Chairman Wilcenski: Good Evening and welcome to the Public Meeting for Monday,
December 5, 2022 for the Southold Town Planning Board. This meeting is public. The
Planning Board,may add or remove applications from the Agenda upon its discretion, without
further notice. Applications may not be heard in the order they appear on this agenda.
SETTING OF THE NEXT.PLANNING BOARD MEETING
Chairman Wilcenski: The first order of business is to set Monday, January 9, 2023 at
6:00 p.m. at the Southold Town Hall, Main Road, Southold, as the time and place for the
next regular Planning Board Meeting.

SITE PLAN APPLICATIONS
SET HEARING:
Chairman Wilcenski: Greenport Medical Offices & Apartments —This Site Plan
application is for the proposed construction of four (4) 10,900 sq. ft. campus-style office
buildings with three (3) medical office units on the first floor and ten (10) workforce
apartments on the second floor of each, with 120 parking stalls on 4.7 aces in the'RO and
R-40 Zoning District. The property is located at 160 NYS Route 25; Greenport.
SCTM#1000-34-2-1. The subjects of this hearing include the site plan application, and a
Draft Conditioned Negative Declaration which contains mitigation of potential impacts from
this proposed site plan. The proposed mitigation includes, in part, the removal of one of the
buildings, reduction in the size of the parking lot, an increase in the buffer size, and the
relocation and reduction in length of the easterly driveway.

WHEREAS, this Site Plan application is for the proposed construction of four (4)
campus-style residential office buildings with three (3) medical office units on the first
floor and ten (10) workforce housing units on the second floor of each, with 120 parking
stalls on 4.7 aces in the RO and R-40 Zoning District; and
WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617, has determined that the proposed
action is an Unlisted action as it does not meet the criteria for a Type I or Type II action;
and
WHEREAS, the Planning Board, pursuant to SEQRA, has determined that the proposed
action described above may have potentially moderate to large adverse impacts on the
environment, but the impacts may be adequately mitigated by conditions imposed by
the lead agency, without the need for additional environmental studies; and
WHEREAS, the Planning Board is considering a Conditioned Negative Declaration
pursuant to SEQRA, and is presenting a draft Conditioned Negative Declaration for
public review and comment; be it therefore
RESOLVED, that the Southold Town Planning Board has determined that this proposed
action is an Unlisted Action under SEQRA as described above;

March 2, 2022, and the draft Conditioned Negative Declaration.

CONDITIONAL SKETCH PLAT APPROVAL EXTENSION:
Chairman Wilcenski: Tuthill Conservation Subdivision —This proposal is for an 80/60
Conservation Subdivision of four parcels (total area=112 acres) into 17 residential lots, with
94 acres to be preserved. The properties are located on Main Road in Orient in the R-80
and R-200 Zoning Districts. SCTM#'s 1000-17-4-16, 1000-17-6-14.2, 1000-18-3-30.3 and
1000-18-6-17.3

WHEREAS, this proposal is for an 80/60 Conservation Subdivision of four parcels
SCTM#s1000-17-4-16, 1000-17-6-14.2, 1000-18-3-30.3 and 1000-18-6-17.3

(total area = 112 acres) into 17 residential lots, with 94 acres to be preserved. This
project includes the transfer of yield among the four parcels pursuant to §240-42 F of
the Southold Town Code.
SCTM#1000-17-4-16 (North Dyer) equals 21 acres proposed to be subdivided into 6
lots where the lots range in size from 0.7 - 0.9 acres. This property includes a 0.7-acre
private right-of-way and 15.6 acres of preserved open space inclusive of 6 acres of
unbuildable lands.
SCTM#1000-17-6-14.2 (South Dyer) equals 35.3 acres proposed to be subdivided into
5 lots where the lots range in size from 0.5 - 0.9 acres; property includes a 0.5-acre
right-of-way and 28.5 acres of open space inclusive of 15 acres of unbuildable lands.
SCTM#1000-18-3-30.3 (North Brown) equals 28.7 acres proposed to be subdivided into
5 lots where the lots range in size from 0.7 - 0.8 acres. This property includes a 1.3-acre
private right-of-way and 23.7 acres of open space inclusive of 2 acres of unbuildable
lands.
SCTM#1000-18-6-17.3 (South Brown) equals 26.9 acres proposed to be subdivided
where Lot 1 equals 0.92 acres. This property includes 25.5 acres of open space
inclusive of 0.62 acres of unbuildable lands; and
WHEREAS, on July 3, 2014 the agent submitted a Sketch Plan Application and fee in
the amount of$500.00 with other required materials for submission pursuant to Article V
Sketch Plat Review; and
WHEREAS, on December 2, 2019 the Southold Town Planning Board granted
Conditional Sketch Plan Approval upon the maps entitled:
• Sketch Plan North Dyer dated as last revised April 3, 2013,
• Sketch Plan South Dyer dated April 1, 2011,
• Sketch Plan of North Brown dated October 22, 2013,
• Sketch Plan of South Brown dated as last revised April 2, 2013; and
WHEREAS, Conditional Sketch Approval, granted by the Planning Board on December
31, 2020, is set to expire pursuant to Article V. Sketch Plat Review§240=14. Expiration
of the Southold Town Code; and
WHERAS the applicant has requested a one-year extension of time to file the Final Plat,
citing difficulty in South Dyer title search findings translated into an updated accurate tax
map and obtaining agreement with neighbors regarding respective ownership, rights of
way and maintenance responsibility over Racketts Court. In addition, they have not
been able to obtain the required Final Plat maps; therefore be it
RESOLVED, that the Southold Town Planning Board grants an extension of time to file
the Final Plat Application from December 5, 2022 to December 31, 2023.

