SOUTBOLD TOWN BOARD
JANUARY 21, 1997
WORK SESSION
Present: Supervisor Jean W. Cochrari, Councilwoman Alice J. Hussie, Councilman
Joseph L. Townsend, Jr., Councilwoman Ruth D. Oliva, Justice Louisa P. Evans,
Councilman William D. Moore, Town Clerk Judith T. Terry, Town Attorney Laury
L. Dowd.
9:10 A.M. - Venetia McKeighan, Director of Human Services, and Karen McLaughlin,
Neighborhood Aide, met with the Town Board to discuss their proposal for expanding
the Human Resources transportation component by offering a cost effective way to
transport elderly and/or physically challenged citizens to physicians and other
essential services. Secondly, they presented a proposal to establish an employment
agency to provide qualified domestic workers to employers seeking the services of
such employees. The employees would receive free basic instruction and training.
The Town would 'have no responsibility for any worker placed with a family. The
family is the employer and would pay the salary. The family would pay the Town
an application fee, plus an hourly fee for the worker. The Town Board did not
make a decision at this time with regard to the proposals.
9:40 A.M. - Richard Hilary met with the Board to discuss his proposed contract with
the Town to provide administrative and management services to the Town's S.O.A.R.
(Stewardship of America's Resources) Program (see resolution 18).
10:50 A.M. Board of Appeals Chairman Gerard Goehringer appeared before the i~
Town Board to ask them to consider appointing another full-time Clerk Typist to
his office. He said that in order for the office to run~_~ciently, there is a need
for two full-time Clerk Typistsand one part-time Clerk Typ~-~. The Board took the
request under advisement.
11:10 A.M. Robert VanBourgondien, Chairman of the Agricultural Advisory
Committee, met with the Board to present the committee's report on the proposed
Dickerson farmland split. He said that it is the committee's opinion that the split
and sale of the southern portion of the 18 acres is in the best interest of agriculture
and Southold Town. They do not feel it compromises the Town's goal of farmland
preservation. The split leaves both parcels significantly greater than 10 acres by
Agricultral and Markets definition. Town Attorney Dowd advised the Board that
the next step is for the applicant to take the request to the Planning Board.
11:25 A.M. - The Town Board took up the following "For Discussion" items:-
Councilman Townsend reported that he has been investigating the need for a new
street light along the Nassau Point Causeway, but has been unable to reach a Park
District Commissioner. After lunch he reported that he spoke to that individual,
determining that the light would be on park district property. He advised that the
Town would be unable to pay for the light, but offered the expertise of
Superintendent of Highways Jacobs in assisting with the most efficient location of
the light.----Request for payment of the Town's share of the additional expenses
related to the public education effort on the Peconic County initiative (resolution
22).----Board set January 29th and 30th to interview applicants for the Board of
Appeals and Planning Board.----Town Board rejected a request from the Eastern
Outboard Racing Club, Inc. to have a one day regatta on the inner portion (
Hallock's Bay, Orient. The Board expressed a number of environmental concerns
with regard to the proposal.----Request from Latham Farms for a refund of the
application fee for a set-off on September 30, 1994. The Board determined that the

applicant had pursued the applicati~)n to the point where the Planning Board was
awaiting the submission of final maps with Health Department approval and the.
preparation of Declaration of Covenants and Restrictions prior to ~taking action on
the final map. In light of those facts, they did not feel the applicant should receive
a refund.----The Board reviewed 1997 resolutions to be voted on by the Supervisor
or Deputy Supervisor at the February 19th business session of the Annual Meeting
of the Association 'of Towns.----A memorandum from the law firm Varnum, Riddering,
$chmidt & Howletl[ LLP, dealing with a model zoning ordinance for communities to
use to regulate the new Personal Communications Service - the newest form of
cellular ,service) and cellular services to be provided while giving communities the
appropriate zoning authority to control proposed new cellular and PCS towers. Town
Attorney Dowd said she'll Contact other towns and obtain their regulations.----Town
Board reviewed information obtained by Councilman Townsend with regard to the
Tax Receiver's salary, and the salaries of the Tax Receivers of the other four east
end towns. A part of the discussion included a memorandum from Receiver of Taxes
Marilyn Quintana questioning information supplied by Senior Accountant Cushman,
and offering justification for a 1997 salary increase. The Board agreed to consider
the increase when they prepare the 1998 Budget.----Letter from Mr. Hank Kuhn
asking the Town Board to consider making their agendas available in the local
libraries. The Supervisor's office will fax a copy on Friday afternoons,g---Receipt

