Because of the proximity of the building to the water, we have been advised to contact the NYSDEC, According to Part 66I, Tidal Wetlands-Land Use Re~ula'.ions, 661.4, page 13, our proposal would no[ be considered within a "tidal wetland" or an "adjacent area," as the building sits about 35' above mean sea level and about 140' from the shore line.
