That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 36 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized,or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. Moore, Esq. 51020 Main Road Southold, NY 11971 RE: THOMAS BARNARD 4240 PARADISE POINT ROAD, SOUTHOLD SCTM# 1000-81-3-7 Dear Mrs. Moore: The Board of Town Trustees took the following action during its Regular meeting held on Wednesday, November 15, 2023 regarding the above matter: WHEREAS, Patricia C. Moore, Esq., on behalf of THOMAS BARNARD applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated August 8, 2023, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered the Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the'imposition of the following Best Management Practice requirements: installation of gutters to leaders to drywells; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on November 15, 2023, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, and, 2 WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of THOMAS BARNARD for the as-built 3'x16' steps to a 13.8'x16.6' wood deck at top of bulkhead with 3'x6' steps to the beach; existing 29.9'x23.6' seaward side deck attached to dwelling with 8.2'x5.5' steps to ground set into the deck; existing 2,500sq.ft. dwelling with attached 24.3'x36.3' garage and as-built east side entry with 3'x3' wood platform and steps to ground; existing 5'x12' outdoor shower on top of 45' long by 4'-5' (variable width) decking along east side of dwelling; existing 19' x 6' and 45'x 6' covered walk/breezeway from dwelling to garage; with the condition that no fertilizer is used on the lawn, with the installation of gutters to leaders to drywells; and as depicted on the site plan prepared by Vincent Benic Architect last dated April 8, 2023, and stamped approved on December 5, 2023; and the site plan prepared by Vincent Benic Architect last dated December 4, 2023, and stamped approved on December 5, 2023. The subject property is a 49, 658 sf irregularly shaped non-conforming lot located-in-an-R-80 zoning district. The property has an irregularly shaped road frontage on Paradise Point Road of 269. 42 ft, then turns southwest for 278. 31 ft to Peconic Bay, then turns south for 89. 46 ft of bayfront bulkhead, then returning northwest for 531.53 ft back to Paradise Point Road. The property is improved with an existing 1- story residence, detached garage and a wood deck on the bulkhead. There is a shed located in the front yard. Hs AMENDMENT ADDITIONAL INFORMATION: Ina letter dated March 2,2023,the applicant's attorney,on behalf of her client,requested that the Board amend condition of approval number 3. In her letter she stated the screen in porch was converted to living space in 1999,and was made part of the living room. This request to legalize the"as built"conversion was included in the Notice of Disapproval and the submitted application.Based upon this information,at the March 16,2023 Special Meeting the Board members voted unanimously to strike this condition from the original decision. In a letter dated April 14,2023,the applicant's attorney requested that the Board review the decision and amend Condition#5 to conform to the lot area indicated in the Architect's site plan.During the April 20, 2023 Special Meeting of the Zoning Board of Appeals,it was determined that the site plan prepared by Venci Benic,R.A.,depicting the subject lot size as 41,654.44 sq.ft.was accurate and acceptable. Condition No.5 has been removed. FINDINGS OF FACT/REASONS FORBOARD ACTION: The Zoning Board of Appeals hcld a public hearing on this application on February 2,2023 at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Tdwn:.Law &267=b(3)(b)(11.. Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The deck at the bulkhead is similar to other decks along the waterfront in the surrounding area. As for the property setbacks,the distance to the rear property line is constantly changing as it is set at the high-water mark,which due to sand accretion,changes yearly. The surrounding neighborhood is made up of similar shaped properties with residences both larger and smaller than what exists on the subject site,which makes it consistent with the character of the neighborhood. 2. Town Law 1§267!V3.)(b1(2): The benefit sought by the applicant,cannot be achieved by some"method,feasible forthe e_applicant to,.pursue,other than an area variance. The existing structures and alterations to the structure pre-date Trustee's jurisdiction and were constructed without requiring Trustee's permits.
