Highway pavement is not to be opened unless authorized on front sheet (Perm 42b) of this Permit. 2. Sleeves shall be jacked under the highway for all highway crossings, unless permission to cross in any other manner is given in writing by the Department of Transportation; and jacking and receiving pits must be kept a minimum of 5 feet from the edge of pavement. As a general rule, the "open cut" method for crossing a highway will not be permitted,; the need for any such open cut must be substantiated by the permittee and permission granted from the Depart- ment of Transportation on the basis of satisfactory sheeting, maintenance and protection of traffic, compaction equipment, etc. 3. Any excavation in excess of 5 feet in depth must be sheeted in accordance with Code Rule 23 and OSHA. Any excavation closer than 5 feet to the edge of pave- ment must be sheeted as directed by the Department of Transportation. All backfill must be compacted in a manner satisfactory to the Department of Transportation. 4. Adequate signs, barricades, and lights, in accordance with the standards of the New York State Manual of Uniform Traffic Control Devices, Subchapter G, shall be provided. Barricades, whether in sidewalk or roadway area, shall have prominently displayed, for police convenience, the address and telephone number of 24-hour availability of someone who can reset the lights and barricades if it should become necessary. 5. Pedestrian and vehicular traffic is to be maintained and protected at all times. There shall be no unprotected or unlighted drop-offs or obstacles. No pavement openings will be permitted to remain open overnight. They must be backfilled or plated at the end of the workday. Open holes outside the pavement shall be fenced or guarded. The permittee agrees to pay all costs incurred by the State, including man-hours and equipment use, necessary to correct any unsafe conditions on a Permit site. 6. In the event that the permittee has permission from the Department of Transpor- tation to open the pavement, only one lane at a time may be opened provided safe two-way traffic is maintained at all times, with adequate signs and barricades to warn the public whenever work is performed on the highway. As stated above, no pavement area may be left open overnight or on weekends. 7. Adequate access to adjacent properties must be provided. 8. Pavement and Paved Shoulders - Minimum size replacements in finished concrete or asphalt on concrete base shall be 10 feet X width of panel. In all cases, if the replacement is within five feet of a joint, or five feet of a major crack, the replacement must extend to the joint or crack. Any opening in con- crete pavement shall be saw cut and final restoration must be done with High Early Class F concrete mix. In the case of an opening in asphalt, the minimum size replacement shall be 4 feet X 4 feet or at least 18 inch cutback beyond the size of the hole. Asphalt restoration shall be made by cutting, with a wheel or jackhammer the existing adjacent asphalt square, painting the exposed face with hot asphalt, placing the new asphalt, and compacting with a ten-ton roller. Surface variations in excess of 1/4 inch shall be eliminated or the pavement relaid. Unless otherwise directed by the Department of Transportation, asphalt shoulder restoration shall be 4 inches Item 403 (2 1/2 inch Binder and 1 1/2 inch Top) on a sound base. 9. Sidewalk, where disturbed, shall be replaced to full panels of a minimum size 4 feet X 4 feet or as marked when found. Concrete curb where worked on, as in the case of the installation of a new curb cut in an area of existing full curb, or vice versa, shall be removed to its full depth and replaced in accordance with Typical Sections from the Department of Transportation. Cold Patch - A mil~nimum of depth ,of 2 inches of asphalt concrete, whether cold patch or hot asphalt is used, shall. be placed as a temporary surface in any pavement, shoulder,lor sidewalk opening that must be restored to use prior to permanent restoration. Where temporary asphalt is required, the edges shall be cut square and the temporary asphalt placed on a well-stabilized base. It is the permittee's responsibility to,~~aintain any temporary patches in a safe and useable condition. 11. Drainage - There 'shall be no co~,tribution to, nor interference with, drainage along the State Highway, either during the permit work or after, as a result of such work. Drainagg along highway is not to be obstructed. Profile of drive- - ways and the cross-section of thQ finished shoulder shall be such as to follow the drainage cross-section of the highway shoulder. Initial slopes shall be away from pavement Qf highway. Finished driveways which block or otherwise interfere with the Normal flow of drainage shall be removed and replaced by the permittee to the proper grade, or, if permitted in writing, the permittee shall construct the necessary leaching basin to relieve the adverse condition, all to the specifications of the Department of Transportation. 12. No trees within the~I,State right-of-way may be cut or trimmed, either above or below ground without permission in writing from the Department of Transportation. The Regional Landscape Architect will be given 72 hours notice and a joint inspection arranged!, if the work in any way jeopardizes the trees. The permittee agrees, by acceptance of this Permit, to replace any trees damaged without permission of the Department of Transportation. As a general rule, trees will NOT be permitted to~be planted in the grass area between curb and sidewalk. 