(631) 765-1809 MINUTES SPECIAL MEETING THURSDAY, OCTOBER 19, 2023 A special meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was held at the Southold Town Hall Annex, Second Floor Conference Room, 54375 Main Rd at Youngs Avenue, Southold on Thursday, October 19, 2023 commencing at 4:00 P. M. The public had access to view and listen to the meeting as it was happening via Zoom. However, this meeting was not a public hearing and no testimony was solicited or received. Present were: Leslie Kanes Weisman, Chairperson Elizabeth Sakarellos, Sr. Office Assistant Nicholas Planamento,Vice Chair Donna Westermann, Office Assistant Eric Dantes, Member Julie McGivney,Asst. Town Attorney Patricia Acampora, Member Robert Lehnert, Member 4:03 P. M. Chairperson Weisman opened the meeting in order to call for Executive Session. Vote of the Board: Ayes: Member Weisman(Chaimerson) Dantes Planamento Acampora and Lehnert. This resolution was duly adopted (5-0). EXECUTIVE SESSION: 4:03 P. M. Motion was offered by Chairperson Weisman, seconded by Member Dantes to enter into Executive Session in order to receive Attorney Advice. Vote of the Board: Ayes: Members Weisman(Chairperson), Dantes, Planamento,Acampora and Lehnert. This Resolution was du1X adopted(5-0). Zoning Board of Appeals October 19, 2023 Minutes Page 2 5:00 P. M. motion was offered by Chairperson Weisman, and seconded by Member Dantes to exit Executive Session. Vote of the Board: Ayes: Members Weisman (Chairperson), Dantes, Planamento,Acampora and Lehner. This Resolution was duly dopted(5-0). WORK SESSION: Began at 5:01 P.M. A. Requests from the Board Members for future agenda items. B. The Board discussed extension and de minimus approval requests. C. The Board discussed to reopening the public hearing of North Fork Project 2 & 3.Appeal #7836 POSSIBLE RESOLUTION TO REOPEN THE FOLLOWING HEARINGS: NORTH FORK PROJECT 2, LLC. & NORTH FORK PROJECT 3, LLC. #7836 — Request for Variances from Article III, Section 280-14 and Article III, Section 280-15; and the Building Inspector's June 20, 2023 Notice of Disapproval based on an application to create a two lot subdivision; at 1)proposed Lot 1 is less the code required minimum lot size of 80,000 square feet; 2) proposed Lot 1 is less than the required lot depth of 250 feet; 3) a Greenhouse located on proposed Lot 2 is less than the minimum required side yard setback of 20 feet; located at 10020 Sound Avenue and 9650 Sound Avenue, Mattituck, NY. SCTM No. 1000-122-2-8.1 and 1000- 122-2-24.4. For the sole purpose of accepting an amended survey of the proposed subdivision showing the proposed lot lines for parcel 1 and parcel 2,the acreage of each proposed parcel, all as built (existing) structures on both parcels and eliminating proposed future structures or uses. SCTM No. 1000-122-2-8.1 and 1000-122-2-24.4. RESOLUTION: A Motion was offered by Chairperson Weisman, seconded by Member Lehnert to REOPEN the Hearing and accepting amended survey. Vote of the Board: Ayes: All. This Resolution was duly adopted 5-0). POSSIBLE RESOLUTION TO ADJOURN/CLOSE THE FOLLOWING HEARINGS: VERONICA GONZALEZ #7767 — (Adjourned from July 6, 2023) Request for a Variance from Article III, Section 280-15; and the Building Inspector's January 20, 2023 Notice of Disapproval based on an application for a permit to construct an accessory in-ground swimming pool;'at 1) located in other than the code permitted rear yard; located at: 285 Oyster Ponds Lane, Orient,NY. SCTM No. 25-1-7. For the-sole purpose to CLOSE hearing based upon the receipt from the Building Department of documents curing code violations on the subject property. SCTM No. 25-1-7. RESOLUTION: A Motion was offered by Chairperson Weisman, seconded by Member Dantes to CLOSE the Zoning Board of Appeals October 19, 2023 Minutes Page 3 Hearing and Reserve Decision. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). DELIBERATIONS/POSSIBLE DECISIONS/RESOLUTIONS: Agenda items and commenced deliberations on the following applications. The original determinations of each of the following applications as decided are filed with the Southold Town Clerk: GRANT RELIEF AS APPLIED: Joseph C. GRANT RELIEF AS APPLIED WITH CONDITIONS: QJSG Properties, LLC #7827 Patrick McElroy #7830 Chris and Marisa Lazos #7809 Robert S. Martin #7833 Kathleen Walas and Thomas Sarakatsannis #7835 GRANT RELIEF AS APPLIED WITH CONDITIONS: Michael and Nicholas Giacone #7829 Vote of the Board: Ayes: Members Weisman(Chairperson),Acampora,Planamento, and Lehnert. (Member Dantes Recused). This Resolution was duly adopted(4-0). RELIEF DENIED WITHOUT PREJUDICE: Edwin J. Pisani #7834SE Vote of the Board: Ayes: Member Weisman(Chairperson), Planamento, Lehnert,Acampora and Dantes. This Resolution was duly adopted(5-0). DENY AND GRANT ALTERNATIVE RELIEF WITH CONDITIONS: Tracey and Alexander Sutton #7831 Vote of the Board: Ayes: Members Weisman(Chairperson), Dantes,Planamento, and Acampora,and Lehnert. This Resolution was duly adopted(5-0). This Resolution was duly adopted(5-0). .RESOLUTIONS: RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Planamento to authorize advertising of hearings for the Regular Meeting to be held on Thursday, November 2, 2023 which will commence at 9:00 A. M. for Executive Session and 10:00 A.M. for Work Session and Regular Meeting. Vote of the Board: Ayes: Member Weisman(Chairperson), Dantes, Planamento,Acampora and Lehnert. This Resolution was duly adopted(5-0). RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Lehnert to approve minutes from the Regular Meeting held October 5, 2023. Vote of the Board: Ayes: Member Weisman (Chairperson), Dantes, Planamento,Acampora and Lehnert. This Resolution was duly adopted(5-0). There being no other business properly coming before the Board at this time, the Chairperson declared the meeting adjourned. The meeting was adjourned at 5:51 P. M.
