Colin Cowley PROPERTY LOCATION: 220 Navy St. Orient,NY SCTM# 1000-26-1-25 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated 3/28/2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt Iist and is not subject to review under Chapter 268. PROPER CT /DESCRIPTION: The subject property is a non-conforming 12,326.17 square foot parcel located in an R-40 Zoning District. The parcel runs 115.76 feet along Navy Street. The parcel runs 108.40 feet on the West side, 115.68 feet on the South side, and 104.68 feet on the East side. The parcel is improved with a two- story frame dwelling with covered porch and pergola and three sheds (sheds to be removed). All is shown on a survey prepared by Kenneth W Woychuck,L.L.S.dated April 10, 2021. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124; and the Building Inspector's March 10, 2023, Notice of Disapproval based on an application for a permit to demolish an existing dwelling and construct a new single-family dwelling, 1) located less than the code required minimum front yard setback of 35 feet; located at 220 Navy Street,Orient,NY. SCTM No. 1000-26-1-25 RELIEF REQUESTED: The applicant requests a variance to construct a new home with a front yard setback of 22 feet where Town Code requires a minimum front yard setback of 35 feet. ADDITIONAL INFORMATION: The survey shows that the parcel is split with part of the parcel being located in a FEMA X Flood Zone and part of the parcel being located in a FEMA Flood Zone AE Elevation 6. The applicant's representative testified that the current condition of the structure is in an unfortunate state and unsalvageable. Page 2,July 20,2023 #7796,220 Navy Street SCTM No. 1000-26-1-25 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 6,2023 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Towyn.Law 267-b 3 b In . Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is an older single-family neighborhood which was developed prior to zoning. Many homes in this neighborhood are pre-existing non-conforming. Some of the newly renovated homes have the benefit of variance relief. The existing house has a front yard setback of 21.2 feet. The proposed front yard setback is characteristic of this neighborhood. 2. Town Lawn 267-b 3 b 2 * The benefit sought by the applicant can be achieved by some method,feasible for the applicant to pursue,other than an area variance. The applicant is building a new home and therefore could build the home in a code conforming location. However, Orient does not have the benefit of public water and therefore has to meet stringent Suffolk County Department of Health criteria in order to install the water well and on site septic system. Granting of the variance relief helps the applicant have space to design a septic system which conforms to Suffolk County sanitary code. 3. Towyn Law 267-b J b . The variance(s) granted herein is mathematically substantial, representing 37% relief from the code. However, the neighborhood is an older neighborhood and the proposed front yard setback is characteristic of this neighborhood. 4. Town Law 267"-b 3 b ffiNo evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Lawry 267-b 3 b . The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code- was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law.-4267-b. Grant of the requested relief is the minimum action necessary to enable the applicant to enjoy the benefit of a new home while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Dantes,seconded by Member Acampora,and duly carried, to GRANT the variance as applied for, and shown on the Site Plan and Architectural .Plans prepared by Anthony Portillo,Architect, labeled SD-1 thru SD-6, and dated December 1,2022. SUBJECT TO THE FOLLOWING CONDITIONS: 1) Applicant shall install an Innovative Advanced(I/A)wastewater treatment system as approved by the Suffolk County Department of Health Services. 2) As depicted on the Site Plan (SD-1), three sheds shall be removed or moved to a conforming location prior to the issuance of a Certificate of Occupancy.