STATE ENVIRONMENTAL QUALITY REVIEW ACT -Adopt Findings Statement
Chairman Wilcenski: The Orchards Standard Subdivision —This proposal is for a
Clustered Standard Subdivision to subdivide a 13.3-acre parcel into five lots where Lot 1 =
9.33 acres including a 1.35 acre building envelope and 7.98 acres of preserved Open
Space, Lot 2 = 0.99 acres, Lot 3 = 1.14 acres, Lot 4 = 0.92 and Lot 5 = 0.92 acres in the R-
80 Zoning District. The property is located at 2595 Orchard Street, on the northeast side of
Orchard Street, approximately 17' northwest of Platt Road, in Orient. SCTM#1000-27-1-3

EXTENSION OF TIME TO RENDER A FINAL PLAT DETERMINATION:
Chairman Wilcenski: Harold R. Reeve & Sons, Inc. —This proposal is for a Standard
Subdivision of a 5.1-acre split-zoned parcel into 4 lots where Lots 1-3 equal 1 acre each
in the R-40 Zoning District and Lot 4 equals 1.9 acres located in the LB Zoning District.
The property is located at 1605 Wickham Avenue, on the n/s/o County Road 48,
approximately 190' w/o Wickham Avenue, in Mattituck. SCTM#1000-140-1-6

WHEREAS, this proposal is for a Standard Subdivision of a 5.1-acre split-zoned parcel
into 4 lots where Lots 1-3 equal 1 acre each in the R-40 Zoning District and Lot 4 equals
1.8 acres located in both the R-40 and LB Zoning Districts; and
WHEREAS, on August 5, 2019 the Southold Town Planning Board granted Conditional
Preliminary Plat Approval upon the map prepared by Howard W. Young, Land Surveyor,
entitled "Subdivision Map of Harold R. Reeve and Sons, Inc.", dated January 8, 2015
and last revised May 24, 2019 and approval on the Preliminary Road and Drainage
Plans last revised May 24, 2019; and
WHEREAS, on February 10, 2020, a Final Plat Public Hearing was held and closed;
and
WHEREAS, the Southold Planning Board, pursuant to the Southold Town Code, has 62
days to render a Final Plat Determination after the Final Plat Public Hearing is closed
unless a mutual agreement is reached; and
WHEREAS, due to the COVID-19 Pandemic and Town of Southold State of Emergency
in response to the pandemic, the 62-day timeframe expired on April 12, 2020, and
WHEREAS, On December 1, 2022 the applicant submitted a request to extend the
decision timeframe for another six months, and
WHEREAS, Southold Planning Board and the applicant have mutually agreed to extend
the timeframe to render a Final Plat determination from December 5, 2022 to June 5,
2023.; therefore be it
RESOLVED, that the timeframe to render a decision on the Final Plat is hereby
mutually extended from December 5, 2022 to June 5, 2023.

PUBLIC HEARING
Chairman Wilcenski: 6:01 pm Key Capture Battery Energy Storage Site Plan—This
site plan is for the construction of a 60MW Lithium-Ion Battery Energy Storage System and
a new LIPA substation. The battery storage facility is comprised of 272 battery energy
storage container units, 34 power conversion system units, a 1,000 sq. ft. point of
interconnection building. The LIPA substation will require a 2.54-acre parcel to be created
for LIPA ownership, and will contain a 392 sq. ft. LIPA substation building, lightning masts
and ±13 utility poles connecting to CR 48 by way of an access easement over Town of
Southold land. The parcel is ±27 acres in the Light Industrial Zoning District. The property is
located at 10750 Oregon Road, Cutchogue. SCTM#1000-83-3-6.1
