GOGGINS, being duly sworn deposes and says: ONE: On or about December 2, 1999, acting in my capacity as President of 13105 Main Road, Corp., purchased of property located at 13105 Main Road, Mattituck, New York and further described as Suffolk County Tax Map Number 1000-140.00-03.00-039.000. TWO: On December 2, 1999 the aforesaid property was in a state of repair as follows: a. The first floor contained old construction material, old doors, old windows, old mirrors, and old items used in connection with the Lodge/Hotel. Another area of the first floor contained a desk, phone, register. Another area contained a key board apparently used in connection with the plumbing business. A bathroom used by employees of the Plumbing business. There was a room at the north west corner, containing a functional bathroom and living quarters. b. The second floor had most of the plaster and lath removed from all of the walls. One room was still in functional condition. The bathrooms on the second floor were in operable condition, but in need of replacement. The studs d. The third floor was still in live-in condition. The five (5) bedrooms were still functional containing beds, dressers and night tables. The third floor bathroom was fully operational. e. The basement contained plumbing supplies in the area where the tavern was once operated. There was also plumbing and hotel items stored under the front porch area of the basement. In the northern area of the basement, there were plumbing supplies, bakery items, landscaping tools and a work shop. In the western are of the basement contained a storage facility used by a law firm. f. The rear area of the building contained a two (2) story apartment. It had a bedroom and bathroom on the second floor, and a Living area/Kitchen on the first floor. The windows on the second floor had been recently replaced. The walls had severe water rot. THREE: On or about December 2, 1999, I began clean out the basement and the debris on the first and second floors, and performed the following work: a. On the first floor we removed the plaster and lath from the walls and " ceiling to replace same with sheetrock. We also needed to insulate the building. Originally we were going to continue to use the existing electric, but I decided to replace the electric for safety reasons. We found that we needed to sure up the floor joists between the first and second floor. b. On the second floor, we decided to replace the existing bathroom fixtures and bathrooms as the piping was old steel lines and the fixtures were old. We removed the rest of the plaster and lath from the walls. We removed the bathrooms with intent to replace same. We removed the existing non bearing stud walls in the rear area to replace them with new ones. We saw that the rear area floor needed an other layer of plywood which we installed. c. The third floor we removed the plaster and lath from some of the walls and all of the ceilings and removed all of the beds and fiirniture. d. We removed all of the debris, plumbing supplies, tools etc. from the basement. e. The rear area of the building where the two (2) story apartment is located replaced the rooted wall on the east side of the first floor. We replaced the studs on the north and west side walls on the first floor. We replaced some of the studs on the second floor and replace the bathroom walls with new studs. FOUR: For safety reasons, we intend to install fire separation walls between uses. FIVE: For safety reasons, we intend to install a sprinkler system. SIX: For safety reasons, we intend to replace all electric. SEVEN: For safety reasons, we intend to build a second floor deck and stairway at the north end of the building to facilitate ingress and egress from the two (2) second story apartments. I was the owner of property located at 13105 Main Road, Mattituck, New York and further described as Suffolk County Tax Map. Number 1000-140.00-03.00-039.000 from November 30, 1994 until December 2, 1999 when I sold it to 13105 Main Road, Corp. 2. On November 30, 1994 I purchased the building and Walter Dohm's plumbing business from Walter Dohm. The building had been in Mr. Dohm's Family since the 1920s. 3. I continued to operate the plumbing business from the site, which included an office, repair and storage. When I was doing work on the first floor, I would move the office to the front area of the second floor. 