Chairman Wilcenski: Good Evening and welcome to the Public Meeting for Monday, June 6,
2022 for the Southold Town Planning Board. This meeting is public. The Planning Board may
add or remove applications from the Agenda upon its discretion, without.further notice.-
Applications may not be heard in the order they appear on this agenda.
SETTING OF THE NEXT PLANNING BOARD MEETING
Chairman Wilcenski: The first order of business is to set Monday, July 11, 2022 at 6:00
p.m. as the time for the next regular Planning Board Meeting.

SUBDIVISIONS
SET PRELIMINARY PLAT HEARING:
Chairman Wilcenski: Peconic Onwego Standard Subdivision —This Standard
Subdivision proposes to subdivide a 3.65 acre parcel into 2 lots. Lot 1 equals 2.73 acres
and Lot 2 equals 0.92 acres in the Limited Business and Residential Office zoning
districts. The property is located at 32900 Country Road 48, Peconic. SCTM#1000-74-
4-14.3

WHEREAS, this Standard Subdivision proposes to subdivide a 3.65-acre parcel into 2
lots. Lot 1 equals 2.73 acres and lot 2 equals .92 acres in the Limited Business and
Residential Office zoning districts; and
WHEREAS, on November 16, 2021, the applicant submitted a Standard Subdivision
Sketch Plan Application for review by the Southold Town Planning Board; and
WHEREAS, at their work session on January 24, 2022, the Southold Town Planning
Board found the Sketch Plan Application complete; and
WHEREAS, the Southold Town Planning Board granted Conditional Sketch Plan
Approval upon the map entitled "Minor Subdivision Map of Peconic Onwego" prepared
by Kenneth M. Woychuck Land Surveying dated February 16, 2020 and last revised
September 23, 2021 and all conditions have been met; and
WHEREAS, on February 24, 2022, the applicant submitted a Preliminary Plat
Application and at the work session on April 25, 2022, the Southold Town Planning
Board found the preliminary plat application complete; therefore be it
RESOLVED, that the Southold Town Planning Board sets Monday, July 11, 2022 at
6:01 p.m. for a Public Hearing upon the map prepared by Kenneth Woychuk,
Licensed Surveyor entitled "Standard Subdivision Map of Peconic Onwego" dated
February 16, 2020 and last revised February 17, 2022.

EXTENSION OF TIME TO RENDER A FINAL PLAT DETERMINATION:
Chairman Wilcenski: Harold R. Reeve & Sons, Inc. —This proposal is for a Standard
Subdivision of a 5.1 acre split-zoned parcel into 4 lots where Lots 1-3 equal 1 acre each
in the R-40 Zoning District and Lot 4 equals 1.9 acres located in the LB Zoning District.
The property is located at 1605 Wickham Avenue, on the n/s/o County Road 48,
approximately 190' w/o Wickham Avenue, in Mattituck. SCTM#1000-140-1-6

WHEREAS, this proposal is for a Standard Subdivision of a 5.1 acre split-zoned parcel
into 4 lots where Lots 1-3 equal 1 acre each in the R-40 Zoning District and Lot 4 equals
1.8 acres located in both the R-40 and LB Zoning Districts; and
WHEREAS, on August 5, 2019 the Southold Town Planning Board granted Conditional
Preliminary Plat Approval upon the map prepared by Howard W. Young, Land Surveyor,
entitled "Subdivision Map of Harold R. Reeve and Sons, Inc.", dated January 8, 2015
and last revised May 24, 2019 and approval on the Preliminary Road and Drainage
Plans last revised May 24, 2019; and
WHEREAS, on February 10, 2020, a Final Plat Public Hearing was held and closed;
and
WHEREAS, the Southold Planning Board, pursuant to the Southold Town Code, has 62
days to render a Final Plat Determination after the Final Plat Public Hearing is closed
unless a mutual agreement is reached; and
WHEREAS, due to the COVID-19 Pandemic and Town of Southold State of Emergency
in response to the pandemic, the 62-day timeframe expired on April 12, 2020, and
WHEREAS, On May 31, 2022 the applicant submitted a request to extend the decision
timeframe for another six months, and
WHEREAS, Southold Planning Board and the applicant have mutually agreed to extend
the timeframe to render a Final Plat determination from June 6, 2022 to December 5,
2022.; therefore be it

RESOLVED, that the timeframe to render a decision on the Final Plat is hereby
mutually extended from June 6, 2022 to December 5, 2022.