1.'50 P.M. Work Session reconvened and Councilman Townsend and Senior Planner
Scopaz presented to the Town Board a proposal to amend the uses permitted within
the Light Industrial (LI) and Light Industrial Office (LIO) Zoning Districts; a
proposal that was developed by the Planning and Zoning Committee. At the
conclusion of the discussion, it was decided to send a copy to the Planning Board,
Board of Appeals and Town Trustees to review and ask for their comments within
a month.
2:50 P.M. - The Town Board reviewed the resolutions to be voted on at the 4:30
P.M. Regular Meetin. g.
EXECUTIVE SESSION
3:10 P.M. - On motion of Councilwoman Hussie, seconded by Councilwoman Oliva,
it was Resolved that the Town Board enter into Executive Session to discuss
negotiations with the Village of Greenport for settlement of their lawsuit against the
Town, and personnel employment, history. Vote of the Board: Ayes: Supervisor
Cochran, Councilwoman Hussie, Councilman Townsend, Councilwoman Oliva, Justice
Evans, Councilman Moore. Also present: Town Clerk Terry, Town Attorney Dowd.

Bernadette Castro. As we announced last week, we have received a grant
for $200,000 from New York State Parks, which is towards the purchase of
Fort Corchaug Park project.

of a matching grant for the Fort Corchaug Park project.
IV. PUBLIC HEARINGS.
SUPERVISOR COCHRAN: We have two hearings tonight, one at 5:00 P.M.,
on a "Local Law in Relation to Modifications in Shellfishing Regulations",
and at 5:02 a hearing on a "Local Law in Relation to Scallop Size
Regulations". So, we will interpret business at 5:00 o'clock to go into the
hearings.

SUPERVISOR COCHRAN: As you know the Town Board has a policy that
allows for time prior to the adoption of any resolutions, or anyone that
would like to make comment in relation to any of the resolutions listed on
the agenda. So, I will entertain your comments on resolutions at this
point. Later in the program you do have adequate time to allow addressing
the Board on topics not a part of the resolutions. Is there anyone who
would like to address the Board in relation to resolUtions on the agenda?

Community College Technicenter in conjunction with the New York State
Department of Labor, at the SCCC Tech nicenter, Hauppauge, from
8:00 A.M. to 10:00 A.M., on January 29, February 5, 12, 19, 26, March 5,
12, 19, 1997, and the $80.00 tuition for all eight sessions and the
necessary expenses for travel, using a Town vehicle, shall be a legal charge
to the Accounting & Finance Department's 1997 budget.

deleting Shawmut Bank, and increasing Fleet Bank's collateral from
$1,000,000.00 to $5,000,000.00.

York, as time and place for a public hearing on this Local Law, which reads

BE IT ENACTED, BY THE Town Board of the Town of Southold as follows:
I. Chapter 85 (Taxation) of the code of the Town of Southold is
hereby amended as follows:
1. Section 85-1 (partial exemption for senior citizens) is
amended as follows:
A. Amount of exemption.
(1) Rea! property owned by one (1) or more persons, each
of whom is sixty-five (65) years of age or over. or real property
owned by husband and wife. one (1) of whom is sixty-five
(65): years of age or over. shall be exempt from town taxes to

permission to Senior Accountant John Cushman and Principal Account Clerk
Connie Solomon to attend a Cash Management User's Training Seminar,
specifically for munlcipal and school district customers of Fleet Bank, on
Tuesday, January 1~, 1997, from 9:00 A.M. to 12:30 P.M., at Fleet Bank's
Long Island headquarters building in Melville, N.Y., arid the necessary
expenses for lunch and use of a Town vehicle for travel shall be a legal
expense to the Accounting & Finance Department's 1997 budget.

