This resolution was duly ADOPTED. SUPERVISOR COCHRAN: We have a few minutes, twelve or thirteen minutes, I think what we will do is take the audience now. If there is anyone from the audience, that would like to address the Board on any given topic relating to Town business we would be very happy to hear your remarks at this time. I will stop you at five o'clock, because we will have to stop for the hearing. Would you like to address us? JOE MERKEL: My name is Joe Merkel, resident of Southold. Good afternoon, everyone on the Board and Mrs. Cochran. I would just like to talk to you a little bit about the use of pesticides on the East End, and especially along the waterfront areas, marshes, and the creeks. I Originally was just going to discuss the runoff of the pesticides into the creeks and bays, but after reading the articles in The Suffolk Times this past January 16th, on herbicides found in wells, quite: a cocktail of herbicides. I think I could talk about that also, because it seems to be even more important. There is now a need to try to limit the use of lawn chemicals, pesticides, all ~in the waterfront areas. The creeks are breeding areas for both foliage, and sea life. Heavy rainfall, and the over irrigation of lawns run into these areas. You can see the visible signs when the creeks all turn brown after some heavy rains. . I have a few copies of some sheets that I made for you, just to give you an idea. These are typical chemicals that any homeowner could purchase for using on his lawn, or his yard. I kind of highlighted the ones of importance to look at just so you can get an idea. These are just a few of them. There would probably be hundreds of them if you got them alll out. I highlighted the areas for hazard to humans, and domestic animals and the environmental hazards. As you will see :as you look through them all of them kind of say, like this one here, toxic to fish, birds, wildlife; Do not apply directly to water, or surface water will run off into these tidal areas, or the high tide wall. They are all primarily simazine. It would be harmful if swallowed. Do not take internally. Do not breath the dust. Environmental hazard, do not contaminate by distribution by the water. Highly toxic to fish, bird, and wildlife, when applied to a body of water, or where the runoff is. When you look through all these you get a whole idea of, you know, the scope out here, and think of things of what the average person might not be even aware of, you know, what is going on when he is using all these products. So, I think you need to develop a different approach to the lawn and yard care as we know it today. The lawn is not a food crop, so why is it necessary to use all these pesticides, when we really don~t know the long term effects that all these chemical are going to have on the wildlife; and ourselves? Organic program,, which I have on the back sheet, if you look on the back sheet there, which I am trying to promote now. There is a program along with improved cultural practices, such as proper watering, mulching of grass clippings, which are 90% water, and that doesn't lead to any thatch buildup, higher cutting height, would strengthen the lawn. Also, an integrated pest management I.P.M. Program could be used to monitor the conditions, and only apply things as necessary. If you read on the organic thing it's derived from dried whey, cocoa meal, compost, peanut meal, fish tankage, bone meal, ground shells, kelp. You could almost eat that stuff it's so good. It even smells very rich with the cocoa meal in there. It may just take a little bit longer to work, but once they get going they build the soil. Since no one knows what yet causes the Brown Tide taking these steps really help the situation. I can remember back in the 60's, when we first moved out here the abundance of sea llfe in the bays. The bays were chock full of scallops, you could walk across the bAY scalloping back there in the Peconlcs. Up in Flanders Bay as a kid I remember that. The flounder, the blowfish we catch with the nets, the blue claw crabs, the weakfish, the tide runners, the striped bass, fluke, all of these were very abundant in the bays at that time. Now a days some of these species are gone all together and some of the other ones are very, very scarce. So, it's sad to think that in such a short time the situation has changed so much in part of my lifetime. Now, the most recent article in the Suffolk Times the herbicides