4. I continued to rent out rooms/apartments as Walter Dohm did prior to me. I rented rooms/apartments at the site from time to time as I was making repairs to the stricture. The walls and facilities were old so my goal was to repair same while still attempting to rent them. I rented a rear two (2) story apartment from time to time when I was no making repairs to that area, which is located at the most northerly portion of the premises. This area had contained a bathroom, cooking facility and two rental rooms. I was in the process of repairing this area to make it a one (1) bedroom apartment when I sold the site on December 2, 1999. The studs and structural members and some of the walls as well as the windows water rote an 6. I rented two (2) apartments on the second floor rear area from time to time when I was not making repairs to the area, which is located at the area which is covered by a flat roof. In this area, Walter Dohm had been renting two (2) rooms where the people shared cooking facilities and bathrooms. When I purchased the site, I continued it as two (2) separate living areas. I was in the process of reconstructing the walls, which were water damaged and cracked ti when I sold the premises. I was also in the process of repairing and/or replacing the old bathroom fixtures, cooking facilities, electric and piping when I sold the premises. 7. I rented the five (5) rooms on the third floor from time to time, but I never made repairs to the that area except the removal of two (2) plaster walls that were in bad shape. The bathroom fixtures on the third floor are antiques so I intended on saving them when I got ready to make repairs to that area. I never had full occupancy at any given time of these rooms. I stopped renting these rooms when I was making the major repairs in september/October of 1998. 8. There was also an apartment on the first floor at the rear northwest area, which I had created. 9. No one rented for any substantial length of time. I continued to operate the site as Walter Dohm did to a very limited extent allowing people to stay over night or for a week or so. Sometimes a month. Sometimes on weekends during the summer. I had not rented any of the rooms since sometime in September or October of the year 1998. At this time I had started gutting the second and first floor to repair the walls, replace any plumbing and to repair any damage caused by water leaking from the roof. Also, at such time, I could not rent the third floor rooms because of the filth, dust and state of repair. 10. It was my idea to restore the building to its original shape, and continue to operate it as a Lodge. I made the mistake of gutting the first and second floors at the same time in September/October of 1998, which resulted in an inability to collect rent. 11. To the best of my recollection, at no time did the above uses discontinue for a period exceeding two (2) years. 12. Sometime in 1995, I repaired a part of the basement and rented same to a law firm for storage of their files. At the time that I sold the site, the law firm was still renting the space. My father operated a retail plumbing business from the site since on or about 1917. I continued to operate the plumbing business after my father passed in or about 1965 until five (5) years ago when I sold the site and the business to Richard Tandy. My father and I used the site as a storage facility for my plumbing supplies as well as a location of our Office to operate the Plumbing business. The site was operated as a Hotel/Lodge since on or about 1880 by the people who sold the site to my parents sometime on or about 1916. My parents and I continued to operate the site as a Hotel/Lodge until the mid-I` when my parents died. The site contained seven (7) rental rooms on the second floor, and five (5) rental rooms on the third floor. It also contained five (5) bathrooms shared cooperatively by all the guests. Basically, like the Bed and Breakfasts are operated these days, but without the Breakfast. Since on or about the mid sixties when my parents died, the second floor, third floor and rear area had been continued to be rented from time to time for residential use with operational bathrooms and cooking facilities. The building needed to be reconditioned so the occupancy was not attractive to boarders. The walls and ceiling were cracking and so forth. To the best of my recollection the above statements are true. To the best of my recollection at no time did the above uses discontinue for a period exceeding two (2) years. A Tavern was operated at the site as part of the Hotel and licensed after prohibition in the basement/sub level area, which was discontinued. The attached plans and this letter are to be made part of the project documents. The first floor handicap bathroom, handicap access ramp and rear deck& stairs were inspected on Wednesday,July 18, 2001. The railing for the handicap ramp was not installed at that time, but is scheduled to be completed shortly. It is my professional opinion that after the railing installation, the handicap facilities incorporated into the building meet the general requirements set forth by the Americans With Disabilities Act(ADA). In accordance with section 735.6a of the New York State Uniform Fire Prevention and Building Code, exit doors may swing inward, which would negate the requirement in section 735.3c to provide a drop of between 4"& 7-3/4"for door swing over a platform. In addition, one exit is allowed as stipulated in section 735.10. It is my professional opinion that the rear deck and