Townsend, Jr., Councilwoman Ruth D. Oliva, Justice Louisa P. Evans, Councilman William D. Moore, Town Clerk Judith T. Terry, Town Attorney Laury L. Dowd. 9:10 A.M. - Solid Waste Management Task Force members Hank Pope, Jack Romeril, and William Cremmers met with the Town Board to discuss the proposals of Dvirka and Bartilucci, and Barton and Loguidice for engineering services for preparation of a municipal solid waste transfer station plans and specifications, permitting and construction inspection services. The Task Force, headed by Councilwoman Hussie, recommended that the board go with Dvirka and Bartilucci. Supervisor Cochran and Councilwoman Hussie will meet with D&B after the first of the year, and work out the method of funding the project. 9:40 A.M. Councilwoman Oliva reported to the Board on the progress of the Goldsmith Inlet/Kenney's Beach Work Group. She said the next step is to begin the SEQRA process, and she will arrange a meeting with Senator Kenneth LaValle and Assemblywoman Patricia Acampora to request funding to support the studies that will be required for an erosion plan. Finally, Councilwoman Oliva asked that a member of the Conservation Advisory Council be appointed to the Working Group, A resolution (17) was placed on the agenda to accomplish this.----CouncilwomanOliva also discussed the proposed Cablevision Franchise renewal. She advised the Board that there are certain items in the proposal that are common to the five east end towns, but since the towns have not met in recent months, she would like to hold the proPOsal until a meeting of the towns can be convened.----The Board reviewed the requests of Loaves & Fishes Food Pantry, and CAST for 1996 Grant Program funding,~and placed a resolution (18) on the agenda to allocate funds to those groups.----Supervisor Cochran distributed to the Board an updated listing of those properties in Southold Town that have had the development rights acquired by the Town and County.----The Board reviewed a proposal drafted by the Town Attorney to amend the policy with regard to trailer permits, and placed a resolution (19) on the agenda to adopt same.----A proposal from Karen B. Meredith to set off and purchase approximately 15 acres of the Dickerson family property on Youngs Avenue, which is under the acquisition of development rights program, was discussed. The Board agreed to ask the Agricultural Advisory Committee for their opinion of such a proposal. This will be discussed again at the January 21st meeting.----A resolution (20) was placed on the agenda to reduce the price of the Town's Yellow Garbage Bags, effective January 1, 1997.----A proposed !'Local Law in Relation to Appearance Tickets" was discussed and referred to the Code Committee and Chief of Police Conway for comment.----A letter was received from the NYS Coastal Management Program Supervisor of Consistency Review with regard to the permit application of Mariculture Technologies, Inc. Town Attorney Dowd and Councilwoman Oliva will prepare comments.----Town Board short-listed the candidates for Custodial Worker I, and set December 30th to reinterview.----The Board reviewed the Grants Program procedures for 1997, and agreed to add "environmental" to the categories. Also, Supervisor Cochran will prepare a press release to notify applicants that the applications are available for 1997, and must be returned by March 1st.----Request from the Anti-Bias Task Force for the Town to purchase a table for ten ($250.00) for The Reverend Dr. Martin Luther King, Jr. Memorial Breakfast, sponsored by The First Baptist Church of Riverhead, at Islandia. The Town Board agreed they would ratl~er spend the $250.00 for a specific Anli-Bias Task Force project, which they will surely have during 1997. Further, there will be Martin Luther King events in the Town of Southold for them to attend.----The Board set December 30th to interview applicants for part-time Account Clerk.---- They reviewed two proposals for a "Local Law in Relation to -Modifications of Shellfishing Restrictions" with regard to the taking of oysters. Before moving on this the Town Trustees will be invited to the January 7th work session to discuss their feelings with regard to the proposed law. EXECUTIVE SESSION 11:25 A.M. - On motion of Councilwoman Hussie, seconded by Councilman Moore, it was Resolved, that the Town Board enter into ExecutiVe Session for a meeting with Special Counsel Jonathan L. Rosner to discuss the Stipulation & Order of Settlement in the 'matter of the Village of Greenport v. Town of Southold. Vote of the Board: Ayes: Supervisor Cochran, Councilwoman Hussie, Councilman Townsend, Councilwoman Oliva, Justice Evans, Councilman Moore. Also present: Town Clerk Terry, Town Attorney Dowdo 11:45 A.M. The Town Board reviewed the resolutions to be voted on at the 4:30 P.M. Regular Meeting. :55 A.M. Work Session recessed for the Town Board to meet Greenport Village Board at the Greenport Village Hall in Greenport, EXECUTIVE SESSION with the 4:00 P.M. On motion of Justice Evans, seconded by Councilwoman Oliva, it was Resolved that the Town Board enter into Executive Session to discuss CSEA contract negotiations and employment history. Sawickl, Safety Officer Plum Island Disease Center with appreciation to Jim Bunchuck for providing assistance to the Plum Island Animal Disease Center. IV. PUBLIC HEARINGS None. V. RESOLUTIONS. SUPERVISOR COCHRAN: As you know the Town Board has a policy, that if there are any resolutions you would speak to, it is done at this time. If you would like to discuss something with the Town Board on Town Board business at the end of the meeting you are more than welcome. We will go into resolutions at this time. Councilman Moore, Justice Evans, Townsend, Councilwoman Hussle, DEC:KMBER 23, 1996 275 14.