RELIEF REQUESTED: The applicant requests a variance to build a swimming pool in a front yard location where town code requires swimming pools and accessory structures to be located in a rear yard location. ADDITLQNAL INFORMATION:RMAT"ION Site inspection and photographs show that there is vegetative screening along Flint Street. F I 1 I I F FACT/R:L,A$ONW5-L'OR BQ ESD ACTI )N—' The Zoning Board of Appeals held a public hearing on this application on August 3, 2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page 2, August J 7,2023 #7806,,Tisdel SCTM No. 1000-48-2-29 1 Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is an older neighborhood that consists orsingle- family homes on smaller lots. The subject property is a comer lot with heavy evergreen privacy screening along the Flint Street frontage. The swimming pool is a common accessory use in single family neighborhoods. The proposed location of the swimming pool will not affect the character of the neighborhood. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The house location on the Southern side of the property creates a situation where there is not any rear yard. The entire lot is front yard and side yard. The applicant cannot construct a swimming pool without the benefit of variance relief. 3. The variance granted herein is mathematically Substantial, representing 100%relief from the code, However, this is tile most practical location for the applicant to construct a swimming pool in regards to the location of the house. The applicant has agreed to add and maintain additional vegetative landscape plantings to screen the swimming pool from both street views on this comer lot. 4. Town Law §262-b3)Lb�L4 . No evidence has been submitted to suggest that a variance in this residential L J community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel Linder the Zoning Code in effect prior to or at the time Of purchase. 6 1 '267�-b.