13. The permittee shalll,keep the roadway free of foreign objects, such as rocks, timbers, and other items that may fall from transporting vehicles, Spillage of material carriedlby, or dropped from the undercarriage of any carrying vehicle resulting f~^om the permittee's hauling operation along or across the public-traveled way shall be removed immediately and such roadway shall thereafter be maintained free of such spillage. 14. All materials must dome from State approved and inspected sources. All con- crete delivered by ransit mix must be shipped in an approved carrier. Asphalt concrete must be wi~hin specification temperatures and the load properly covered with a canvds. 15. No official State Department of Transportation signs may be disturbed without approval from the Permit Unit. If it is necessary to relocate such signs, the Regional Traffic Section must be contacted for the new location. 16. In State Contract areas the permittee must conduct his work in conformity with the schedule of theState's Engineer-in-Charge and contractor, and all work must be done to the'~,Isatisfaction of the State Engineer-in-Charge. 17. The permittee shailifurnish the Department of Transportation with a telephone number of 24-hour availability, where a demand for emergency repairs will be immediately honored; Furthermore, the permittee agrees to assume all responsi- bility for emergency repairs required, whether the need arises as a result of his contractor's work, by storm damage, or by any other means which renders his contractor's work area unsafe in the opinion of this Department or the Police Department. In theievent that it becomes necessary to call out State Highway Maintenance forces iro restore a permit site to a safe condition, the permittee will be back-charged for all manpower and equipment charges involved. 18. General conditions apply to telephone and telegraph installations as well as specific conditions an the setting and resetting of poles. These conditons, and any special conditions which are added to this form, are enfarceahle by the Department at Transportation. A. TIME 1. Work under the permit shall he commenced within thirty 1301 days from the date of permit issuance unless a later starting date is approved by the Regional Traffic Engineer. The suhbase course shall be a minimum of 12 inches thick un~rtL4 otherwise approved. The materiel shall meet the requirements of current Department or Transportation suhbase course item as specified by the flegional Sails Engines""ff b. Under the permit, construction which adversely affects the suhsurfa' idrainage of the pavement structure shall he corrected by the addition of surface or subsurface drains, as required. 2. Pavement and Shoulders I a. Permanent The replaced pavement shall be similar to the existing pavement in camposdion end texture. The selection of the material type and compositon shall be sublect to the approval of the flegional Directs( or his representative, Tha limit of pavement replacement shall he such that the replaced pavement is supported by thoroughly compacted subbase materiel and the pavement is restored to the proper grade, cross~slape and smoothness. When bituminous concrete mixtures are required far the pavemem replacemen6 the layers shall consist of one ar a combination of mixture types contained in Ta61e 4011, Composition of Bituminous Plan; Mixtures in Section 401 of the New Yark State Department of Transportation's Specification, including addenda. The mixture shell he placed at the proper temperaturee, without segregation, and compacted thoroughly. When Portland cement concrete mixtures are requred for pavement replacement, the mixtures shall consist of either Class C or Class F as contained in Table 5013, Concrete Mixtures in Section 501 of the New York State Department of Transportation's Specifications, including addenda. Class F is a high early strength mixture and should he used when early opanmg to traffic is desired ' The concrete mixtures shall he placed without segregation, then consolidated, finished to the proper elevation, and textured, Coring the concrete pavement shall be in actor dance with one of the methods permitted in Section 502 pertaining to curing, Pavement shoulders, curbs, gutters and other incidental features shall he rep~oced in kind unless otherwise approved by the Regional Director or his representative. b. Temporary Pavement that is replaced Temporarily may 6e paved with either a hot bituminous concrete mixture mentioned shove or a cold hituminous patching mixture. When a cold patching mixture is used it shall cpnsist of aggregate and hituminous material proportioned end mixed in a bituminous mixing plant er rotating peddle shaft pugmill. flegardless which patching mixture is used i~ shall 4e laid on a prepared foundation and thoroughly compacted. Since cold hituminous patching mixtures are subject to distortion by traffic, the temporary patch shall 6a maintained to provide a smooth surface until the pavement is permanently replaced. 3. Manholes Manhole frames and covers shall havg sufficient structural adequacy to support the roadway traffic. The type of manhole frame and cover shall he approved by the Regional Director or his representative. The manhole frame shall he set flush with the surlece of the roadway unless otherwise permitted by the flegional Director or his representative. D. MAINTENANCE AND PROTECTION OF TI~AfFIC 1. Traffic is to be mainmined at all times during the progress of this work and adequate signs, barricades and lights shall 6e provided in accordance with the provisions of Suh~chapter H of the N.Y.S. Department of Transportation's Manual of Uniform Traffic Control Devices. A maintenance and protection of traffic plan may he required. No lanes shall be closed without prior approval. 