stairway as-built construction is adequate to support the intended loads and is in conformance with the general intent of the New York State Uniform Fire Prevention and Building Code serving as an exit for the second story B-1 occupancy. The 450 books that comprised the original collection of the Library were housed in the Octagon House on Main Road. In 1905 the Library moved from the Octagon House to Library Hall(seen in the cover photo)which was a gift to the Village of Mattituck by Frank M.Lupton. A fire in 1939 at Library Hall created a need for a new library site and eventually the old elementary school property on Main Road was purchased. The Library's present building was constructed in 1961 and the 1980 addition of what is now the Children's Room was made possible in large part by the generosity of Mattituck resident, Katie Dexter. The Library's existing facility houses over 41,507 volumes of both hardcover and paperback books,over 1,255 volumes of large print books for the visually impaired,over 168 subscriptions to periodicals and newspapers and several thousand other kinds of material such as videotapes and books on cassettes. It serves an estimated population of 5,380. The Library has approximately 4,272 registered borrowers,which represents 80%of the estimated population of the area. The Library also provides other services to the community including free internet access, com- puters for public use,concerts,seminars and children's storytimes and programs. Residents voted overwhelmingly to approve the construction of an addition to the Library in December of 1998. The addition will double the current building size and allow more shelving space, additional computer availability, quiet study space,a meeting room and a new Children's Room. It is here because for centuries the woodland Indians, who were the first people to live here,were in the habit of burning off the trees and shrub growth in order to provide fertile ash in which to grow their corn. The wooded verges of these fields provided shelter for the white tailed deer and the fox which preyed upon them as they do to this day. Like all Americans, these Indians came from somewhere else, mostly from the West by way of Connecticut. Love Lane, so named an old timer tells me because it was once a nice secluded place for lovers to linger, follows an original Indian pathway. In 1645, the governor of New Haven.Colony bought Mattituck from the Indians. It cost more than Manhattan but not by much, going for some glass beads,a few iron kettles and some wampum made from the shells that grew in such abundance in the local creeks that the North Fork was long a center for its manufacture. Mattituck was purchased from New Haven by the Puritan elders settlers of Southold and was distributed in four acre lots to heads of household,as a land dividend,in 1661. Their names are with us still on streets, farms and businesses;names like Wells, Horton,Mapes and Dickerson. By 1775 the European people of Mattituck mostly thought of themselves as Americans,though most of them had come from a part of England that like Mattituck,was defined by tidal creeks and salt meadows. They were not pleased when the British set up camp on Maratooka Lake. Some people fled to Connecticut but others stayed behind to tend their farms. In the years after the Revolution the residents of Mattituck farmed and fished. They shipped produce, firewood and fish oil to New York City and across the Sound to Connecticut in coastal boats launched in Mattituck inlet. Farm labor was done by slaves, indentured servants and occasionally Indians until slavery was ended in New York state in the early part of the nineteenth century. Modern times were slow to arrive. Corn was ground in tidal mills like the one on Mattituck inlet, now a popular restaurant, until 1906. The railroad came through in 1844 but did not stop in the North Fork hamlets until after the Civil War. The local farmers hated the noise and dirt that brought them no benefit. They had to adapt to modernity, however,when the LIRR put the town on Eastern time in November 18, 1883. There was a feed store near the depot on Love Lane and Pike Street. Pike was lined with boarding houses for summer visitors and hunters who came out on the train. During the latter part of the nineteenth century a new influx of immigrants added Polish names to the landscape. By the early years of the twentieth century Polish immigrants began to farm,first as tenants and then as owners. World War 1,with its demands on the nations food resources, made farming very profitable and Mattituck flourished. It was then that potatoes and cauliflower became the dominant crops. The Mattituck volunteer fire department was organized in 1905. They must have used a horse drawn pumper because Mattituck did not wholly embrace mechanization until well into the twentieth century. By mid century there were tractors in all the fields however,and parking on Love Lane began to be a problem.
