No additional members of the public or an immediate neighbor spoke in favor of or against this application.

The Zoning Board of Appeals held a public hearing on this application on Rdy 6, 2023 kit which time written and
oral evidence were presented. Based Upon all testimony, docurrientation,personal inspection of the property and

surrounding neighborhood,and other evidence, the Zoning Board finds the following facts to be true and relevant
and makes the following findings:

with single-family homes built In the late 1960's thrOLICrIl carly 1980's, most ot'which have been rCCCndy Updated to

similar relief from the code, as many lots in the community are shkdkw and do not have the lot depth to allow for the
current required setbacks. The reduced setback, will not be recognizable to the public at large Garea residents cW
passersby. FUrthen-nore, the lot opposite the subject parcel is owned by tlie 1-own of`Southold and is In its natural
state, undeveloped, and used as a drainage SUMP.

Lo Law "267-b(3)('b)(2)1 The benefit sought by the applicant or cannot be achieved by some method feasible
for the applicant to pursue, other than in area variance. As a result of the construction of the original house built in
1974 with the documented front yard setback of 39.125 feet, it is assumed that at the time of construction an error
was made relative to the placement of the foundation (built ten inches too close to the street) which was only
discovered as a result of the applicant's desire to apply for a building permit to add a full second floor-, so, any
addition to the structure will require Board relief. Phis determination is in keeping with the Walz decision, 45039 in
2001.
3. 'row n Law §267-b(3)(b)(3). The variance granted herein is not mathematically substantial, representing 2.5%
relief from the code Vlorcover,, the house, as built, has existed in its present location and has contributed to the
community character, without issue since conStrUCtion in 1974. FUrthennore, several other hoim:,; in tile immediatc
community have received similar relief;based on Board knowledge, for less than code compliant front yard setbacks.

COMMUllity will have an adverse impact on the physical or environmental conditions in the neighborhood. The