2. Tha applicant shall erect and maintaid suitable barricades around all trenches while work is in progress far the protection of the public, and they shall ha suitably lighted by yellow lights et night. The work shall be carried an in such manner that not mare than 100 feet of trench in earth remains open at end of day's work. 3. No pavement cuts me to he left unhll~d over night, except in emergencies, and in such cases, adequate precautions must ba exercised to protect traffic. Prior approval must he obtained to use steel plating. 4. No construction materials or equipment shall 6e left on the shoulders or pavement after working hours, nor shall any construction equipment or material be placed in any manner or location that will obstruct highways or railroad warning signs. 5. All open trench in the highway right~el~waV shell he barricaded. There shall he conspicuously displayed bright red flags no less than 24" x 24" attached to such barricades and illuminated at night with flashing y¢gow fights. If in the rydgment of the representative of the Commissioner of Transportation, flagmen era necessary, they shall he employed by the permittea and on duty at sll times during the progress of the work so es to direct traffic end maintain yellow flashing lights, etc. 6. Soft shoulder signs of adequate size, not less than 24" square, shall 6e erected and maintained on all hackfill trenches within the shoulder area until the hackfill is thoroughly sealed. These signs shall ba located ~t the beginning of each section of work at intersections and at a distance not greeter than 1000 feet apart. 7. During winter conditions highway shoulders shall he maintained free of obstructions which would interfere with snow removal end ice control. 8. The permittea shall keep the traveled ~vay free of foreign objects such as rocks, timber and other items that may fall from transporting vehicles. Spillage of material carried by or dropped tram the undercarriage of any carrying vehicle resulting tram the permittee's haulin8 operations along ar across any public traveled way shall be removed immediate ly and such traveled way, bath within', and outside of the work limits, shall he kept free of such spillage by the permittea. E. COMPLETION OF WORK 1. All work is to be performed in a man~jer approved by the Resident Engineer of the State Departmem of Transportation. 2, All disturbed areas shall be returned tq their original condition in a manner satisfactory to the Commissioner of Transportation or his representative 3. The permittea shell be required to restore shoulders end ditches and clean up the highway as his work progresses. All driveways shall 6e restored with material in kind end to their original conditions. I 4. All surplus earth end rubbish shall 6a cleaned up end removed from the highway righhof~way upon completion of the work, and the highway left in a neat and orderly condition. 5. As built plans showing final grade of new installation and existing underground facilities encountered shall be provided to N.Y.S.0.0.T. if variation from approved design plans occurred during construction. F. NECESSITATED FUTURE WORK • 1. The applicant agrees, that any present for future injury to or disturbance of the highway, its slopes ar gutters, caused by placing mains and service pipe shell be repaired by the applicant at his own expense and in accordance with the requirements of the State Department of Transportation. 2. If necessity arises in the future 6ecaus~ of the work on the State Highway system andlor its structures, requiring the removal, relocation or replacement of the installation authorized by the permit, said work shall 6e done es directed by the Commissioner ar his representative, end all cost and expense sa incurred shell be the obligation of the said permittea or his successor in interest. II. TELEPHONE . TELEGflAPH INSTALLATIONS A. SETTING OF POLES 1. All poles shat! be set outside the diteA lines se that the proper drainage of the highway will oat 6e interfered with. In case it is impracticable to set poles so as not to interfere with the flow of water in the ditches, the shoulder, ditch and space around the poles shall he paved by the applicant to protect against wash. 2. There shall he no obstruction to private driveways, connecting highways ar roads, paths or sidewalks. 3. In case it is found necessary to trim tretjs within the boundaries of the highway, the least possible amount shell be done, end in all cases the consent of the shutting property owner must he secured before the poled are set and trees trimmed. 4. Poles shall he of sufficient length to provide a clearance of not less than eighteen feet between the wire and the crown of the highway, under the worst condtitians of temperature end loadings They shell 6e set in line and properly plumbed. They shall 6a wall guyed. No guying to trees, unless by special permission of owner. Special precautions shall be taken on curves and where line$ cross from one side of highway to the other. Poles shall he straight, sound, end the fittings shall he of sufficient strength to carry wires under the worst condition of loed~ng (ice, wind, e[cl. 5. Where telegraph and telephone wires crgss high tension power lines, electric light or trolley wires, spacial precaution shell he taken to maintain proper clearance under the worst condition of temperature and loath ng, B. flESETTING POLES 1. If necessity arises in future, because of work on the highway, to relocate, replace or ra~set poles, cables or conduits, said work shall be done at the expanse of the applicant. III. SPECIAL CONDITIONS I A. In addition to the aforementioned conditions, ~~,if it is found necessary 6y this Department to add to ar otherwise modify the same, it is to be understood such changes shall farm a part of the permit and be complied with immediately upon notice.
