SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, pennit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, 23,575.35 square feet, .54-acre rectangular shaped lot located in the R40 Zoning District measures 90.08 feet along Lilac Lane, then runs north 257.10 feet along a residentially developed lot to the west, then runs east 90.00 feet along a residentially developed lot to the north and returns 267.74 feet along a residentially developed lot to the east. The subject parcel is undeveloped, however, a building envelope with code compliant zoning setbacks is illustrated, as shown on the survey prepared by Kenneth M. Woychuk,Licensed Land Surveyor, and dated May 20, 2023. BASIS OF APPLICATION: Request for a Variance from Article II, Section 280-9A(l) and the Building Inspector's July 13, 2023, Notice of Disapproval based on an application for lot recognition and to legalize a lot created by deed on October 22, 1980 at; 1) lot having less than the required lot width of 100 feet which no longer conforms to Bulk Schedule AA; located at: 955 Lilac Lane, Cutchogue,NY. SCTM#1000-104-1-14. RELIEF REQUESTED: The applicant requests a variance for a lot width of 90 feet where the code requires a minimum lot width of 100 feet.This lot was created by deed with a sufficient lot width on August 13, 1965,meeting requirements of Bulk Schedule AA. However,due to a surveyor's error,the deed was corrected, and recorded again on October 22, 1980, to illustrate insufficient lot width, not conforming to Bulk Schedule AA, therefore requiring lot recognition by the Zoning Board of Appeals. ADDITIONAL INFORMATION: Prior to the public hearing a letter of opposition, signed by several neighbors, was received by the Zoning Board of Appeals. During the public hearing, an immediate neighbor spoke against this application. This neighbor also provided the Board with a copy of a 1954 deed. Page 2,November 16,2023 #7840, Meiri SCTM No. 1000-104-1-14 Prior to the public hearing the applicant's agent provided the Board with a Memorandum of Law; this document was also distributed to the Board members at the public hearing. Substantial discussion occurred during the public hearing relative to the history of the subject property, deeds and deed description, adjacent properties,and their deeds. The applicant's agent submitted a detailed hand-drawn map illustrating the various owner's / deeds over approximately a 70-year period. The applicant's agent stated that a conforming residence can be built within the code required building envelope. Testimony was offered, including submission of variance relief granted in Zoning Board of Appeals file 97704 dated November 21,2022, illustrating the character of the immediate neighborhood. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 2, 2023 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The surrounding neighborhood is characterized by similarly sized parcels with varying lot widths. Lot width of parcels on Lilac Lane vary from 53 feet to 135 feet. Many lots do not share the conforming depth of the applicant's parcel. The character of the residential neighborhood is of modest houses on irregularly shaped lots.Therefore,there will be no change in the character of the neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance. As a result of an error made in the original 1965 deed description, corrected to reflect a 90-foot,non-conforming lot width in 1980,the applicant cannot develop the site. Variance relief is the only way possible for the property owner to have the lot recognized as a developable parcel. 3. Town Law§267-b(3)(b)(3). The variances granted herein is mathematically substantial,representing 10%relief from the code. However,the applicant submits the relief required from the lot width requirements of Bulk Schedule AA is 10 feet and therefore not mathematically substantial since the resulting lot will be similar in size and lot width to other lots in the neighborhood. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and when developing the lot, and install a Suffolk County Board of Health approved Innovative Advanced(I/A) sanitary system. 5. Town Law U67-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of lot recognition for a 90 feet wide residential building lot while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The requested relief is required because the subject parcel is 90' wide and as such, it does not meet the minimum 100' lot width requirements of Bulk Schedule AA as required by the code for lot recognition. By way of background, the subject parcel (SCTM# 1000-104-1-14, "Lot 14") consists of 23,575 SF in the R-40 Zoning District, located on Lilac Lane in Cutchogue. It is 90'wide and 257' deep. When the parcel was originally created by deed in 1965 (Liber 5803, page 590), it was erroneously described as being 110' wide. A review of the deeds in the chains of title for Lot 14, the parcel to the east (Lot 13) and the parcels to the west, (Lot 15 and Lot 16.1) is explanatory. It appears that during the 1950s, Lot 13 was created by a series of conveyances resulting in the current lot with a width of 130 feet. When