This meeting is public. The Planning Board may add or remove applications from the Agenda upon its discretion, without further notice. Applications may not be heard in the order they appear on this agenda. SETTING OF THE NEXT PLANNING, BOARD MEETING Chairman Wilcenski: The first order of business is to set Monday, August 8, 2022 at 6:00 p.m. as the time for the next regular Planning-Board Meeting. SUBDIVISIONS CONDITIONAL SKETCH PLAT DETERMINATIONS/ STATE ENVIRONMENTAL QUALITY REVIEW ACT TYPE CLASSIFICATIONS: Chairman Wilcenski: Smyth Standard Subdivision —This standard subdivision proposes to subdivide a 3.68 acre improved parcel into 3 lots; where lot 1 equals 1.01 acres, lot 2 equals 1.46 acres and lot 3 equals 1.21 acres in the R-40 Zoning District. SCTM#1000-102-6-23.1 James H. Rich III: WHEREAS, this standard subdivision proposes to subdivide a 3.68 acre improved parcel into 3 lots; where lot 1 equals 1.01 acres, lot 2 equals 1.46 acres and lot 3 equals 1.21 acres in the R-40 zoning district; and WHEREAS, on March 29, 2022 the applicant submitted a Sketch Plan application and fee; and WHEREAS, at their work session on April 25, 2022, the Planning Board found the Sketch Plan Application incomplete; and WHEREAS, on May 9, 2022 the applicant submitted a revised Sketch Plan application, including the information needed to make the application complete; and WHEREAS, the Southold Town Planning Board has determined that the following provisions of the Southold Town Code §240 Subdivision of Land are not requisite in the interest of the public health, safety and general welfare because this subdivision is not clustered, no new road is proposed, and the acreage of Lot 1,2 and 3 are all conforming to the zoning district and therefore are eligible for a waiver: a. Existing Resources Site Analysis Plan (ERSAP); b. Yield Plan; c. Primary & Secondary Conservation Area Plan; d. Draft Bond Estimate e. Performance Guarantee; and Southold Town Planninq Board Public Meetinq —July 11, 2022 — Page 3 WHEREAS, the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617, has determined that the proposed action is an Unlisted Action as it does not meet any of the thresholds of a Type I Action, nor does it meet any of the criteria on the Type II list of actions; and WHEREAS, on June 6, 2022, at their work session, the Planning Board reviewed the submission and found the Sketch Plat application was complete and ready for a determination pursuant to Town Code §240 Subdivision of land; therefore be it RESOLVED, that the Southold Town Planning Board has determined that this proposed action is an Unlisted Action under SEQRA as described above; Martin Sidor: Second. Rich III: And be it further RESOLVED, that the Southold Town Planning Board grants a Conditional Sketch Plat Approval upon the map entitled, "Clustered Standard Subdivision for John and Margaret Smyth", prepared by Kenneth M. Woychuck Land Surveying, dated February 17, 2020 and last revised May 4, 2022, with the following conditions: 1. The existing barn and it's use after the subdivision is approved to create proposed Lot 3 must be resolved prior to final approval. Submit a request to the Town Building Department to determine whether a variance is required for this structure to remain after the subdivision is approved. Issues may include the rear yard setback requirement and/or the use of the building as accessory without a principal structure. 2. Required amendments to the Subdivision Map: a. Establish, show and label perimeter buffers on each lot compliant with the required limits of clearing. A total lot area of 50 percent is permitted to be cleared on each lot. The building envelopes cannot encroach into the limits of clearing, and must be adjusted to reflect the limits of clearing where they overlap with the clearing limits. b. Label significant trees (greater than 18" DBH) that will be retained. Integrate them in the clearing limits to the greatest extent practicable. c. Provide the location and results of a test hole. d. Clarify or remove the square footage notations under and outside of the Lot Data table. e. Amend the SCDHS box to show the correct subdivision name. f. Show the proposed curb cut of the driveway on Lot 1 in relation to crosswalk,' sidewalks, utility pole, signs, Depot Lane, and other curb cuts in the vicinity. g. Indicate on the subdivision map the future status of accessory buildings on proposed Lot 3, including the carport and the frame barn. h. Indicate on the subdivision map the future status of the existing concrete aprons and driveways where any changes are proposed. 3. Submit a complete Preliminary Plat Application and Fee. Chairman Wilcenski: 15105 Oregon Road Standard Subdivision —This standard subdivision proposes to subdivide a 5.18-acre parcel into two lots where Lot 1 equals 2.60 acres and Lot 2 equals 3.24 acres and is improved with a single-family residence in the Agricultural Conservation and Residential 80 Zoning Districts. SCTM#1000-73-1- 1 Martin Sidor: WHEREAS, this standard subdivision proposes to subdivide a 5.18-acre)parcel into two lots where Lot 1 equals 2.60 acres and Lot 2 equals 3.24 acres and is improved with a single-family residence in the Agricultural Conservation and Residential 80 Zoning Districts.; and WHEREAS, on January 20, 2022 the applicant submitted a Sketch Plan application and fee; and WHEREAS, at their work session on March 28, 2022, the Planning Board found the Sketch Plan Application incomplete; and WHEREAS, on April 19, 2022 the applicant submitted a revised Sketch Plan application, including the information needed to make the application complete; and WHEREAS, the Southold Town Planning Board has determined that the following provisions of the Southold Town Code §240 Subdivision of Land are not requisite in the interest,of the public health, safety and general welfare because this subdivision