Chairman Wilcenski: Good Evening and welcome to the Public Meeting for Monday, April
10, 2023 for the Southold Town Planning Board. This meeting is public. The Planning Board
may add or remove applications from the Agenda upon its discretion, without further notice.
Applications may not be heard in the order they appear on this agenda.
SETTING OF THE NEXT PLANNING- BOARD MEETING.
Chairman Wilcenski: The first order of business is to set Monday, May 15, 2023 at
6:00 p.m. at the Southold Town Hall, Main Road, Southold, as the time and place for
the next regular Planning Board Meeting.

SITE PLAN APPLICATIONS
BOND RELEASE
Chairman Wilcenski: Heritage at Cutchogue aka Harvest Pointe —This Approved
Residential Site Plan is for the development of 124 detached and attached dwellings.
The property is located at 75 Schoolhouse Road, Cutchogue. SCTM#1000-102-1-33.3
James H. Rich III: Mr. Chairman, I offer the following:
WHEREAS, this Approved Residential Site Plan is for the development of 124 detached
and attached dwellings, with three base designs: 48 "Type A" units (1,999 +/- sq. ft.
livable area), 72 "Type B" units (1,599 +/- sq. ft. livable area) and 4 "Type "C" units
(1,999 +/- sq. ft. livable area). In addition, a 6,188 +/-sq. ft. clubhouse with an outdoor
swimming pool, one tennis court, 289 parking spaces, of which 248 are associated with
the individual dwelling units and 41 are associated with the clubhouse, and various
other associated site improvements, on a vacant 45.99-acre parcel in the Hamlet
Density (HD) Zoning District, Cutchogue; and
WHEREAS, on April 10, 2017, the Southold Town Planning Board accepted the
Performance Bond secured by Savings Passbook in the principal amount of
$150,014.00; and
WHEREAS, on April 11, 2017, the Town Board approved the Bond referenced above in
their Resolution No. 2017-340; and
WHEREAS, on October 26, 2018, Henry Alia, agent for the applicant, submitted a
request to reduce the Bond amount from $150,014 to $39,908; and
WHEREAS, on December 3, 2018, the Planning Board, at a public meeting, approved a
reduction in the bond from the amount of$150,014.00 to $75,825.00; and
WHEREAS, on December 3, 2018 the Planning Board accepted a reduction in the
performance guaranty amount from $150,014 to $75,825 for the Heritage at Cutchogue
and recommended that the Town Board accept same; and

WHEREAS, on December 18, 2018, the Southold Town Board accepted the reduction,
as described above, by resolution #2018-1051; and
WHEREAS, on January 14, 2019, the Planning Board reviewed a request to reduce the
performance guaranty further and agreed that it could be reduced by $17,100; and
WHEREAS, on February 11, 2019, that the Planning Board accepted the reduction in
the performance guaranty in the amount of$17,100, and the total amount of the
performance guaranty to be retained will be reduced from $75,825 to $58,725 ($58,730
with interest) for the Heritage at Cutchogue; and
WHEREAS, on March 27, 2023, the Planning Board reviewed the request to release the
remaining performance guarantee bond of$58,730 (with interest); therefore be it
RESOLVED, that the Southold Town Planning Board hereby recommends to the
Southold Town Board the release of the Heritage at Cutchogue (aka Harvest Pointe)
performance guarantee (bond) once the following condition is met:
Condition: Obtain correspondence from the Town Highway Superintendent and
the Office of the Town Engineer that the off-site work as required by the
performance bond are constructed to Town Specifications and the release of the
bond is supported.