Lot 15 was created (on the same day as Lot 14), it was described with a point of beginning 220 feet from the point of the beginning of Lot 13 (which would be the northeast corner of the intersection of Lilac Lane and Horton Road). Lot 16.1 is 110' wide and is described with a point of beginning that is 330' from the point of the beginning of Lot 13. Since Lot 13 is 130 feet wide and Lots 15 and 16.1 are both 110 feet wide, there is only 90 feet left for Lot 14. The erroneous 110' lot width was carried forward in subsequent deeds in 1971 and 1973 and finally corrected when the Applicants' parents took title to the property in 1980 (See deed in Liber 8903, page 564). The surrounding neighborhood is characterized by similarly sized parcels with varying lot widths. Lot widths of parcels on Lilac Lane vary from 53 feet to 135 feet. Many lots do not enjoy the conforming depth that Lot 14 has. For the following reasons, the Applicants submit that a variance from the lot width requirements of Bulk Schedule AA and recognition of the subject parcel is warranted: 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The granting of variance relief to recognize the subject non-conforming parcel will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family homes on similar sized lots. The variance will legalize a lot that 1 t is non-conforming as to lot size and width but otherwise conforming as to lot depth and similar in size to the other parcels on Lilac Lane and many others in the surrounding community. Nearby lots 18.2 and 18.3 are also 90 feet in width and Lots 20 and 22 are 70 feet and 53 wide respectively. 2. The benefit sought by the Applicant CANNOT be achieved by some feasible method for the applicant to pursue other than an area variance, because: Due to the pre-existing nonconformities of the parcel that have existed since it was created, there is no way that the lot can be recognized without variance relief for the lot width and area of the parcel. 3. The amount of requested relief is not substantial because: The Applicant submits that the relief required from the lot width requirements of Bulk Schedule AA is only 10 feet and therefore not mathematically substantial since the resulting lot will be similar in size to other lots in the neighborhood. 4. The variance will NOT have an adverse impact on the physical or environmental conditions in the neighborhood or district because: There is no perceivable adverse impact on physical or environmental conditions on Lilac Lane. The subject neighborhood has access to public water and any new construction must comply with Chapter 236 and will undoubtedly include the installation of an I/A waste water treatment system. S. To the extent that the difficulty is self-created, pursuant to Town Law §267-b (3), a self-created hardship "shall not necessarily preclude the granting of an area variance." Finnegan, Esq. u 13250 Main Road Mattituck, New York 11952 (631) 315-6070 Dated: October 31, 2023 STATEMENT OF FACTS By way of this appeal of the Building Inspector's Notice of Disapproval of their building permit application dated July 13, 2023, the Applicants are seeking a variance under Article II, Section 280-9A(1) for lot recognition of the subject i. parcel that was originally created by deed on August 13, 1965. The requested relief is required because the subject parcel is 90' wide and as such, it does not meet the minimum 100'lot width requirements of Bulk Schedule AA as required by the code for lot recognition. By way of background, the subject parcel (SCTM# 1000-104-1-14, "Lot 14") consists of 23,575 SF in the R-40 Zoning District, located on Lilac Lane in Cutchogue. It is 90'wide and 257'deep. When the parcel was originally created by deed in 1965 (Liber 5803, page 590), it was erroneously described as being 110' wide. A review of the deeds in the chains of title for Lot 14, the parcel to the east (Lot 13) and the parcels to the west, (Lot 15 and Lot 16.1) is explanatory. It appears that during the 1950s, Lot 13 was created by a series of conveyances resulting in the current lot with a width of 130 feet. When Lot 15 was created (on the same day as Lot 14), it was described with a point of beginning 220 feet from the point of the beginning of Lot 13 (which would be the northeast corner of the intersection of Lilac Lane and Horton Road). Lot 16.1 is 110' wide and is described with a point of beginning that is 330' from the point of the beginning of Lot 13. Since Lot 13 is 130 feet wide and Lots 15 and 16.1 are both 110 feet wide, there is only 90 feet left for Lot 14. The erroneous 110' lot width was carried forward in subsequent deeds in 1971 and 1973 and finally corrected when the Applicants'parents took title to the property in 1980 (See deed in Liber 8903, page 564). The surrounding neighborhood is characterized by similarly sized parcels with varying lot widths. Lot widths of parcels on Lilac Lane vary from 53 feet to 135 feet. Many lots do not enjoy the conforming depth that Lot 14 has. For the following reasons, the Applicants submit that a variance from the lot width requirements of Bulk Schedule AA and recognition