RESOLVED that the Town Board of the Town of Southold hereby
authorizes and direct Supervisor Jean W. Cochran to execute agreements
with Fleet Bank for Cash Management Services to include Fleet's Treasury
Express and Automated Clearing House Services, all in accordance with the
approval of the Town Attorney.

authorizes and directs Supervisor Jean W. Cochran to execute a Safety Video
Loan Agreement between the National Resource Safety Center Inc. and the
Town, all in accordance with the approval of the Town Attorney.

RESOLVED that the Town Board of the Town of Southold hereby grants
permission to police Officers Ginas, Fohrkolb, and Quarry to attend
an Emergency Medical Technical Refresher Course, to be given at the
Mattituck Fire Department Headquarters, from January 8, 1997 to April 17,
1997, and the $35.00 tuition per person shall be a legal charge to the
Police Department's 1997 budget.

authorizes and directs the Town Clerk to advertise for bids for the
purchase of one (1) 1997 Pick-Up Truck with Snow Plow for the
Superintendent of Highways.

RESOLVED that the Town Board of the Town of Southold hereby
authorizes and directs the Town Clerk to advertise for resumes for a
part-time Clerk Typist for the Board of Trustees, 17-1/2 hours per week,
at a salary of $6.82 per hour.

16.-Moved _by Justice Evans, seconded by Councilwoman Oliva,
WHEREAS, when MV RACE POINT was drydocked in December 1996,
stress cracks to shell plating-and stress fractures of internal framing were
found in way of the fuel and ballast tanks between frames 61 and 73 (aft of
the engine room), and the U.S. Coast Guard has required that repairs,
including additional strengthening of the vehicle deck, be affected before
the vessel may resume her normal services; and
WHEREAS, the Board of Commissioners of the Fishers Island Ferry
District is of the opinion that during winter months, when the most severe

minutes, I think what we will do is take the audience now. If there is
anyone from the audience, that would like to address the Board on any
given topic relating to Town business we would be very happy to hear your
remarks at this time. I will stop you at five o'clock, because we will have
to stop for the hearing. Would you like to address us?
JOE MERKEL: My name is Joe Merkel, resident of Southold. Good
afternoon, everyone on the Board and Mrs. Cochran. I would just like to
talk to you a little bit about the use of pesticides on the East End, and
especially along the waterfront areas, marshes, and the creeks. I
Originally was just going to discuss the runoff of the pesticides into the
creeks and bays, but after reading the articles in The Suffolk Times this
past January 16th, on herbicides found in wells, quite: a cocktail of
herbicides. I think I could talk about that also, because it seems to be
even more important. There is now a need to try to limit the use of lawn
chemicals, pesticides, all ~in the waterfront areas. The creeks are breeding
areas for both foliage, and sea life. Heavy rainfall, and the over
irrigation of lawns run into these areas. You can see the visible signs
when the creeks all turn brown after some heavy rains. . I have a few
copies of some sheets that I made for you, just to give you an idea. These
are typical chemicals that any homeowner could purchase for using on his
lawn, or his yard. I kind of highlighted the ones of importance to look at
just so you can get an idea. These are just a few of them. There would
probably be hundreds of them if you got them alll out. I highlighted the
areas for hazard to humans, and domestic animals and the environmental
hazards. As you will see :as you look through them all of them kind of say,
like this one here, toxic to fish, birds, wildlife; Do not apply directly
to water, or surface water will run off into these tidal areas, or the high
tide wall. They are all primarily simazine. It would be harmful if
swallowed. Do not take internally. Do not breath the dust. Environmental
hazard, do not contaminate by distribution by the water. Highly toxic to
fish, bird, and wildlife, when applied to a body of water, or where the
runoff is. When you look through all these you get a whole idea of, you
know, the scope out here, and think of things of what the average person
might not be even aware of, you know, what is going on when he is using
all these products. So, I think you need to develop a different approach
to the lawn and yard care as we know it today. The lawn is not a food
crop, so why is it necessary to use all these pesticides, when we really
don~t know the long term effects that all these chemical are going to have
on the wildlife; and ourselves? Organic program,, which I have on the back
sheet, if you look on the back sheet there, which I am trying to promote
now. There is a program along with improved cultural practices, such as
proper watering, mulching of grass clippings, which are 90% water, and
that doesn't lead to any thatch buildup, higher cutting height, would
strengthen the lawn. Also, an integrated pest management I.P.M. Program
could be used to monitor the conditions, and only apply things as
necessary. If you read on the organic thing it's derived from dried whey,
cocoa meal, compost, peanut meal, fish tankage, bone meal, ground shells,
kelp. You could almost eat that stuff it's so good. It even smells very
rich with the cocoa meal in there. It may just take a little bit longer to
work, but once they get going they build the soil. Since no one knows
what yet causes the Brown Tide taking these steps really help the
situation. I can remember back in the 60's, when we first moved out here
the abundance of sea llfe in the bays. The bays were chock full of
scallops, you could walk across the bAY scalloping back there in the
Peconlcs. Up in Flanders Bay as a kid I remember that. The flounder,
the blowfish we catch with the nets, the blue claw crabs, the weakfish,
the tide runners, the striped bass, fluke, all of these were very abundant
in the bays at that time. Now a days some of these species are gone all
together and some of the other ones are very, very scarce. So, it's sad to
think that in such a short time the situation has changed so much in part
of my lifetime. Now, the most recent article in the Suffolk Times the
herbicides found in wells, it seems that the precept which contains the
chemical slmazine was found in some private wells on Apollo Lane. The
instructions on the container states that simazine can travel, seep or
leach through the soil, and into the ground, water which may be used for
drinking, and it says especially where soils are permeable, for example well
drained soils, sands. This is exactly what the soil structure is that we
have out here on the eastern end. You dig down at all, and you can see
that. The EPA guidelines state causes weight loss, cancers long term