DETERMINATIONS
Chairman Wilcenski: Hard Corner Heart of Love Lane—This amended Site Plan is
for the proposed alteration and conversion of an existing ±16,500 gross sq. ft.
commercial office building (with basement) to contain a 56-seat restaurant and two retail
spaces on the first floor and two commercial spaces and an accessory apartment on the
second floor, all on 0.784 acres in the HB Zoning District. The property is located at 245
Love Lane & 50 Pike Street, Mattituck. SCTM#1000-141-4-2, 141-4-3, 141-4-6.1

WHEREAS, this amended Site Plan is for the proposed alteration and conversion of an
existing ±16,500 gross sq. ft. commercial office building (with basement) to contain a
56- seat restaurant and two retail spaces on the first floor, and two commercial spaces
and an accessory apartment on the second floor on 0.78 acres in the HB Zoning
District; and
WHEREAS, on July 13, 2021, the Southold Town Board issued resolution #2021-596
permitting the transfer of 1.6 Sanitary Flow Credits to Hard Corner Properties, LLC to
create one (1) affordable apartment in perpetuity on the property located at 50 Pike
Street aka 425 Love Lane, Mattituck; and
WHEREAS, on August 4, 2021, the Suffolk County Department of Health Services
(SCDHS) issued wastewater permit C-21-0045 @ 1,910gpd for Restaurant, Dry Stores
and Apartment; and
WHEREAS, the Suffolk County Department of Health Services required Suffolk County
Tax Map (SCTM) parcels #1000-141.-4-6.1, 1000-141.-4-2 and 1000-141.-3-30 to be
merged; and
WHEREAS, on August 8, 2021, Covenants and Restrictions Liber: D00013023 Page
399 were filed with the Office of the Suffolk County Clerk regarding the transfer of 1.6
sanitary flow credits and the requirement of one (1) affordable apartment in perpetuity;
and
WHEREAS, on September 7, 2022, a Deed of Merger was recorded with the Office of
the Suffolk County Clerk as required by the Suffolk County Department of Health
Services; and
WHEREAS, on October 26, 2022, Abigail Wickham, Authorized Agent, submitted
information and materials for a Site Plan Application; and
WHEREAS, on November 7, 2022, the Planning Board accepted the application as
complete for review; and
WHEREAS, on November 7, 2022, the Southold Town Planning Board, pursuant to
State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined
that the proposed action is a Type II Action as it falls within the following description for
6 NYCRR, 617.5(c)(2) replacement, rehabilitation or reconstruction of a structure or
facility, in kind, on the same site, including upgrading buildings to meet building, energy,
or fire codes, unless such action meets or exceeds any of the thresholds in section
617.4 of this Part; and
WHEREAS, on November 7, 2022 pursuant to §280-131(H), the Planning Board waived
the requirement for a Public Hearing for this application involving a modification to an
existing structure with no substantial change to the existing footprint, where the

Planning Board determined that such modifications or any change in use will not require
significant changes to existing major site design features [...]; and
WHEREAS, on November 7, 2022, the Southold Town Planning Board found that this
application was eligible for waiver of certain elements of the Site Plan requirements, as
detailed in the work session staff report, for this existing structure with no substantial
change to the footprint. Pursuant to §280-133 C of the Southold Town Code, the
Southold Town Planning Board has the discretion to waive any or all of the
requirements in §280-133 for those applications involving modifications to existing
structures with no substantial change to the existing footprint and where the Planning
Board determines that such modifications or any change in use will not require
significant changes to existing major site design features if such requirements are not
necessary to protect the health, safety or welfare and to further the objectives set forth
in Town Code §280-129; and
WHEREAS, on November 18, 2022, the Planning Board, pursuant to Southold Town
Code §280-131 C., distributed the application for comments; and
WHEREAS, on December 13, 2022, the Southold Town Engineer reviewed the
proposed application and determined revisions were required in order for the site plan
met the minimum requirements of Chapter 236 for Storm Water Management; and
WHEREAS, on March 14, 2023 Timothy Germann (Registered Architect), submitted
revised site plans as required for Chapter 236 and site plan review; and
WHEREAS, on March 27, 2023, Abigail Wickham, authorized agent, submitted revised
plans and additional information as required for review; and