of the subject parcel is warranted. POINT I THE APPLICANT HAS MET THE TEST FOR THE GRANT OF AN AREA VARIANCE SET FORTH IN TOWN LAW §267-B Under §267-B, the Applicant must demonstrate compliance with the following standards to be eligible for the issuance of a variance: (a) whether the grant of the variance will cause an undesirable change in the character of the neighborhood or will create a detriment to nearby properties; (b) whether the benefits sought by the applicant can be achieved by some method feasible for the applicant to pursue other than an area variance; (c) whether the requested area variance is substantial; (d) whether the grant of the variance will have an adverse effect or impact upon the physical or environmental conditions in the neighborhood or in the affected area of the Town; and (e) whether the difficulty causing the applicant to request an area variance was self-created which consideration shall be relevant to the determination of the Board but shall not necessarily preclude the grant of the variance. It is respectfully submitted that under the facts and circumstances presented here, the Applicants can clearly meet the standards set forth in Town Law §267-B and as a result, the relief requested herein should be granted. 1. The Grant Of The Variance Will Not Cause An Undesirable Change In The Character Of�The Neighborhood Or Create Detriment to Nearby Properties. The granting of variance relief to recognize the subject non-conforming parcel will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family homes on similar sized lots. The variance will legalize a lot that is non-conforming as to lot size and width but otherwise conforming as to lot depth and similar in size to the other parcels on Lilac Lane and many others in the surrounding community. Nearby lots 18.2 and 18.3 are also 90 feet'in width and Lots 20 and 22 are 70 feet and 53 wide respectively. 2. The Benefits Sought to Be Achieved by Applicant Cannot Be Feasibly Achieved by Some Method Other Than the Requested Area Variance The Applicants are seeking the benefit of the buildable lot that their parents purchased in 1980 with the plan to construct a family home in the future. That plan was sidelined when their parents were tragically killed in a motor vehicle accident in 1993. Due to the pre-existing nonconformities of the parcel that have existed since it was created, there is no way that the lot can be recognized without variance relief for the lot width and area of the parcel. 3. The Area Variance Sought is Not Substantial. The Applicant submits that the relief required from the lot width requirements of Bulk Schedule AA is only 10 feet and therefore not mathematically substantial since the resulting lot will be similar in size to other lots in the neighborhood. 4. The Grant of the Variance Will Not Have an Adverse Impact on the Physical or Environmental Conditions in the Neighborhood or District. There is no perceivable adverse impact on physical or environmental conditions on Lilac Lane. The subject neighborhood has access to public water and any new construction must comply with Chapter 236 and will undoubtedly include the installation of an I/A waste water treatment system. 5. The Self Created Nature Of the Alleged Difficulty Should Not Preclude the Granting of Area Variance Relief. To the extent that the difficulty is self-created, pursuant to New York Town Law §267-b (3), a self-created hardship "shall not necessarily preclude the granting of an area variance." v. CONCLUSION For the reasons set forth herein, it is respectfully submitted that the standards of Town Law Section 267-b have been met and, as such, relief from the requirements set forth in Southold Town Code Section 280-14 is warranted. I join with my neighbors in opposing the appeal of the denial of variance for SCTM#1000-104-1-14 for the reasons stated by others including the following reasons. I have just recently learned that from 1957-1971 the minimum width for lot creation was 100 feet,and that from 1971 to 1983 that was increased to 135 feet and now minimum width stands at 150 feet. Clearly the code is designed taking particular care to establish width as a key metric. Ignoring that seems counter to the code's intention 1. Lot#14 was purchased in 1980,with an accurate survey before purchase and by definition with the buyers' full knowledge that their investment was not a buildable lot. That fact is the crux of the issue. The zoning schedule in effect precluded any expectation of development. The appeal goes into some detail concerning recalculations of the lot's dimensions, all prior to this owner—these are all irrelevant. The appeal seems to speculate as to buyers reasoning,again irrelevant. The appeal makes much of square footage, insinuating the width of a property is not in and of itself an issue. This is not irrelevant; it is a clear misstatement of the code's intention and evolution overtime. 2.Variance approvals for non-buildable lots set a precedent that only encourage appeals that reverse seven decades of Town code amendments designed to set the rules in which development can reasonably proceed.