effect. Tests on lab animals has caused drowsiness, irregular breathing,
anorexia weight loss, and some deaths. The situation in Riverhead isn't as
critical as out here, since 95% of the homes are hooked to public wells back
there, but in Southold we are going to have more serious problems, since
most of the homes all have private wells, where we get our drinking water
from. in the second article, there is quite a cocktail herbicides, and the
County Health Department is doing tests County-wide. They tested
. twenty-three wells in Cutchogue, and found chemicals in five of them. One
particular well had alachlor, metolachlor, and metribuzin were all
found in one, all above the allowable, so that's kind of scary whe. n you
start thinking .about it. It's not too far away from here. Then mn the
study, in the nitrate and pesticide in the farm fields, the following
results were [ound. In ~1975 there was 11.3 milligrams, per liter of nitrates,
Which they were hoping that the improved :practices, and
thi ~. would lower it, there was still 11.7 milligrams~ per liter.

had Jim Hubbard, who was a custodian, and we had Tom Fishers, who

Talk, which is a television show that is aired on Channel 27. Two meetings

was to do it that was the intent of it, to have scallops that are not less
than 2-1/1~. HOWeVer, from tlme to time if you have. an anriual growth rlng,
you could take those, but the way it reads to me is if the scallop has an
annual growth line you can't take it unless there is a special permit
regardless of slze.

for. In other words, the Board can say, okay, these scallops are mature
animals, they are not 2-.1/~, but it's okay to take them. I think Joe is on
track.
COUNCILMAN TOWNSEND: If they are less than two and a quarter, but
have an annual growth they may be taken upon approval. That's the intent
of that.
SUPERVISOR COCHRAN: We should have said that. The intent should have
been clearer in the law. We are amending the law, but we're not acting on
the law yet. We are acting on the environmental aspect.