-Moved by Justice Evans, seconded by Councilwoman Hussie, WHEREAS, the State of New York provides financial aid for resource recovery equipment, source separation equipment, or both, for the implementation of small scale, Iow-technology approaches to resource recovery; and WHEREAS, the Town of Southold, hereby called the MUNICIPALITY, has examined and duly considered the applicable laws of the State of New York, and the MUNICIPALITY deems it to be in the public interest and benefit to file an application under these laws; and WHEREAS, it is necessary that a Contract by and between THE PEOPLE OF THE STATE OF NEW YORK, herein called the STATE, and the MUNICIPALITY be executed for such STATE Aid: NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Southold: 1. That the filing of an application in the form required by the State of New York in conformity with the applicable laws of the State of New York including all understanding and assurances contained in said application is hereby authorized. 2. That Supervisor Jean W. Cochran is directed and authorized as the official representative of the MUNICIPALITY to act in connection with the application and to provide such additional information as may be required and to sign the resulting contract if said application is approved by tile STATE. 3. That the MUNICIPALITY agrees that it will fund its portion of the cost of said Solid Waste Management Project. 4. That the MUNICIPALITY or MUNICIPALITIES set forth their respective respon'sibilities by attached joint resolution relative to a joint Solid Waste Recovery and Management Project. 5. That five (5) Certified copies of this Resolution be prepared and sent to the NEW YORK STATE DEPARTMENT OF ENVIRONMENTAL CONSERVATION, ALBANY, NEW YORK 12233-q015, together with a complete application. Abstain: Councilwoman Oliva, Supervisor Cochran. This resolution was duly ADOPTED. SUPERVISOR COCHRAN: Ruth and I are reclusing ourselves from this particular allotment to CAST, because she and I both serve on the Board of Directors, so will recluse ourselves from this vote. 19.-Moved by Councilman Townsend, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby adopts the following amended Policy Regarding Trailer Permits, effective immediately: WHEREAS, Section 100-239.2 of the Southold Town Code authorizes the Town Board to issue permits for an automobile trailer or house car; and WHEREAS, the proliferation of these trailers is not encouraged, and is the policy of the Town Board to issue such permits only upon an adequate showing of necessity and hardship, subject to such conditions relating to permit term and use as the Board shall deem appropriate; now, therefore, be it RESOLVED that the Town Board hereby determines that the following are appropriate reasons for issuance of a trailer permit: 1-. DECEMBER 23, 1996 COUNCILMAN TOWNSEND: I intend to vote no, as you will find out on this, because while it was part of our Budget discussions my feeling was the assumptions that we made in those discussions were incorrect, and I feel that it is not..we are running a deficit, and by reducing the cost of bags you are going to aggravate that. I don't feel that we have taken into consideration overhead. We had this discussion before. The Solid Waste Advisory Committee in the past has recommended that we do not reduce the price of bags, that it will impair our recyCling effort. So, for those reasons I plan to vote against it. Not that I don't want to give people a Christmas present, because I certainly would like to do that, but I think that we are going to just add more to the tax base, and people have very little control over the tax rate, where they do have control of how much garbage they dispose of. That's my opinion. COUNCILWOMAN OLIVA: I would just like to say, as a member of the Task Force that voted against lowering the bag price, I will vote against it also, because I have been very interested in recycling. I do feel that people will not recycle as much as they could, because if it's cheaper just to stuff it all in the yellow bags, they are going to do that. I realize the prices of recycling go up and down, but last year we did make a lot of money, this year we are not, but who knows for next year. I do feel, too, that the overhead was not taken into account with the price of the garbage bags. There is the cost of labor. There is the cost of machinery, and so forth, and so on. So, I will vote, no, on this, too. SUPERVISOR COCHRAN: Bill? COUNCILMAN MOORE: You have heard my comments over and over again. The yellow bags were to pay for the cost of