Goehringer SOUTHOLD TOWN BOARD OF APPEALS TELEPHONE (516) 765-1809 MAY 7, 1980 A Special Meeting of the Southold Town Board of Appeals was held on Wednesday, May 7, 1980 at 4:15 o'clock P.M. at the Southold Town Hall, Main Road, Southold, New York 11971. Present were: Charles Grigonis, Jr., Chair~an; Terry R. Tuthill; Robert J. DouglasS; and Gerard P. Goeb~inger. Absent was: Messr. Serge Doyen, Jr. On motion made by Mr. Douglass, seconded by Mr. Goehringer, it was RESOLVED, that the following appeals be scheduled and advertised for public hearings to be held at the next regular meeting of this Board, to wit, May 22, 1980 at the below specified times: 7:35 P.M. Appeal No. 2687. Application of Marino Fara- guna. Sideyard variance for proposed dwelling. Location: 5675 Skunk Lane, Cutchogue, NY. 7:45 P.M. Appeal No. 2685. Application of Emanuel and Venita Lorras. Rearyard setback variance for proposed addition. Location: 2135 Bay Avenue, East Marion, NY. 8:00 P.M. Appeal No. 2692. Application of Victor E. Catalano. Location: Winthrop Drive and Reservoir Road, Fishers Island, NY. 9:55 P.M. Appeal No. FL-2. Application of Richard Zeisler. Variance to the Flood Damage Prevention Law, Section 46-18A, B, to construct basement below the restricted base flood elevation in a special hazard flood zone. Jacksons Landing, Mattituck, NY. Vote of the Board: Ayes: Messrs. Grigonis, Tuthill, Douglass and Goehringer. Absent: Messr. Doyen. Upon reviewing all of the files being scheduled for the next regular meeting of May 22, 1980, the Board members asked that letters be sen~ to the N.Y.S. FL-2 Richard Zeisler. ~outhold Town Board of Appeals -3- May 7, 1980 Special Meeting On motion by Mr. Grigonis, seconded by Mr. Douglass, it was RESOLVED, after reconsideration and further review, it is the consensus of the Board that a $25.00-filing fee would be more equitable in light of the costs involved of appeal applica- tions to the zoning ordinance, and that the Chairman is authorized and directed to send a letter to the Southold Town Board recommend- ing same. Vote of the Board: Ayes: Messrs. Grigonis, Tuthill, Douglass and Goehringer. Absent: Messr. Doyen. On motion by Mr. Douglass , seconded by Mr. Goehringer, it was RESOLVED, in the application of FRANK and JACQUELINE WEBER, for permission to construct dwelling with insufficient sideyards, Article III, Section 100-31, that after review of the Environmental Assessment Short Form, which has indicated that no significant adverse effects to the environment were likely to occur, and review of the documents submitted therewith, this Board has determined that this project if implemented as planned is classified as a Type II Action, not having a sig- nificant effect upon the environment (Section 617.13 of the New York State Environmental Quality Review Act, and Section 44-4B of the Southold Town Code), subject to the approvals and/or recommendations of the Suffolk County Health Depart- ment and New York State Department of Environmental Conser- vation. Vote of the Board: Ayes: Messrs. Grigonis, Tuthill, Doug- lass and Goehringer. Absent: Messr. Doyen. On motion by Mr. Douglass , seconded by Mr. Goehringer, it was RESOLVED, in the application of KENNETH STRACHAN, JR., for permission to construct garage in the sideyard and/or frontyard area, Appeal No. 2697 at property located off a proposed right-of-way off King Street, Orient, New York, that after review of the Environmental Assessment Short Form, which has indicated that no significant adverse effects to the environment were likely to occur, and review of the documents submitted therewith, this Board has determined that this project if implemented as planned is classified as a Type II Action, not having a significant effect upon the environment( Section 617.13 of the New York State Environ- mental Quality Review Act, and Section 44-4B of the Southold Town Code), subject to the approvals and/or recommendations of the Suffolk County Health Department and New York State Department of Environmental Conservation. Grigonis, Tuthill, Messr. Doyen. seconded by Mr. Goehringer, RESOLVED, in the application of KENNETH STRACHAN, JR. for a variance to the New York Town Law, Section 280-A for approval of Access at a right-of-way located off the south side of King Street, Orient, New York, that after review of the Environmental Assessment Short Form, which has indicated that no significant adverse effects to the environment were likely to occur, and review of the documents submitted therewith, this Board has determined that this project if implemented as planned is classified as a Type II Action, not having a sig- nificant effect upon the environment (Section 617.13 of the New York State Environmental Quality Review Act, and Section 44-4B of the Southold Town Code), subject to the approvals and/or recommendations of the Suffolk County Health Department, and New York State Department of Environmental Conservation. Vote of the Board: Ayes: Messrs. Grigonis, Tuthill, .Douglass and Goehringer. Absent: MesSr. Doyen. On motion by Mr. Douglass , seconded by Mr. Goehringer, it was RESOLVED, in the application of MARINO FARAGUNA, in Appeal No. 2687, for permission to construct dwelling in the sideyard area with insufficient setback, that after review of the Environmental Assessment Short For~, which has indicated that no significant adverse effects to the environment were likely to occur, and review of the documents submitted therewith, this Board has determined that this project if implemented as planned is classified as a Type II Action, not having a sig- nificant effect upon the environment (Section 617.13 of the New York State Environmental Quality Review Act, and Section 44-4B of the Southold Town Code), subject to the approvals and/or recommendations of the Suffolk County Health Department and New York State Department of Environmental Conservation. Vote of the Board: Ayes: Messrs. Grigonis, Tuthill, Douglass and Goehringer. Absent: Messr. Doyen. On motion by Mr. Douglass , seconded by Mr. Goehringer, it was RESOLVED, in the application of EMANUEL & VENITA LORRAS, in Appeal No. 2685 for permission to construct addition with insufficient rearyard setback at property known as 2135 Bay Southotd