here, letter H of that right now reads, if you read it strlc.tly, says that

LYNN RICHARDS: I am Lynn Richards. I am the coordinator for the
ProgramJ for' the Disabled, and I am, also, the proprietor of East End
Con~Pan|~n Care. I received a call this afternoon from The Suffolk Times,
that the~e was an informal meeting this morning regarding the possibility of
the toing into a buSiness similar to mine, and so I have some
concerns that. because I didn't know if the Town's intent was to
compete businesses or what. I am only here to ask.
SUPERVI COCHRAN: If we are going to compete with local business? I

COUNCILMAN TOWNSEND: Today I presented to the Board the work of the
Planning and Zoning Committee relative to Light Industrial and Light
InduStrial Office zones. That makes several recommendations for deleting
uses, or adding uses for trying to bring the Code up to date, as far as
the uses that we could possibly use in our Industrial zones, and the Board

has received them, and we will refer them to the other Boards, that relate
to planning in town, and even though they were part of the
recommendations they will make their final recommendations, and then we'll
put it into law hopefully, or present it the public for a hearing. The next
thing is to go on to look at the rest of the business zones, and see what
changes there we can enact that will help the Town's merchants, and
protect the Town for the future. AS Supervisor mentioned, I appeared on
TV with her, and I also appeared on the Democrats TV show. I seemed to
be in demand last Week to talk about other issues. We had several meeting
with .t. he Villag~ of C~reenport, which I can't go into details on, but the
laWsuit over police protection in Greenport. They are very interesting, and
they are energetic, and it has been a real education. That's it.
COUNCILWOMAN OLIVA: I was privileged to attend a breakfast in
celebration of Martin Luther King's birthday yesterday back in the Radisson
Hotel in Islandia. It was attended by about 500 people and it was really
very inspiring. They had a speaker by the name of Mr. Haynes, who is
now with Hofstra, and is the former ambassador to Algeria, and had just
returned from China. He was really inspiring. I hope that~.a lot of the
people there would take his message to go Out and look for ~hfferent peer
models, and some of, the ones that they have, and look to others who are
preSid.'ents of c0ml~anies, and what have it. It was a very, very
heartWarming celebration.
COUNCILMAN MOORE:' Just very briefly, I think by the next Board
meeting we should final legislation ready on the Farm Law. That is some
other work 'the Code Committee is working on. I anticipate the :Town Board
rmation to report to the public at our next meeting.

COUNCILWOMAN HUSSIE: I don't have anything to say, because I'm just
going to refer to Channel 27 Wednesday at 9:30, and then you will know
what we are all: doing.
JUSTICE EVANS: All I have to say is, we did have a resolution on the
Fishers Island Metal Dump tonight, and I hope that is last we're going to
hear about the Metal Dump, because hopefully it's done after ten, fifteen
years, but I think that is the last step.
SUPERVISOR COCHRAN: It is a job well done. I would like to thank Ruth
for standing in the stead swearing in the Southold Seniors in the club. I
was able to do Southold-Peconic, and Mattituck, but Ruth covered the bases
for me with the Southold Seniors. Also, I would just llke to say that our
Graffiti and Vandalism Committee is moving along real well. i reported to
you at the last Board meeting, that we were going to holding hamlet
meetings in each hamlet, including the hamlets New Suffolk, East Marion,
Orient, right down the line. We are setting those dates right now, so
please, watch. We will be publicizing them, and we are encouraging people.
this is a part of the program to try to do something in relation to
vandalism and graffiti. It is an entire campaign that we're laying out,
which is called Community Pride. That's where the hamlets come in. We are
hopeful that each hamlet will do a project, that will enhance the hamlet.
Part of discouraging graffiti and vandalism is beautification, and taking
pride in what we have, and where we live. This will be done not just with
adults in the community, but also with young people. The young people's
side of it is, also, part of an educational process. So, we look forward to
that, and we will be releasing those dates very shortly, and hopefully you
will encourage your friends to come on down, and let's do something in
each hamlet, that will instill more pride. Also the usual meetings that I

have had throughout the week, not just committees but with, you know,
people from the community. I have many people call, and come in for an
appointment, and try to solve some of the problems that are there. As I
have said before sometimes I feel llke a social worker, but it's fun, and
it's good, and it serves a good purpose. I will call for a motion to
