Box 582 Bohemia, NY 11716 RE: HERBERT & SUSAN HOFFMAN 1605 ARSHAMOMAQUE AVENUE, SOUTHOLD SCTM# 1000-66-3-10 Dear Mr. Patanjo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, November 15, 2023 regarding the above matter: WHEREAS, Jeffrey Patanjo on behalf of HERBERT &SUSAN HOFFMAN applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated October 2, 2023, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on November 15, 2023, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, 2 WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of HERBERT &SUSAN HOFFMAN to remove the existing timber retaining wall and replace with a new 79 linear foot long retaining wall in new landward position; install a 10 linear foot long return on the north end and a 6' return on the south end; the new retaining wall to be installed at a raised height of 30 inches above top cap of existing retaining wall; 4'wide by 5' long steps to water using Thru-Flow decking surface to be installed; prior to removal of the existing retaining wall there shall be 17 cubic yards excavated from landward side from between old wall and new wall, this material shall be used as fill along with 13 cubic yards from upland sources behind the new retaining wall to raise grade; proposed intertidal plantings shall be placed immediately seaward of proposed retaining wall to create a wetland area; plantings to consist of salt hay (spartina patens), seaside lavender (limonium carolinianum) and saltwort (salicornia spp.); plants shall be planted in accordance with NYSDEC guidelines; and to install and perpetually maintain a 10' wide non-turf buffer along the landward edge of the retaining wall; with the condition that the. 10' wide non-turf buffer located landward of the retaining wall be vegetated; and as depicted on the site plan prepared by Jeffrey Patanjo, received on October 26, 2023 and stamped approved on November 15, 2023. Permit to construct and complete project will expire three years from the date the permit is signed. No Disturbance to Vegetated Tidal Wetlands. There shall be no disturbance to vegetated tidal wetlands or protected buffer areas.as a result of the.permitted activities. .8. Storage of Equipment,Materials The storage of construction equipment and materials shall be confined within the project work area and/or upland areas greater than 75 linear feet from the tidal wetland boundary. 9. Clean Fill Only All fill shall consist of clean sand,gravel,or soil (not asphalt,.slag, flyash,broken concrete or demolition debris).. 1o. Department Jurisdiction The department retains jurisdiction of all regulated lands where fill has been permitted. -Placement of fill shall not be used to alter the department's Tidal.Wetland jurisdictional area at the project site. The area remains a regulated area subject to Tidal Wetland Land Use restrictions of 6 NYCRR Part.661. 11. Backfilling. All peripheral berms, cofferdams,rock revetments, seawalls, gabions,bulkheads or other approved shoreline stabilization structures shall be completed prior to placement of any fill material behind such.structures. { 12. Jet-in Bulkhead Bulkheads constructed,directly adjacent to vegetated tidal wetlands shall be hand driven or jetted in with no disturbance:to the tidal wetland. Trenching is strictly prohibited. 13. New Bulkhead Landward of Existing.Structure The new bulkhead shall be constructed landward of the.existing structure as perthe NYSDEC approved plans prepared by Jeffrey Patanjo, last revised on 6!20/2023, and stampedNYSDEC.Approved on 8/30/2023. The existing sheathing.shall,not be removed until the landward sheathing is securely in place. Once the new sheathing has.been appropriately installed, the old.sheathing shall be.cut to grade or removed in its entirety, 14. Wood Preservatives a; Pressure treated wood used for construction of in-water structures must have undergone a treatment process approved(stamped or otherwise marked ascertified) by the American Wood Preservative Association. b. Wood treated with Pentachlorophenol (PCP)must not be used in marine or brackish waters. Wood treated with PCP must be aged in the open air for at least three months prior to in-water use. c. The use of creosote treated wood is prohibited both in the water and upland areas. d.. Chromated Copper Arsenate(CCA)pressure treated wood must be clean and free of CCA surface deposits. Wood with surface deposits must be washed for at least 5 minutes under running water prior to use.The washing must occur greater than 100 feet landward of.any regulated wetland and/or water body.(Note "E." below for handling wash water.) e. Any wood debris such as sawdust.or wash water must not enter any water body,.including wetlands { or protected buffer.areas. 1.8. No Dredging or Excavation No dredging,excavating or other alteration of shoreline or underwater areas is authorized by this permit, nor shall issuance of this permit be construed to suggest that the Department will issue a permit for such activities in the future. 19. No Structures on Pilings No structures, other than structures specifically authorized by this permit, shall be constructed on pilings without further authorization from the department(permit, modification or amendment). 20. Install,Maintain Erosion Controls Necessary erosion control measures,i.e., straw bales, silt fencing,etc.., are to be placed on the down slope.edge.of any disturbed area. This sediment barrier.is to be.put in place before any disturbance of the ground occurs and is to be maintained in good and. functional condition until thick vegetative cover is established. 21. State May Order Removal or Alteration of Work If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the.State, or cause doss or destruction of the natural resources of.the State, the owner may be ordered by the Department to remove or alter the structural work,obstructions, or hazards caused thereby without expense to the State, and if;upon the expiration,or revocation of this permit,the structure,fill, excavation, or other modification of the watercourse hereby authorized shall not be completed,the owners, shall,without expense to the State; and to such extent and in such time and:manner as the Department of Environmental Conservation may require,remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity.of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. 27. SCTM# 1000-66-3-10 For a Wetland Permit to remove the existing timber retaining wall and replace with a new 79 linear foot long retaining wall in new landward position; install a 10 linear foot long return on the north end and a 6' return on the south end; the new retaining wall to be installed at a raised height of 30 inches above top cap of existing retaining wall; 4' wide by 5' long steps to water using Thru-Flow decking surface to be installed; prior to removal of the existing retaining wall there shall be 17 cubic yards excavated from landward side from between old wall and new wall, this material shall be used as fill along with 13, cubic yards from upland sources behind the new retaining wall to raise grade; proposed intertidal plantings, shall be placed immediately seaward of proposed retaining wall to create a wetland area; plantings to consist of salt hay (spartina patens), seaside lavender (limonium carolinianum) and saltwort (salicornia spp.); plants shall be planted in accordance with NYSDEC guidelines; and to install and perpetually maintain a 10' wide non-turf buffer along the landward edge of the retaining wall.
