The Southold Town Planning Board, as lead agency, has determined that the proposed action described below will not have a significant effect on the environment and a Draft Environmental Impact Statement will not be prepared. Name of Action: Bay to Sound Project Phase 5 SCTM# 100-45-5-4 SCTM#: Multiple Location: Between Pipes Cove and Long Island Sound in Greenport NY SEQR Status: Type I ( ) Unlisted (X) Conditioned Negative Declaration: Yes ( ) No (X) Description of Action: Expand Bay to Sound Trails at Pipes Cove Preserve, Arshamomaque County Park and Clay Pit County Park. Cleanup of trash and historic dumping areas throughout the Bay to Sound project area in Greenport. Habitat restoration at Pipes Cove Preserve, Arshamomaque Preserve and Skipper Horton Park. The following tasks will be accomplished: 1. Footbridges will be constructed over Moores Drain (140 sq feet) and Pipes Neck Creek(240 sq feet). Three-feet wide boardwalks with open decking on pilings will be constructed within fresh water wetland SO-2 (489 sq feet), tidal high marsh (1671 sq feet), FC marsh (1245 sq ft), gtc . �?. f Ju 1tc?t ne .2.x.22. three-feet wide boardwalks with open decking will be constructed within fresh water wetland SO-3 (39 sq ft) The NYS DEC issued Wetland Permit# 1-4738-04540/00001. Reasons Supporting This Determination: A Short Environmental Assessment Form has been submitted and reviewed and it was determined that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. The determination was based upon the following: This proposed action will not have adverse impacts on the land area, waters or adjacent properties. Thus the following can be said of this action: 1. The proposed application will have no bearing upon Article VI of the Suffolk County Sanitary Code and is not expected to adversely affect groundwater quality. The removal of degrading/decaying buildings will remove potential pollutants from the land area. 2. No substantial adverse change in existing air quality, ground or surface water quality or quantity, traffic or noise levels, no substantial increase in solid waste production, potential of erosion, flooding, leaching or drainage problems will occur as a result of this action. Storm water will be controlled on site pursuant to Chapter 236 Stormwater Management of the Southold Town Code and potentially a NYSDEC SPEDS Permit depending upon total area of disturbance. The Southold Town Trustees conditioned that no CCA treated lumber is to be used in the construction to further protect water quality. 3. The area is currently impacted with dilapidated buildings and debris and will be restored with vegetation. No significant removal or destruction of large quantities of vegetation or fauna, no substantial interference with the movement of any resident or migratory fish or wildlife species is expected. 4. The action is located within the NYSDEC Critical Environmental Area - Pipes Cove Creek and Peconic Bay and Environs. No significant adverse impacts on these habitat areas will occur as a result of this action. 5. NYSDEC data indicates that the protected species Least Tern may occur on site. This species is not expected to be significantly affected through the action. No substantial adverse impacts on threatened or endangered animal or plant species or the habitat is expected to occur. 6. The proposed action is not in material conflict with a community's current plans or goals as officially approved or adopted. 7. The parcel is SPLIA listed due to the past structures on site; however, it is noted in the NYS CRIS system as not eligible for listing. The buildings are dilapidated and beyond repair. The removal of the buildings and debris will restore the area to open space. The proposed action will not significantly impair the character or quality of important historical, archaeological, architectural, or aesthetic resources or of existing community or neighborhood character. 8. No major adverse change in the use of either the quantity or type of energy will occur. N mq�tye,Declaratim FIA&q 9. No creation of a hazard to human health will occur as a result of this action. Debris from demolition will be carted off-site by an approved subcontractor and disposed of at a NYSDEC permitted waste management facility. 10. The proposed action will not cause a substantial adverse change in the use, or intensity of use, of land including agricultural, open space or recreational resources, or in its capacity to support existing uses. Based upon such, no significant adverse impacts to the environment are expected to occur should the project be implemented as planned.
