The purpose of the inspection was to survey the house with respect to the plans and to report thereon. The inspection and evaluation of the reported defects was conducted by the firm of Richard L. Heimer, P.E , P.C. with offices in New York City, Brook- lyn, Huntington Station, Great Neck, Staten Island, Monsey, and White Plains, New York. Richard L. During the past three decades the firm, its president and engineering staff, have inspected and evaluated over 30,000 buildings for prospective purchasers, owners, attorneys and other interested parties. The President, Richard L. Heimer, is a Licensed Professional Engineer in New York (License #43882), as well as in New Jersey (License #GE 21629) He is a graduate engineer with a Bachelor of Science degree from the Mas- sachusetts Institute of Technology (1956). He also is a graduate of Polytech- nic Institute of New York where he received his Master of Science degree. He has 33 years experience as an engineer, estimator and inspector for con- struction projects ranging from single family residences to high-rise apart- ment buildings to industrial and commercial buildings. Richard L. Heimer has lectured for the State University of New York at Stony Brook, the C.W. Post Center of Long Island University, Hunter Col- lege, and the New York State Society of Professional Engineers. His ex- perience and background have enabled him to qualify as an expert witness in hundreds of civil trials in state civil, state supreme and federal courts. Nu- merous articles about his work have appeared in local newspapers. He has also been interviewed on radio and television providing commentary and opinion and is a Licensed Certified Asbestos Investigator in New York City. Richard L. Heimer is a member of the American Society of Civil Engineers, The New York State Society of Professional Engineers, The Institute of Elec- trical and Electronics Engineers, and the National Society of Professional Engineers. He is also a charter member of the National Radon Association. HISTORY Upon arrival at the home we were met by Mr. Crenshaw who stated that al- though he was living in the home, he did not actually own it He stated that it had not yet received a Certificate of Occupancy from the town. lie further stated that it was not built in accordance with the plans and also reported structural defects. He stated that he moved into the house in May of 1989 and that since that time the builder has not made any repairs. We also examine the house in respect to the plans and our specific findings were as follows: 1. The bathroom is not constructed per the plans. The bat}itub is twisted at 90 degrees from the position in the plan and the bathroom has dif- ferent dimensions and a different aspect ratio than indicated. 2. The closet in the first floor bedroom is half the size as the one shown in the plan. This is because of the altered arrangement in the bath- room. Mr. Crenshaw stated that he did not institute these changes and was extremely upset when he found they had occurred 3. There is a structural beam on the ceiling of the kitchen which is not shown on the plan This is major defect in our opinion. It shows that the builder constructed the house negligently using cheaper and fore- shortened lumber. It shows that the house has been structurally modi- fied to its detriment. 4. Similarly there is a boxed-in beam in the bathroom which looks en- tirely out of place. It is not shown in the plan and is present, in our opinion, because the builder must have decided to use less expensive materials than would be required in the plan. It also structurally modifies the building. 5. The back of the house is leaning outwardly by approximately 1/2 inch. The front roof is sagging slightly as is the rear roof. This, in our opinion, is due to the revised construction of the house. In our opin- ion, proper procedures were not utilized to compensate for the natu- ral tendency of this home to lean towards the rear. The changes de- veloping from the revised beams allowed movement. Flad the house been constructed in a proper manner as shown on the plans and, the settlement would not have occurred. RICHARD L. HEIMER, P.E P.C Page 3 of S Crenshaw 3/9/90 108228 As a consequence of this settlement, there are cracks throughout the house and most of the doors do not close properly. In our opinion, this is not the result of normal settlement but settlement specifically due to improper construction vis a vis the revised building plans and the fundamental construction. CONCLUSIONS In order to repair the damage, in our opinion, it would be necessary to en- tirely rebuild the first floor bathroom, the closet next to the bathroom and the structural members above the bathroom and the kitchen. Such recon- struction is estimated at between $20,000 and $30,000. We are uncertain of this figure since there is no way to know the exact dimensions of the changes independently and negligently brought about by the builders revisions with- out entirely removing the sheetrock ceiling of the first floor. This house will have to be vacated during the construction. Repair of the bowing and the settlement will require major strengthening of the structural members including, but not limited to, re-construction as per the plan and additional bolted collar beams. We estimate the cost of con- struction of the structural repairs at $2750. The above cost estimates were rendered during a normal business day on Friday, March 9th, 1990. These results will be kept in our files as part of our normal business records.