found in wells, it seems that the precept which contains the chemical slmazine was found in some private wells on Apollo Lane. The instructions on the container states that simazine can travel, seep or leach through the soil, and into the ground, water which may be used for drinking, and it says especially where soils are permeable, for example well drained soils, sands. This is exactly what the soil structure is that we have out here on the eastern end. You dig down at all, and you can see that. The EPA guidelines state causes weight loss, cancers long term JANUARY 21, 1997 31 ~ effect. Tests on lab animals has caused drowsiness, irregular breathing, anorexia weight loss, and some deaths. The situation in Riverhead isn't as critical as out here, since 95% of the homes are hooked to public wells back there, but in Southold we are going to have more serious problems, since most of the homes all have private wells, where we get our drinking water from. in the second article, there is quite a cocktail herbicides, and the County Health Department is doing tests County-wide. They tested . twenty-three wells in Cutchogue, and found chemicals in five of them. One particular well had alachlor, metolachlor, and metribuzin were all found in one, all above the allowable, so that's kind of scary whe. n you start thinking .about it. It's not too far away from here. Then mn the study, in the nitrate and pesticide in the farm fields, the following results were [ound. In ~1975 there was 11.3 milligrams, per liter of nitrates, Which they were hoping that the improved :practices, and thi ~. would lower it, there was still 11.7 milligrams~ per liter. So Jt J.~ an :increase. It shows little has been accomplished, to improve ta decrease these nitrates. So the Town to .take the lead to he str amount of these pestici( mJcals from our bays, and our pr.¥ate :wells too.; The asset for " ' ~ tourism.. That s to see it. The,~ uld work together for our ha ch any way I can help, any kind of committees, and such, I~i,,ng. Try to get something going out here, kind of help us along. I think if everyone works togethe~ we can improve the quality of iii,fO for So thatls what I have to say. Thanks for your time. SUPERVISOR. CO~HRAN'. Joe, why don't .vou ca my. office:; , and make an appo.ntment to Cgme in, and if there is any ether Board member that'; iS intere?ted, maybe We can sit down, and strategize a little bit, or look'and see what we could possibly do, or what our options are. JOE MERKEL: That sounds good. SUPERVISOR COCHRAN: Any Board member is invited to sit in on this. COUNCILMAN MOORE: Are you familiar with restrictions that other communities may have put on the use of this kind of pesticides, where they have particular soil problems? SUPERVISOR COCHRAN: We can track that down. ! think we have to have a starting point somewhere, so if you come in, Pll let the Board members know when you have made the appointment, and anyone that wants to sit in, and let's talk. Thank you, Joe. We only have one or two minutes. We have had two people retire lately from Town Hall. We have had Jim Hubbard, who was a custodian, and we had Tom Fishers, who was running the Building Department, so I would like to wish them well on behalf of the Board.. I know Jim's wife had a list of things already when he came home. I would like to thank the Board, also, in relation to Town Talk, which is a television show that is aired on Channel 27. Two meetings I had Councilman Moore and Councilwoman Oliva. They were the guests. Then this past Week it was Councilwoman Hussle, and Councilman Townsend. I thought it would be important to the community at large to hear what committees they serve on, and how the Board is functioning. So, we did that, and everyone did a nice job, so I would llke to thank you for that. it's five o'clock. May I have a motion to adjourn for a hearing? Moved by Councilman Townsend, seconded by Councilwoman Oliva, it was RESOLVED that a recess be called at this time, 5:00 P.M., for the purpose of holding a public hearing. Vote of the Town Board: Ayes: Councilwoman Oliva, Councilman Supervisor Cochran. This resolution was duly ADOPTED. Councilman Moore, Justice Evans, Townsend, Councilwoman Hussie, Meeting reconvened at 5:05 P.M. 320 JANUARY 21, 1997 SUPERVISOR COCHRAN: We will now pass Number 25. 25.