the removal of the garbage..It has nothing-to do with recycling whatsoever. I mean we can encourage that anyway we want, but you don't make a punitive cost for bags, because if you want to maximize your recycling you make the bags $10.00 a piece, and you would be certain to increase your recycling right there, but that's not the point of charging on a user fee basis. SUPERVISOR COCHRAN: I would ike to add that I do not feel it will affect the recycling. We have a community that supports recycling. I don't think the price of the yellow bags will tie into that. Number two, the Budget also called for increasing construction debris. It's costing us $117.00 a ton to take it out of town, and we were only charging $70.00 most of the year, and then I had proposed to the Board that they had forgotten they were go{ng to move it up to $90.00, so it was moved up to $90.00, so we're still moving C&D at a loss. It's my feeling that you try as much as possible when it's user fees to charge what the cost is. So, C~,D has been moved up to $120.00 a ton. Big deal, $3.00 profit, but at least it's paying for itself, and I don't believe the people that use the yellow bags wilt be supplementing construction debris, which they are doing. I can't quite reconcile in my mind that you would vote for the yellow bags through the budget, and now not vote for the yellow bags. I have difficulty with that, but everyone's entitled to their opinion. There is no TV. COUNCILMAN TOWNSEND: I wasn't going to vote because of one little issue in the budget, and haven't in the past. 20. - Vote of the Town Board: Ayes: Councilman Councilwoman Hussie, Supervisor Cochran. I am a resident of Southold, and also, a former member of the Ad Hoc Animal Rescue Team. I say former member, because we, the Ad Hoc Animal Rescue Committee, had been OECEMBER 23, .96 ' 279 struggling over a year with the North Fork Animal Welfare League. We presented our slate of Directors to be nominated at their annual election, which was on Saturday, December 21st of this year, an"d we won uncontested. At this time I wish to thank the Town Board for their help, and understanding all through this dilemma, the Traveler-Watchman, the Suffolk Times, for taking the interest and time to keep the public informed. Last but not least, I wish to thank you, the people, whoever you are, who have stood with us in our trouble to help make a change at the Southold Shelter. We couldn't have done it without you. Several of weeks ago I was here talking about the grant for $100,000 for the bridge over Brushes Creek, and at that time I seemed to feel some agreement with what I was saying, that there should be at least someone looking into the procedures prior to spending that amount of money, as compared to some of the other small amounts of money you vote on here, and I was wondering after I left I realized I didn't get any feedback from anyone from the Board, that yes, we are going to look into this, or give it some consideration. I just wanted to check that. SUPERVISOR COCHRAN: In relation to keeping an eye on the bridge? HANK KUHN: In relatibn to spending any substantial amount of money. COUNCILWOMAN HUSSIE: I think this experience has pointed out, that we have to give every contract very careful scrutiny. We haven't done anything to date. We have been sort of the end of the year rush and catch up. HANK KUHN: I can understand that, but I'm asking, are you going to? COUNCILMAN MOORE: In the manner for which the community is to be informed when things are happening, where permits are necessary, and that kind of stuff, it's struck a chord with several of us. As Alice said, it hasn't gotten good form to how we're going to get it to the next step. There was some acknowledgement of the legitimize of the observation. SUPERVISOR COCHRAN: And they have, I believe, put another inch and a half of a~phalt on it, and it doesn't seem to be settling anymore than it was. As I say, they are keeping an eye on it, HANK KUHN: I noticed in the paper you had indicated that the issue was completed, at least you reported as such. SUPERVISOR COCHRAN: I don't think so. It's ongoing. It's 'not completed. We're keeping an eye on it. We are supposed to be getting reports every couple of weeks from the Town Engineer. It's ongoing. HANK KUHN: Thank you. We thought you would have some refreshments here for the green team. If I had known that I would have brought you in something from McDonalds. Joe, they got chili now. Try some of their chili. COUNCILMAN TOWNSEND: I think they should have something named after you, Carlin Raspberry something or other, ice cream or something. FRANK CARLIN: There's a company upstate that is named after me, Carlin Heater Control. In fact he sent me a hat that I wear around town, so I've got a company named after me. Okay. SUPERVISOR COCHRAN: You don't have anything to share with us? FRANK CARLIN: That's it. It's the holidays you know. SUPERVISOR COCHRAN: Is there anyone else that would like to address the Town Board. (No response.) If not, I will call for Town Board reports starting with Louisa on my right. JUSTICE EVANS: Merry Christmas to everybody, and Happy Holidays. COUNCILWOMAN HUSSIE: Same. I want