WHEREAS, on March 27, 2023, the Southold Town Planning Board determined at their
work session that with exception of certification from the Southold Town Engineer that
the proposed plan meets requirements pursuant to Chapter 236, a revised photometric
plan pursuant to Chapter 172 and revised site plans showing certain information, all
applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan
Approval of the Town of Southold were met; and
WHEREAS, on March 31, 2023 the Southold Town Engineer reviewed the proposed
application and determined the site plan met the minimum requirements of Chapter 236
for Storm Water Management; and
WHEREAS, on April 6, 2023, the Southold Town Chief Building Inspector reviewed and
certified the proposed uses on the first floor as permitted uses in the Hamlet Business
(HB) Zoning District, and was not able to certify the second floor commercial uses due
to their being unspecified; and
WHEREAS, with exception of the items listed as conditions below, all applicable
requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan Approval of
the Town of Southold were met; be it therefore

RESOLVED, that the Southold Town Planning Board pursuant to §280-133 C hereby
waives certain application requirements as detailed above;

Conditions to be fulfilled prior to endorsement of site plan & prior to building
permits being issued:
A. Provide five (5) prints of a revised site plan that addresses the items listed below,
and includes the stamp, seal and signature of the NYS licensed professional
preparing the plan.
1) Specify the uses proposed within the two commercial spaces on the second
floor.
2) Provide the new merged lot configuration and new Suffolk County Tax Map
identification number for the subject parcel (as required by Suffolk County
Department of Health Services).
B. A revised use certification from the Building Department.

Conditions of approval (ongoing)
1. All aspects of the project shall be constructed and maintained substantially in
accordance with the approved site plan including the architectural drawings.
2. All exterior lighting on the property shall comply with the provisions of Chapter 172 of
the Town Code, and the lighting plan pages of the approved site plan. Any future
exterior light fixtures not shown on the approved site plan must be reviewed for
compliance and approved by the Planning Board prior to installation.
3. All exterior signage on the property, shall comply with Town Code. Any future
signage not shown on the approved site plan must be reviewed for compliance and
approved by the Planning Board prior to installation.
4. All trees and landscaping are required to be maintained by the property owner as
shown on the approved site plan. Should a tree die or otherwise be destroyed, it
must be replaced with the same species and size as shown on the approved site
plan within 6 months. Any change in tree or landscaping species must be approved
in writing by the Planning Board.

plan is for the proposed construction of a 1-story agricultural storage building (40' W x
100' L) with Development Rights held by Southold Town in the AC Zoning District. The
property is located at 4735 Cox Lane, Cutchogue. SCTM#1000-96-2-10.1

WHEREAS, this Agricultural Site Plan is for a proposed 40'W x 1001 (4,000 sq. ft.)
agricultural storage building on a 25.7-acre parcel with Development Rights held by
Southold Town in the AC Zoning District, Cutchogue; and

WHEREAS, on March 20, 2023 Thomas Geppel, applicant, submitted a Site Plan
Application for review; and
WHEREAS, the Southold Town Planning Board, pursuant to §280-133 C of the
Southold Town Code, has the discretion to waive any or all of the requirements in §280-
133 for those applications involving uses strictly related to agriculture as long as they
are not necessary to further the objectives set forth in Town Code §280-129 to maintain
public health, safety, and welfare. The Planning Board has found that this'application is
eligible for a waiver of certain elements of the Site Plan requirements because it is an
agricultural use, the details of which are included in the Staff Report dated March 27,
2023; and
WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code
§280-131 8 (5), has the discretion to vary or waive the parking requirements for Site
Plan Applications where doing so would not have a detrimental effect on the public
health, safety or general welfare, and will not have the effect of nullifying the intent and
provision of the Site Plan Requirements chapter of the Town Code. The Planning Board
has found that this application is eligible for a waiver of parking requirements because
there is no need to provide for parking -the application is for an agricultural use, the

WHEREAS, on March 27, 2023, the Southold Town Planning Board formally accepted

WHEREAS, on March 27, 2023, the Southold Town Planning Board, pursuant to State
Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that
the proposed action is a Type II Action as it falls within the following description for 6
NYCRR, Part 617.5(c)(4),which states that the following actions are not subject to
review under this Part: "agricultural farm management practices, including construction,
maintenance and repair of farm buildings and structures, and land use changes
consistent with generally accepted principles of farming"; and
WHEREAS, on March 30, 2023, the Planning Board, pursuant to Southold Town Code
§280-131(C), distributed the application to the required agencies for their comments;
and
WHEREAS, on April 4, 2023, the Southold Town Land Preservation Committee
determined the recorded easement for the property allows land within the Easement to
be used for agricultural production as defined in Chapter 70 of the Southold Town Code,
and found that the proposed storage building to store hay and farm equipment is
consistent with the purposes and other terms and conditions of the recorded Easement;
and
WHEREAS, on April 5, 2023, the Southold Town Fire Marshall stated there were no
objections to the proposed site plan; and