-Moved by Councilwoman Ollva, seconded by Councilwoman Hussie, it was RESOLVED that pursuant to Article 8 of the Environmental Conservation Law, State Envlronmental Quality Review Act, and 6NYCRR Part 617.10, and Chapter ~[t of Code of the Town of Southold, notice is hereby given that the Southold Town Board, in conducting an uncoordinated review of this unlisted action, has determined that there will be no significant effect on the environment: DESCRIPTION , OF ACTION: Proposed "Local Law in Relation to Modifications in Shellfishing Restrictions". which amends Section 77-206 and 77-211.1 of Chapter 77. This Local Law shall take effect upon filing with the Secretary of Councilman Moore, Justice Evans, Townsend. Councilwoman Hussle, COUNCILMAN TOWNSEND: Madame Supervisor, on that. I was j.ust looking it over again, and I realized that there might be a better way to phrase that, then we have phrased it on the public notice, because it could be read to mean that any scallop that had an annual growth line, no matter what size has to have a special permit. It should read, a scallop smaller than 2 and 1/2 Inches. SUPERVISOR COCHRAN: Laury, would you clarify this? TOWN ATTORNEY DOWD: I think Joe's suggestion is a good one, and if you would approve it I would say that the scallops that are less than 2I~ inch tn size with annual growth line could be taken from the Town waters with the approval of the Town Trustees. COUNCILMAN TOWNSEND: Is that significant enough? Since the intent was to do it that was the intent of it, to have scallops that are not less than 2-1/1~. HOWeVer, from tlme to time if you have. an anriual growth rlng, you could take those, but the way it reads to me is if the scallop has an annual growth line you can't take it unless there is a special permit regardless of slze. PETER WENC'ZEL: I didn't read it that way, but you are probably correct. COUNCILMAN TOWNSEND: COUNCILWOMAN HUSSIE: COUNCILMAN TOWNSEND: Does it constitute a major change to do that? No, the essence of it is still the same. I would like to modify that prior to voting on it as a non-substantial change, just a clarification. Just add scallops less than 7-1]~. We're doing the environmental thing that refers to this. We're referring to this resolution, so I want to change it before we do the first one. TOWN ATTORNEY DOWD: I don't think it would change the Environmental Review, because I prepared it with that interpretation in mind. COUNCILMAN TOWNSEND: So, make that amendment then I'll vote. TOWN CLERK TERRY: The Town Attorney will amend this. COUNCILMAN TOWNSEND: To read as follows, scallaps less than 2 1/1~ inches, but with an annual growth line may be taken from Town waters only by resolution of the Southold Town Board of Trustees. I would like to propose that change. COUNCILWOMAN HUSSIE: SUPERVISOR COCHRAN: intent is? That's a whole different ball game. May I hear from the Trustees as to what your PETER WENCZEL: The intent of the change was to prevent scallops that are less the' 2-1/It from being taken. The situation that I think Joe is trying to clarify is, there is some years when it is felt that adults because they may be so dense, or because of Brown Tide conditions may not reach 2-1/[1 by It Is time to take them. That is what the loophole is for. In other words, the Board can say, okay, these scallops are mature animals, they are not 2-.1/~, but it's okay to take them. I think Joe is on track. COUNCILMAN TOWNSEND: If they are less than two and a quarter, but have an annual growth they may be taken upon approval. That's the intent of that. SUPERVISOR COCHRAN: We should have said that. The intent should have been clearer in the law. We are amending the law, but we're not acting on the law yet. We are acting on the environmental aspect. COUNCILWOMAN HUSSIE: As long as we are cleaning up the language here, letter H of that right now reads, if you read it strlc.tly, says that you can only take scallops that are 2-l/It inches. 27.-Moved by Councilwoman Hussie, seconded by Justice Evans, it was RESOLVED that pursuant to Article 8 of the Environmental Conservation Law, State Environmental Quality Review Act, and 6NYCRR Part 617.