REASO S F &BOARD AQRQNt "I"he Zoning Board of Appeals held a public hearing on this application on February 1 2023 at which time written and oral evidence were presented, Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true arid relevant and makes the following findings: I.Town Law§267-b 3 "ha ILIJ. Grant of the variance(s) will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed lot line change squares off lot 18/17.2 and removes the flag area of lot 17.3. Each of the proposed lots has road frontage and the proposed transfer does not amend the Limited Business or Residential zoning districts on these split zoned parcels. Therefore, the proposed lot line change will not result in loss of access or functionality. Combined lot 17.2 and 18 is improved with an existing residence and shop. The proposed transfer does not amend the Limited Business (LB) or Residential 80 (R-80) Zoning Districts. The land area within each zoning district will remain the same before and after the transfer. 2. The LB and R-80 Zoning Districts both require a minimum of 80,000 square feet of lot area per use. Both lots will remain under 80,000 square feet. 3. The proposed transfer eliminates a flag land area and will not result in loss of access or functionality for the lots. Lot 17.3 will retain access from Avenue B and Lot 17.2/18 will retain access from Fox Avenue. 4. The proposed transfer of 0.38 acres from lot 17.3 to 17.2, together with the merging of lot 18, will increase the size of lot 17.2 to 62,895 square feet, bringing an already nonconforming lot in the LB zone closer to the required 80,000 square feet minimum lot area.