Approval of the Town of Southold, have been met; therefore be it

WHEREAS, this agricultural site plan is for a proposed 30'W x 401 (1,200 sq. ft.)
agricultural storage building on a 2.79 acre parcel in the AC Zoning District, Cutchogue;
and
WHEREAS, on March 16, 2023 Steven Zuhoski, applicant, submitted a Site Plan
Application for review; and
WHEREAS, the Southold Town Planning Board, pursuant to §280-133 C of the
Southold Town Code, has the discretion to waive any or all of the requirements in §280-
133 for those applications involving uses strictly related to agriculture as long as they
are not necessary to further the objectives set forth in Town Code §280-129 to maintain
public health, safety, and welfare. The Planning Board has found that this application is

Chairman Wilcenski: NFBG Subdivision —This standard subdivision proposes to
subdivide 28.9 acres into 3 lots where Lot 1 is 5 acres and includes a 2-acre
development area and 3 acres of open space, Lot 2 is 19.63 acres upon which
development rights have been sold, and Lot 3 is 4.17 acres and includes a 1.64-acre
development area and 2.55 acres of open space in the AC Zoning District. The property
is located at 2458, 2462 Elijah's Lane, Cutchogue. SCTM#1000-108-8-6.3, 6.4 & 6.5

WHEREAS, this Standard Subdivision proposes to subdivide a 3.65-acre parcel into 2
lots. Lot 1 equals 2.73 acres and lot 2 equals .92 acres in the Limited Business and
Residential Office zoning districts; and
WHEREAS, on September 13, 2022, the Southold Town Planning Board hereby grants
Conditional Preliminary Plat Approval upon the map entitled "Standard Subdivision of
Peconic Onwego" prepared by Kenneth M. Woychuck Land Surveying dated February
16, 2020 and last revised June 6, 2022, with conditions; and
WHEREAS, on March 13, 2023, the approval expired; and
WHEREAS, on March 22, 2023 the applicant's agent requested an extension by email;
therefore, be it
RESOLVED, that the Southold Town Planning Board hereby retroactively extends
Conditional Preliminary Plat Approval from March 13, 2023 to September 11, 2023.

Chairman Wilcenski: Jenkins Conservation Subdivision — This proposal is for a
Conservation Subdivision of a 17.89-acre parcel into two lots, where Lot 1 is 1.84 acres
and contains an existing house and accessory buildings, and Lot 2 is 16.05 acres and
contains a Town drainage easement of 0.28 acres and 15.77 acres of agricultural land.
The Town purchased development rights on 15.77 acres of Lot 2 in 2001, and
ownership of this property has not changed since that time. The property is located at
2800 Depot Lane, Cutchogue, in the AC Zoning District. SCTM#1000-102-2-2.6

WHEREAS, this proposal is for a Conservation Subdivision of a 17.89-acre parcel into
two lots, where Lot 1 is 1.84 acres and contains an existing house and accessory
buildings, and Lot 2 is 16.05 acres and contains a Town drainage easement of 0.28
acres. The Town purchased development rights on 15.77 acres of Lot 2 in 2001, and
ownership of this property has not changed since that time; and
WHEREAS, on February 8, 2022, the Planning Board granted Conditional Final Plat
Approval; and
WHEREAS, on February 23, 2023, this Conditional Final Plat Approval expired; and
WHEREAS, the applicant's agent has requested more time in an April 5, 2023 email;
therefore be it
RESOLVED, that the Southold Town Planning Board grants a six-month extension of
the Conditional Final Plat Approval upon the map entitled "Conservation Subdivision
Final Plat for Jenkins at Cutchogue" from February 23, 2023 to August 23, 2023.