~10, and Chapter ~t~t of the Code of the Town of Southold, notice is hereby given that the Southold Town Board, in conducting an uncoordinated review of this unlisted action, has determined that there will be no significant effect on the environment. DESCRIPTION OF ACTION: Proposed "Local Law in Relation to Scallop Size Regulations", which amends Section 77-20[t of Chapter 77, Shellfish, of the Code of the Town of Southold by deleting the annual growth line as fixed criteria for determining scallop, harvesting size, and make the criteria applicable only upon a resolution of the Board of Town Trustees. The proposal has been determined not to have. a significant effect on the environment because an EnviFonmental Assessment Form has been submitted and reviewed and the Town Board has concluded that no significant adverse effect to the environment is likely to occur should the proposal be implemented as planned. This proposal will allow the Trustees to better manage shellfish resources by limiting harvesting until after the scallop are spawned. 27.-Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oiiva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 28.-Moved by Councilwoman Oliva, seconded by Justice Evans, WHEREAS, there was presented to the Town Board of the Town of Southold, on the 7th day of January, 1997, a Local Law entitled, "A Local Law in Relation to Scallop Size Regulations"; and WHEREAS, a public hearing was held on this Local Law on the 21st day of January, 1997, at which time all interested persons were given an opportunity to be heard; now, ~therefore, be it RESOLVED that the Town Board hereby enacts Local Law No. 2 - 1997, which reads as follows: LOCAL LAW NO. 2 - 1997 A Local Law in Relation to Scallop Size Requirements BE IT ENACTED, by the Town Board of the Town of Southoid as follows: I. This res~lutlon was duly ADOPTED. IRAN: We will go back to entertaining comments from the l, you wanted to address the Board? LYNN RICHARDS: I am Lynn Richards. I am the coordinator for the ProgramJ for' the Disabled, and I am, also, the proprietor of East End Con~Pan|~n Care. I received a call this afternoon from The Suffolk Times, that the~e was an informal meeting this morning regarding the possibility of the toing into a buSiness similar to mine, and so I have some concerns that. because I didn't know if the Town's intent was to compete businesses or what. I am only here to ask. SUPERVI COCHRAN: If we are going to compete with local business? I don't think we are going to be competing, and final decisions haven't been made. PeOple from the Nutrition Center, Ve McKieghan and Karen, did come in Land do a presentation to the Board for enhancing services in the area of ~ransPortation, and in the area of home care referral. We realize there is [aiLger need here, than, I think, the services that are offered, be it bu or what we offer as a community. Councilman Townsend was it could cause a conflict, or go in competition with a in .town. That's not my feeling 100%. We are certainly going to of that with each step that we take. We are not in business tO put small businesses out of business. We will keep you informed~ [tal~e change.) Is there anyone else that would like to address the Boar~? Any business relating to Town government? / BARBA.R~ KELLIN.G.: My name is Barbara Kelling. I'm from Laurel. I would i?~terested if you are going to do a panel with elderly care to appointecl to it. Do you have a committee that you might have in mind? SUPERVISOR COCHRAN: Yes. BARBARA KELLINC: How is it discussed? What Lynn was just talkinci about, ngw, how is that come about? Do you have committee that works o~ this? 'L SUPERVISOR COCHRAN: Our Human Resource Center, it was recommended by them ~or enhanced services to the community. BARBARA KELLING: If the Town considered this, would they have a committee of townspeople? SUPERVI!;OR COCHRAN: We haven't gotten that far yet. BARBAR. KELLING: Can I ask if you form a committee, that my name be consider~ 17 ;OR COCHRAN: Please. Give us your name and phone number SUPERVI right nov BARBARI KELLING: My name is Barbara Kelling. I live on Laurelwood Drive in .aurel, New York. My number is 298-~226. I will be out of town for six w-~eks, but I will be back March 16th. Thank you. SUPERVISOR COCHRAN: Thank you. Is there anyone else who would like to address the Board? (No response.) If not, I will call for Board reports, if anyone has anything to report. / COUNCILMAN TOWNSEND: Today I presented to the Board the work of the Planning and Zoning Committee relative to Light Industrial and Light InduStrial Office zones. That makes several recommendations for deleting uses, or adding uses for trying to bring the Code up to date, as far as the uses that we could possibly use in our Industrial zones, and the Board 324 JANUARY 997 has received them, and we will refer them to the other Boards, that