Townsend, Jr., Councilwoman Ruth D. Oliva, Justice Louisa P. Evans, Councilman William D. Moore, Town Clerk Judith T. Terry, Town Attorney Laury L. Dowd. 9:30 A.M. - The Town Board met to review and finalize the resolutions to be voted on at the 1:00 P.M. Organizational Meeting. They met individually with Senior Accountant John Cushman to discuss salaries and expenditures, and with Receiver of Taxes Marilyn Quintana, who requested salary increases for her staff and herself. EXECUTIVE SESSION 11:10 A.M. - On motion of Councilwoman Oliva, seconded by Councilwoman Hussie, it was Resolved that the Town Board enter into Executive Session to discuss the Town Attorney. Vote of the Board: Ayes: Supervisor Cochran, Councilwoman Hussie, Councilman Townsend, Councilwoman Oliva, Justice Evans, Councilman Moore. Also present: Town Clerk Terry. As a result of this Executive Session resolutions 45 and 46 were placed on the agenda - to advertise for resumes for a Town Attorney and to set the salary of the Town Attorney. 12:25 P.M. - Work Session adjourned. ORGANIZATIONAL MEETING -1:00 P.M. The Or~lanization Meeting of the Southold Town Board was held on Tuesday, January 2, 1997, at the Southotd Town Hall, Main Road, Southold, New York. Supervisor Cochran opened the meeting at 4:30 P.M., with the Pledge of Allegiance to the Flag. Present: Supervisor Jean W. Cochran Councilwoman Alice J. Hussie Councilman Joseph L. Dowd SUPERVISOR COCHRAN: We'll start with Resolution ~¢1. JANUARY 2, 1997 2 '8 '3 1.-SUPERVISOR'S APPOINTMENT Supervisor Jean Cochran hereby appoints William D. Moore as Deputy Supervisor of the Town of Southold for the term of January 1, 1997 to December 31, 1997. 2.-SUPERVISOR'S APPOINTMENT Supervisor Jean Cochran hereby appoints Patricia D. Garsik as Confidential Secretary SUPERVISOR COCHRAN: Resolution #3, appointing a Town Attorney, is on hold. Amended January 21, 1997 by Resolption.#5 4.-Moved by Councilwoman Oliva, s~conc]ecl oy Justice Evans, WHEREAS, Section 64 of the Town Law requires the Town Board to designate, by resolution, banks in the State in which the Supervisor or other officers of the Town shall deposit all moneys coming into their hands by virtue of their office; and WHEREAS, the Town Board may require any bank, so designated, to deposit with such Board bonds or certificates of the United States, of the State of New York, or any county, town, city, village or school district of the State of New York, such security for such funds so deposited, but such bond or certificate shall be subject to the approval of the Town Board and shall be deposited in such place and held under such conditions as the Town Board may determine; now, therefore, be it RESOLVED that the following banks are hereby designated for fiscal year 1997 as depositories, and the following securities are hereby required as collateral for such cash balances in said banks: Bridgehampton National Bank Bridgehampton National Bank (Tax Receivers' Account) Fleet Bank North Fork Bank North Fork Bank Tax Receiver's Account) Shawmut Bank Suffolk County National Bank $1,000,000.00 $5,000.000.00 $1,000,000.00 $5,000,000.00 $5,000,000.00 $ 100,000.00 $5,000,000.00 AND BE IT FURTHER RESOLVED that the Town Board hereby authorizes Supervisor Jean W. Cochran to execute Collateral Agreements between the Town of Southold and the above designated banks and their Third Part Custodial Institutions, all in accordance with the approval of the Town Attorney; and be it FURTHER RESOLVED that authorization for increase and decrease of securities shall be subject to the approval of the Supervisor. 4. -Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussle, Supervisor Cochran. This resolution was duly ADOPTED. 5. -Moved by Councilman Townsend. seconded by Councilwoman Oliva, it was WHEREAS, Section 11 of the General Municipal Law requires that the Town Board may authorize the Supervisor, chief fiscal officer of the Town, to 'nvest moneys not required for immediate expenditure; now, therefore, be it RESOLVED that the Supervisor is hereby authorized to deposit or invest moneys not requires for immediate expenditure in special time deposit accounts, or Certificates of deposit issued by a bank or trust company located and authorized to do business in this State, provided, however, that such time deposit accounts are certificates of deposit shall be payable within such time as the proceeds shal be needed to meet expenditures for which such moneys are obtained, and provided furtl~er that such time deposit accounts or certificates of deposit be secured in the manner provided in Section 11 of the General Municipal Law. 5. -Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Ollva, Councilman Townsend, Councilwoman Hussle, Supervisor Cochran. Cochran, except those third party checks, drafts or other instruments 'n amounts in excess of $5,000.00, drawn upon the following banks: Brldgehampton National Bank Fleet Bank North Fork Bank ShaWmut Bank Suffolk County Nationa Bank 6. -Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran, This resolution was duly ADOPTED. 