is not clustered, no new road is proposed, and the acreage of Lot land 2 are both conforming to the zoning district and therefore are eligible for a waiver: f. Add the zoning division line to the Preliminary Plat. 2. Correct the acreage referenced for the flag of proposed Lot 1. It should be 0.37. James H. Rich III: Second. PUBLIC HEARING Chairman Wilcenski: 6:01 PM — Peconic Onwego Standard Subdivision —This Standard Subdivision proposes to subdivide a 3.65 acre parcel into 2 lots. Lot 1 equals 2.73 acres and Lot 2 equals 0.92 acres in the Limited Business and Residential Office zoning districts. The property is located at 32900 Country Road 48, Peconic. SCTM#1000-74-4-14.3 At this time, if there is anyone who would like to address the Board on this application, please step to the podium, write your name and state your name for the record before addressing your comments to the Board. Tom McCarthy: Good Evening, Tom McCarthy, McCarthy Management. I'm here for the applicant and I'm happy to answer any questions. I don't have any new material to present but I'm happy to answer any questions that the Board may have. Jessica Michaelis: Do you have any green cards? Tom McCarthy: I believe we do. Chairman Wilcenski: Okay, while Tom is at the microphone, do any Board members have any questions for Tom? None Pierce, you're good? Southold Town Planning Board Public Meeting —July 11, 2022 — Page 8 Pierce Rafferty: I'm good. Chairman Wilcenski: Would anybody else like to address the Board? Yes, you can step to that podium, state your name, write your name for the record and address your comments to the Board. James Cardwell: Hi, my name is James Cardwell. I'm a resident on Peconic Lane, I live in the second house in from the corner so my house and my property straddles both what will be residential office as well as the Light Industrial line there. And I guess part of it is two things: obviously, I think that both these properties was originally set that way. My property I think got sold into it a long, long time ago from the previous owners and that kind of stuff and I think at that time it was established as Light Industrial and Residential. Chairman Wilcenski: Light Business. James Cardwell: Oh, Light Business, okay, sorry. I think at that time, I mean, everything has, obviously been sort of status quo for almost 15 years or more, but I guess at that time, the vegetation was supposed to be maintained and to continue to grow. Now with the Light Business, you know, there's trailers, there's boats there, now there's a residential office and I have really no objection to the separation other than, can they accommodate and provide some fencing at this time so that whatever is built there and also for all the boats and trailers that now occupy the Light Business side, which, originally was just for the landscaping business, to shield us so that we no longer will see that in our future. I mean, is that something that can be done? Because we don't really have much control over the types of businesses that are going to go there. They're listed for Residential office but it could be a variety of things that we just don't know, you know, how much impact is going in the future. And I just think that, you know, a fence would provide some type of buffer and ability that we can, sort of, continue to live without the impact of whatever goes on the premises. Chairman Wilcenski: Okay, we can address that with the applicant. James Cardwell: Okay, so that's not something that can be required of him, or, you know? Chairman Wilcenski: At this point, we'd have to have staff and the Board look at your concerns. James Cardwell: Just because this time, I mean, there —even with the Light Business —the boats and the trailers and those things are closer than what they're supposed to be. The maintenance of the property, as is, hasn't been maintained in accordance with Light Business and Residential Office. So that is our concern, that in the future, we can't control it so we'd like to be able to control it now. Chairman Wilcenski: Okay, well that's what this public hearing is for. To bring this up from neighbors and whoever else. So that will be addressed. Southold Town Planning Board Public Meeting —July 11, 2022 — Page 9 James Cardwell: Thank you. Chairman Wilcenski: Thank you. Is there anybody else who has any questions or would like to address the Board on Peconic Onwego? Denis Coiervski: Yeah, my name is Denis Cojervski. I'm a former member of Peconic Lane and (inaudible). I have no objection to this subdivision, I would be very happy if a single-family house went up there, I would be probably less happy if a real estate office or another type of office went in. I would hope that-obviously—there's no way of knowing what a prospective buyer might want to put there and I would hope that the Board would pay attention to Section D that says: "All permitted buildings and other structures shall be visually residential in character, the visible architectural features of which shall be consistent and compatible with the architecture styles of the existing structures in the immediate neighborhood." So, my house was originally built in 1791, 1 don't expect them to build something that looks like 1791, but I would not like to see an ultra-modern real estate office go into that area. That's my feelings on this. So, no objection to the subdivision. Chairman Wilcenski: Thank you for your comments. Anyone else? Anyone on Zoom? Rich III: Mr. Chairman, I understand there was an issue with the mailing and green cards, so I make a motion to hold the hearing open until the next regularly scheduled public meeting on August 8th Martin Sidor: Second. Chairman Wilcenski: We're going to leave the hearing open, as Jim suggested, until August 8th because of the missing green card. Motion made by Martin, seconded by Jim. Any discussion? All in favor?