relate to planning in town, and even though they were part of the recommendations they will make their final recommendations, and then we'll put it into law hopefully, or present it the public for a hearing. The next thing is to go on to look at the rest of the business zones, and see what changes there we can enact that will help the Town's merchants, and protect the Town for the future. AS Supervisor mentioned, I appeared on TV with her, and I also appeared on the Democrats TV show. I seemed to be in demand last Week to talk about other issues. We had several meeting with .t. he Villag~ of C~reenport, which I can't go into details on, but the laWsuit over police protection in Greenport. They are very interesting, and they are energetic, and it has been a real education. That's it. COUNCILWOMAN OLIVA: I was privileged to attend a breakfast in celebration of Martin Luther King's birthday yesterday back in the Radisson Hotel in Islandia. It was attended by about 500 people and it was really very inspiring. They had a speaker by the name of Mr. Haynes, who is now with Hofstra, and is the former ambassador to Algeria, and had just returned from China. He was really inspiring. I hope that~.a lot of the people there would take his message to go Out and look for ~hfferent peer models, and some of, the ones that they have, and look to others who are preSid.'ents of c0ml~anies, and what have it. It was a very, very heartWarming celebration. COUNCILMAN MOORE:' Just very briefly, I think by the next Board meeting we should final legislation ready on the Farm Law. That is some other work 'the Code Committee is working on. I anticipate the :Town Board rmation to report to the public at our next meeting. A in 'the hopper right now, arid we all ho ding back on · m, but hoDefu I¥ by the 4th of February 'we wdl halve .port. I won t characterize ,t by being good .or bad, but news. COUNCILWOMAN HUSSIE: I don't have anything to say, because I'm just going to refer to Channel 27 Wednesday at 9:30, and then you will know what we are all: doing. JUSTICE EVANS: All I have to say is, we did have a resolution on the Fishers Island Metal Dump tonight, and I hope that is last we're going to hear about the Metal Dump, because hopefully it's done after ten, fifteen years, but I think that is the last step. SUPERVISOR COCHRAN: It is a job well done. I would like to thank Ruth for standing in the stead swearing in the Southold Seniors in the club. I was able to do Southold-Peconic, and Mattituck, but Ruth covered the bases for me with the Southold Seniors. Also, I would just llke to say that our Graffiti and Vandalism Committee is moving along real well. i reported to you at the last Board meeting, that we were going to holding hamlet meetings in each hamlet, including the hamlets New Suffolk, East Marion, Orient, right down the line. We are setting those dates right now, so please, watch. We will be publicizing them, and we are encouraging people. this is a part of the program to try to do something in relation to vandalism and graffiti. It is an entire campaign that we're laying out, which is called Community Pride. That's where the hamlets come in. We are hopeful that each hamlet will do a project, that will enhance the hamlet. Part of discouraging graffiti and vandalism is beautification, and taking pride in what we have, and where we live. This will be done not just with adults in the community, but also with young people. The young people's side of it is, also, part of an educational process. So, we look forward to that, and we will be releasing those dates very shortly, and hopefully you will encourage your friends to come on down, and let's do something in each hamlet, that will instill more pride. Also the usual meetings that I JANUARY Zl, 1997 3'25 have had throughout the week, not just committees but with, you know, people from the community. I have many people call, and come in for an appointment, and try to solve some of the problems that are there. As I have said before sometimes I feel llke a social worker, but it's fun, and it's good, and it serves a good purpose. I will call for a motion to adjourn. Moved by Councilwoman Oliva, seconded by Councilman Moore, it was RESOLVED that the Town Board meeting be and hereby is adjourned at 5:25 P,M, Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva. Councilman Townsend, Councilwoman Hussle, Supervisor Cochran. This resolution was duly ADOPTED. Southold Town Clerk