to repeat that. Merry Christmas. COUNCILMAN TOWNSEND: The entire Town Board, or most of the Town Board undertook interviews of the custodial position that was advertised, and it was interesting. I think we discussed this last time, that there were close to 100 applications. COUNCILWOMAN HUSSlE: This is a fish story, eight-six. COUNCILMAN TOWNSEND: It was closer to 100 than 50. I thought we had closer, and we eliminated. Eighty-seven, sorry. Close to 90 applications, and it was very interesting to see who was out there. We all broke them up into fifteen, and the quality of people that are looking for this kind of work. JUSTICE EVANS: It was depressing. COUNCILMAN TOWNSEND: It was depressing, but it also was illuminating, because it shows you what kind of jobs people are willing to give up to get a Town job. People that are making $10,000 more a year are willing to give up that amount to get the security, and the benefits, and the other advantages of a Town job. It shows you what the town does. SUPERVISOR COCHRAN: There were some retired that looked to supplementing their income. There were some young people, who can use probably additional income, and the benefits, and the security. COUNCILWOMAN OLIVA: There were those that had been let go from Grumman, and really needed the job. SUPERVISOR COCHRAN: The Town Board was kind enough to do these interviews, they divided them amongst themselves. It's my feeling, and how I analyzed it, was that I felt that it's an economic thing, also, because it was telling us that this is where there is need, that we need jobs in this middle income area, that gives security and benefits, and I just wondered if through your interviews if you found that this was the case more than anything else, that middle level jobs. COUNCILMAN TOWNSEND: In the private sector there is a lot of the benefits that you used to get that are no longer available. It's too costly to give someone insurance benefits. A lot of that stuff is just thrown ~gt, I think. COUNCILWOMAN OLIVA: Merry Christmas, and Happy New Year. DECEMBER 23, 1996 SUPERVISOR COCHRAN: I would just like to report a couple of things. I just would like to-briefly mention some of the things that I have had on my plate for the last two weeks. Southotd Town did host the Ten Town Supervisors. It will probably be about a year and a half before it's our turn again, so they were very pleased, and I'd like to thank Pindar. They were kind enough to send down a little refreshment for each of the Supervisors, so we wish them well, and they said we spoiled it for the other nine towns, but I promote the wine industry any time I can. Also, we t~ad the ground breaking for our tennis courts. You may have seen the picture. Alice brought her racket with her. She was going to play tennis in the hole or not, but anyhow it was good, and at the same time the kids came down with Moms, and kind of dedicated the little playground up there. We have 27 cartons of play equipment that has to be assembled, and put up when the weather is good. Also, I traveled up to Albany one day. I'm serving on a committee for the Association of Towns and Villages, and it is kind of nice to have someone from downstate serving on some of the upstate committees, and hopefully we'll have more input as time goes on. Also, I attended the hearing on the Maritime Committee, of which I serve for the State. it was held in Riverhead the other night, and they did have a small turnout, but it was a good turnout. People were constructive. It wasn't tearing something apart, it was adding to, and making it better, which is always a positive way to work; Also, I had the opportunity to swear in the new Seniors, the officers for the Mattituck Senior Club, and they are off to another year of serving their fellow seniors in the community. I also met with Commissioner Frank, SuffOlk County Parks, Recreation and Conservation. He came out .h.e other day, and' we met with Chris Smith from Cornell, and Richard ilar¥ from :Sc:ope, who runs the camp here in town, and we discussed some of tl~ feasibility or the possibility of what can happen with some of the County parks out here. Ruth serves on the Recreation Committee with me, and she knows that we have been looking at, and several members of our committee did an evaluation of the County properties, because they are agreeable to working with us in anyway that these parks would benefit Southold Town in so many way. So, 'we'll be looking at that as a committee also. I think that's about it. I would just like to share with the Board on the one resolution in relation to the Recreation lady resigning, the Secretary at the Rec Department. I would just like to share with you, that I think what we're going to do is move Diane from the Trustees, because Al feels that they don't neea two full time Trustees right now, one and a half, so I'm going to move Diane to the Rec Department, she used to work there, until we can get someone on line to replace the part-timer we had. So, that office will be covered until we go through the process, because by the time we advertise, and so on, and so forth, and get interviews it might be a little bit, so at least that will be covered.