7.-Moved by Councilwoman Hussie, seconded by Councilman Moore, it was RESOLVED that the Town Board of the Town of Southold hereby grants permiss|on to Supervisor Jean W. Cochran to travel within New York State on Town business, as required throughout the year, and the necessary expenses for travel, meals and lodging shall be a legal charge to the 1997 Budget. 7.-Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 8.-Moved by Councilman Moore, seconded by Councilwoman Oliva, it was RESOLVED that The Suffolk Times, a newspaper regularly published in the Town of Southold, which has been entered as a second class mail matter, be and the same is hereby designated, effective February t, 1997, as the official newspaper of the Town of Southold for the publication of notices, resolutions, ordinances and other matter required to be published. 8.-Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilwoman Hussie, Supervisor Cochran. Abstain: Councilman Townsend. This resolution was duly ADOPTED. 9.-Moved by Councilwoman Hussie, seconded by Councilwoman Oliva, it was RESOLVED that pursuant to Section 64 (l-a) of the Town Law, a petty cash fund is hereby established in the following amounts for the following individuals: Supervisor Jean W. This resolution was duly ADOPTED. 10.-Moved by Councilman Moore, seconded by Councilwoman Oliva, it was RESOLVED that Supervisor Jean W. Cochran be and she hereby is designated to represent the Town of Southold at the annual meeting of the Association of Towns of the State of New York, to be held in New York City on February 16, 17, 18, 19, 1997, and to cast the vote of the Town of Southold pursuant to Section 6 of Article III of the Constitution and By-Laws of the Association of Town; and be it .JANIJARY 2, 1997 FURTHER RESOLVED that Councilman William D. Moore be an~d here is designated to act as the alternate delegate, to cast the vote oF-the Town of Southold at the annual meeting of the Association of Towns in the absence of Supervisor Cochran. 10.-Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, . This resolution was duly ADOPTED. 11 .-Moved Councilwoman Oliva, seconded by Justice Evans, it was RESOLVED that those officers and employees of the Town of Southold attending the annual meeting of the Association of Towns of the State of New York b~ and hereby are allowed a maximum of $600.00 per officer and employee for the actual and necessary expenses for registration, travel, meals and lodging incurred while attending such meeting. 11.-'Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman OlJva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 12.-Moved by Justice Evans, seconded by Councilwoman Oliva, it was RESOLVED that any Town offic}al, elected or' appointed, who is required to use his own automobile in the performance of his duty, shall be compensated for travel expenses necessarily and actually incurred in carrying out the duties of his office, at a rate not to exceed thirty cents ($.30) per mite. 12.-Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 13.-Moved by Councilwoman Oliva, seconded by Justice Evans, WHEREAS, it is required by Section 27, Subdivision 1 of the Town Law, that the Town Board fix, from time to time, the salaries of all officers and employees of the Town, whether elected or appointed, and determine when the same shall be payable, and that the salaries of the members of the Town Board, the elected Town Clerk and elected Superintendent of Highways shall not be fixed in an amount in excess of the amounts respectively specified in the notice of hearing on the preliminary budget published pursuant to Section 108 of the Town Law; now, therefore, be it RESOLVED that the annual salaries of the officials shall be as follows, to wit: Supervisor Jean W. ~ochran Councilwoman Alice J. This resolution was duly ADOPTED. 14.-Moved by Councilwoman Hussie, seconded by Councilwoman Oliva, it was RESOLVED that pursuant to Section 1~2(1-A) of the Highway Law, the Southold Town Superintendent of Highways be and he hereby is autho~-ized to purchase equipment, tools, snow plows and other implements and devices without prior approval of the Town Board in an amount not to exceed $10,000.00 for any one item during the period from January 1, 1997 through December 31, 1997. 