within these areas are subject to repetitive loss from storm surges and flooding and should be avoided and/or minimized. The second story addition is EXEMPT from LWPR CCR. The property has 100 ft of road frontage along North Sea Drive, then it turns north for 355.69 ft to Long Island Sound, where is has 100.39 ft of sound front before returning 346.85 ft back to North Sea Drive. The property is improved with an existing 1 story frame dwelling with an existing 1-story accessory garage in the west side yard. The house is surrounded by wood decks on the front, west and north sides. The Coastal Erosion Hazard Line is located on the landward side of the existing house, and the property is divided being in both the VE& AE zones for FEMA. BASIS OF APPLICATION: Request n for Variances from Article III, Section 280-13C; Article III, Section 280-15; and the Building Inspector's August 29, 2023,Notice of Disapproval based on an application for a permit to construct additions and alterations to a non-conforming accessary building; at; 1) proposed conditioned, habitable space in a proposed addition to the existing accessory garage is not customarily accessory and incidental to the principal use, and furthermore, not a permitted use; 2) located in other than the code permitted rear yard; located at: 1225 North Sea Drive, (adj.to Long Island Sound) Southold,NY. RELIEF REQUESTED: The applicant requests that the Board of Appeals grant a variance for the non-conforming side yard location of a proposed second story addition containing two bedrooms and one full bathroom over an existing one story accessory garage located in the side yard, and, pursuant to Chapter 280-146(A)Powers and Duties, overturn the Notice of Disapproval for a proposed non-permitted use (habitable bedrooms) based upon the Building Inspector' s August 29, 2023 Notice of Disapproval which states: "The proposed new construction to this existing nonconforming accessory building on a nonconforming 35,127 sf lot, in the Residential R-40 District, is not permitted pursuant to Article III, Section 280-15, which states accessory buildings and structures shall be located in the required rear yard, and in the case of waterfront parcel, accessory buildings and structures may be located in the front yard, provided that such buildings and structures meet the front yard principal setback requirement of 40 feet on lots measuring between 20,000 sf and 39,999 sf. The site plan shows the proposed accessory garage to be located in the side yard. Additionally, pursuant to Article 111, Section 280-13C, the proposed alterations and additions to the existing accessory building, consisting of a second story addition to contain two habitable bedrooms and a bathroom is not a permitted use". ADDITIONAL INFORMATION: The property has Certificates of Occupancy for the structures currently on the lot. The existing house has a Certificate of Occupancy#Z 1066 dated July 6, 1961. The accessory garage in the side yard has a Certificate of Occupancy#Z4650 dated June 2, 1972 which was issued based upon variance relief granted by the Zoning Board of Appeals# 791, dated August 5, 1965. The existing deck has a Certificate of Occupancy#Z 18187, dated July 13, 1989. At the public hearing the Board discussed with the applicant's architect/agent other options for the proposed non-permitted habitable addition to the existing accessory building and the Board also discussed code conforming alternatives available to the applicant to add additional bedrooms to the principal dwelling on the subject property. • Page 3,November 16,2023 97842, Handler SCTM No. 1000-54-4-14 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 2, 2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. The Notice of Disapproval stated the alterations and additions were not a permitted use. Although the applicant submitted an area variance (for location of the alterations and additions),the Board has to consider the test for use, as the Disapproval stated this is not a permitted use and the applicant requests an overturn of the Disapproval based on use. The Board, in addressing the use variance standards and the written submissions and oral testimony by the applicant's architect/agent, finds the applicant does not meet the criteria for a use variance. The first requirement in Town Law§ 267- b(2)(b)( 1)addresses that the applicant can realize a reasonable return for each and every permitted use under the zoning regulations because there is ample room for a second-floor addition to the existing house that would be allowable under the current zoning regulations. The test fails for a use variance because it requires all the standards for use variance be met. The Board, however, did look at the balance of the use tests and finds the following: 2. Town Law 267- b(2)( b)(2). The hardship is not unique to the subject property because one-story houses in the area and throughout the Town have the right to construct code conforming first and/or second floor habitable additions under the current zoning laws. 3. Town Law 267- b(2)( b)(3). The requested use variance, if granted, will alter the essential character of the neighborhood because there are no accessory garages with habitable sleeping quarters in the neighborhood or within the Town unless they have received a Special Exception Permit from the Board of Appeals for an accessory apartment with a full time renter that is either a verified family member or a person on or eligible for inclusion on the Town's Affordable Housing Registry, or the accessory structure with habitable space has a Certificate of Occupancy that pre-dates Zoning. 4. Town Law 267-b(2)( b)(4). The alleged hardship has been self-created because there are many code conforming/code permitted ways to accomplish the applicant's goal of adding bedrooms by doing so as an addition to the principal dwelling or by applying for an accessory apartment in their accessory garage. 5. Town Law 267- b. Grant of a use variance is not the minimum action necessary and adequate to address the unnecessary hardship and at the same time preserve and protect the character of the neighborhood and the health, safety, and welfare of the community. The Notice of Disapproval requiring the applicant to obtain variance relief for the non- conforming location of the proposed alterations and additions to the-accessory garage is Page 4,November 16,2023 #7842,Handler SCTM No. 1000-54-4-14 irrelevant. The alterations and additions are not a permitted use, therefore,the standards for area variance need not be addressed and do not apply.
