The property is located at 54280 Main Road, Southold. The proposed action has been reviewed by New York State Department of Environmental Conservation regulation 6NYCCRR Part 617 State Environmental Quality Review, and it is my determination that pursuant to Part 617.5c(34), the action proposed is a Type II action and, therefore not subject to SEQRA review. 617.5(c)(34) "engaging in review of any part of an application to determine compliance with technical requirements,provided that no such determination entitles or permits the project sponsor to commence the action unless and until all requirements of this Part have been fulfilled;" If the purchase of the sanitary flow credits is successful, a Special Exception review by the Southold Town Zoning Boards of Appeals is required.