14..-Vote of the Town Boa rd: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 15.-Moved by Councilman Townsend, seconded by Councilwoman Oliva, it was RESOLVED by the Town Board of the Town of Southold that the Commissioner of Public Works be and he hereby is authorized to purchase necessary supplies and equipment, without prior approval of the Town Board, in an amount not to exceed $10,000.00 or any one item during the period from January 1, 1997 through December 31, 1997. 15.-Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. JANUARY 2, 1997 287 17.-Moved by Councilman Moore, seconded by Councilwoman Oliva, it was WHEREAS, Section 22B of the Town Law allows the Town Board of any town having more than one Assessor to establish the office of Chairman of the Town Assessors, who, in addition to his regular duties, shall perform such services in connection with assessment and taxation of property for state, county and town purposes as the Board shall direct; now, therefore, be it RESOLVED that Assessor Scott A. Russell be and hereby is designated to hold the office of Chairman of the Board of Assessors until the 31st day of December, 1997, at the pleasure of the Town Board, all in accordance with Section 22B of the Town Law; and be it FURTHER RESOLVED that the compensation for such appointment be fixed at $2,000.00 per annum, payable in regular bi-weekly payments. 17.- Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Supervisor Cocnran. This resolution was duly ADOPTED. 18.-Moved by Councilwoman Oliva, seconded by Councilman Moore, it was RESOLVED that pursuant to Section 272 of the Town Law, Bennett Orlowski, Jr. is hereby designated Chairman of the Southotd Town Planning Board for the term of January 1 1997 through December 31, 1997; and be it ' FURTHER RESOLVED that the Chairman of the Planning Board shall be responsible for furnishing to the Town Board a detailed monthly report of activities within his department; and be it FURTHER RESOLVED .that the Chairman of the Planning Board shall be paid a salary of $2,000.00 per annum, in addition to his regular salary, effective January 1, 1997 through December 31, 1997, and the same shall be paid in regular bi-weekly payments. 18.- Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oiiva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. SUPERVISOR COCHRAN: We are holding Number 19, appointing a Chairman of the Board Appeals, because we will be meeting with the Zoning Board of Appeals, and so we are holding that until after the meeting. 20.-Moved by Councilwoman Hussie, seconded by Councilman Moore, WHEREAS, it is required by Section 27, Subdivision 1 of the Town Law that the Town Board fix, from time to time, the salaries of the officers and employees of the Town, whether elected or appointed, and determine when the same shall be payable; now, therefore, be it RESOLYED that the annual salaries of the members of the Plann'ng Board and the Board of Appeals of the Town of Southold be and hereby are fixed as follows for the term of January I, 1997 through December 31, 1997: PLANNING BOARD William Cremers Kenneth L. Councilman Moore, Justice Evans, Townsend, Councilwoman Hussle, 23.-Moved by Counc|twoman Hussie, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby sets the compensation of the members of the Southold Town Board of Assessment Review, effective January 1, t997 through December 31, 1997, at $60.00 per person per meeting, total compensation per person not to exceed $1,000.00, and total compensation for all five members of the Board not to exceed $5,000,00 .for 1997. 23.- Vote of. the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 24.-Moved by Councilwoman Oliva, seconded by Councilman Moore, it was RESOLVED that the Town Board of the Southold hereby appoints Dr. Edward Broderlck, Superintendent of the New Suffolk Common School and Laurel Common School, as Attendance Officer for the year 1997, subject to the written approval of the District Superintendent of Schools; and be it it FURTHER RESOLVED that the compensation of the Attendance Officer be fixed at $5°00 per hour when working in this capacity, he to pay his own expenses; and be it FURTHER RESOLVED that the Town Clerk be and she hereby is instructed to notify Dr. Broderick and the District Superintendent of Schools of this appointment. 24.-Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran.