Town Board of APpeals -5- May 7, 1980 Special Meeting Avenue, East Marion, New York 11939, that after review of the Environmental Assessment Short Form, which has indicated that no significant adverse effects to the environment were likely to occur, and review of the documents submitted therewith, this Board has determined that this project if implemented as planned is classified as a Type II Action, not having a sig- nificant effect upon the environment (Section 617.13 of the New York State Environmental Quality Review Act, and Section 44-4B of the Southold Town Code). Vote of the Board: Ayes: Messrs. Grigonis, Tuthill, Doug-. lass and Goehringer. Absent: Messr. Doyen. On motion by Mr. Douglass , seconded by Mr. Goehringer, it was RESOLVED, in the application of VICTOR E. CATALANO, in Appeal No. 2692, for variances to the zoning ordinance: (a) approving the area for Lots 1 and 2 due to proposed change in lot line, and (b) approving the road frontage for Lot 3, of property located at the south side of Great Peconic Bay Boulevard, Laurel, New York, that after review of the Environmental Assessment Short Form, which has indicated that no significant adverse effects to the environment were likely to occur, and review of the documents submitted therewith, this Board has determined that this project if implemented as planned is classified as a Type II Action, not having a sig- nificant effect upon the environment (Section 617.13 of the New York State Environmental Quality Review Act, and Section 44-4B of the Southold Town Code). Vote of the Board: Ayes: Messrs. Grigonis, Tuthill, Douglass and Goehringer. Absent: Messr. Doyen. On motion by Mr. Douglass , seconded by Mr. Goehringer, it was RESOLVED, in the application of FRANK E. BROPHY, in Appeal No. 2693 for approval of deck addition with insufficient front and sideyard setbacks at property known as 75 Second Street, New Suffolk, New York 11956, that after review of the Environmental Assessment Short Form, which has indicated that no significant adverse effects to the environment were likely to occur, and review of the documents submitted therewith, this Board has determined that this project if implemented as planned is classified as a Type II Action, not having a sig- nificant effect upon the environment (Section 617.13 of the New York State Environmental Quality Review Act, and Section 44-4B of the Southold Town Code). Vote of the Board: Ayes: Messrs. Grigonis, Tuthill, Douglass and Goehringer. Absent: Messr. Doyen. ~Southold Town Board of Appeals -6- May 7, 1980 Special Meeting On motion by Mr. Douglass , seconded by Mr. Goehringer, it was RESOLVED, that in the application of RICHARD and MARY LINDSAY, in Appeal No. 2695 for permission to construct addition with an insufficient frontyard setback at property known as 435 Watersedge Way, Southold, New York, that after review of the Environmental Assessment Short Form, which has indicated that no significant adverse effects to the environment were likely to occur, and review of the documents submitted therewith, this Board has determined that this project if implemented as planned is classified as a Type II Action, not having a significant effect upon the environment (SectiOn 617.13 of the New York State Environmental Quality Review Act, and Section 44-4B of the Southold Town Code). Vote of the Board: Ayes: Messrs. Grigonis, Tuthill, Do~glass and Goehringer. Absent: Messr. Doyen. On motion by Mr. Douglass , seconded by Mr. Goehringer, it was RESOLVED, that in the applicat%on of RENE GENDRON, in Appeal No. 2698 for approval of insufficient area due to proposed changes in lot lines for properties located at Grange Road Extension, Southold, New York, that after review of the Environmental Assessment Short Form, which has indicated that no significant adverse effects to the environment were likely to occur, and review of the documents submitted therewith, this Board has determined that this project if implemented as planned is classified as a Type II Action, not having a significant effect upon the environment (Section 617.13 of the New York State Environmental Quality Review Act, and Section 44-4B of the Southold Town Code). Vote of the Board: Ayes: Messrs. Grigonis, Tuthill, Douglass and Goehringer. Absent: Messr. Doyen. On motion by Mr. Douglass , seconded by Mr. Goehringer, it was RESOLVED, that in the application of ROBERT W. BROOKS, in Appeal No. 2700 for approval of insufficient area, road frontage and insufficient setbacks at property located at Winthrop Drive and Reservoir Road, Fishers Island, New York, that after review of the Environmental Assessment Short Form, which has indicated that no significant adverse effects to the environment were likely to occur, and review of the documents submitted therewith, this Board has determined that this project if implemented as planned is classified as a Type II Action, not having a significant effect upon the environment (Section 617.13 of the New York State Environmental Quality Review Act and Section 44-4B of the Southold Town Code). Southold Town Board of Appeals -7- May 7, 1980 Special Meeting Vote of the Board: Ayes: Messrs. Grigonis, Tuthill, Douglass and Goehringer. Absent: Messr. Doyen. The sgcretary advised the members present ~that on May 5th, a complete application fora variance to the zoning ordinance was received regarding property owned by Irene Cardinale located at the north side of Sound Avenue, Mattituck, New York. Upon reviewing the records, it has been found that the Board originally granted relief in approving the area of three lots as shown on the survey dated December 5, 1977 submitted with this recently received application. Richard T. Haefeli, Esq., representing Irene Cardinale is inquiring as to whether this application is required. The Chairman said that he was a member of the Board at the time of the original granting of the variance on January 12, 1978 in Appeal No. 2383, and said it is his recollection that the Board approved the area and width of the three lots, and it appears the recent application is not necessary. The secretary was asked to advise the attorney, Mr. Haefeli of the above. The meeting was declared closed at 5:25 P.M. Respectfully submitted, L~nda F.