SITE PLAN APPLICATIONS
DETERMINATIONS:
Chairman Wilcenski: 14695 Main Road (Dentist Office) Amended (Parking Lot
Expansion) —This site plan is an amendment to the approved site plan for an existing
dentist office to expand the parking lot. The property is located at 14695 NYS Route 25,
Mattituck. SCTM#1000-114-8-5
James H. Rich III:
WHEREAS, this amended site plan is to expand an existing parking area as part of an
existing dentist office on 0.48 acres in the Residential Office (RO) Zoning District,
Mattituck; and
WHEREAS, on September 9, 2021, Jaclyn Peranteau, authorized agent, submitted a
Site Plan Application for review; and
WHEREAS, on October 4, 2021, the Planning Bound accepted the application as
complete for review; and
WHEREAS, the Southold Town Planning Board, pursuant to State,Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that the proposed
action is a Type II Action as it falls within the following description for 6 NYCRR, Part
617.5(c)(7) construction or expansion of a primary or accessory/appurtenant, non-
residential structure or facility involving less than 4,000 square feet of gross floor area
and not involving a change in zoning or a use variance and consistent with local land
use controls, but not radio communication or microwave transmission facilities; and

WHEREAS, on November 3, 2021, the Planning Board, pursuant to Southold Town
Code §280-131 C., distributed the application to the required agencies for their
comments; and
WHEREAS, on November 4, 2021, the Southold Town Code Enforcement officer
verified that there were no open violations on the subject parcel; and
WHEREAS, on November 5, 2021, the Southold Town Fire Inspector reviewed and
determined that there was adequate fire protection and emergency access for the site;
and
WHEREAS, the proposed action was determined exempt for review by the Suffolk
County Planning Commission (SCPC); and
WHEREAS, on November 18, 2021, the Town of Southold Local Waterfront
Revitalization Program,Coordinator reviewed the proposed project and determined it to
be consistent with the Southold Town LWRP policies; and
WHEREAS, on November 23, 2021, the Southold Town Engineer reviewed the
proposed application and determined that the application met the minimum
requirements of Chapter 236 for Storm Water Management; and
WHEREAS, on December 6, 2021, the Planning Board required certain revisions to the
site plan and information to be provided; and
WHEREAS, on April 5, 2022, Jaclyn Peranteau, authorized agent, submitted revised
site plans for review; and
WHEREAS, on April 25, 2022, the Planning Board reviewed the revised site plans and
required Tree Fund payment; and
WHEREAS, pursuant to 280-129(C)(1) the Planning Board agreed to permit the
applicant to pay a sum in lieu of two (2) required street trees. A third required tree will
be planted as required. The fee shall be paid prior to any site plan approval and will be
deposited into the Fiduciary Fund and used by the Southold Town Tree Committee
exclusively for the planting of new street trees and/or the replacement of damaged or
removed trees on Town property; and
WHEREAS, on May 17, 2022, Jaclyn Peranteau, authorized agent, submitted required
information for review; and
WHEREAS, on-May 23, 2022, the Southold Town Planning Board determined that all
applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan
Approval of the Town of Southold have been met; therefore be it

RESOLVED, that the Southold Town Planning, Board has determined that this proposed
action is consistent with the policies of the Town of Southold Local Waterfront
Revitalization Program;

(1) condition to the plans entitled "Proposed Parking Lot Expansion for Existing Dentist
Office" prepared by Jaclyn R. Peranteau, P.E. dated June 16, 2021 and last revised
April 28, 2022 and authorizes the Chairman to endorse the Site Plan.
Condition
1. In addition to landscape plantings as per the approved site plan, fencing along
the east, west and north rear yard property lines shall be maintained in order to
maintain sufficient screening of the parking area.

for the proposed construction of a 60' x 100' (6,000 sq. ft.) agricultural pole barn,
including employee bathrooms, an office and storage with a 19-space parking lot, and a

60' x 40' (2400 sq. ft.) agricultural storage shed. The property is located at 12595 '
Oregon Road, Cutchogue. SCTM#1000-83-2-12.7

WHEREAS, this site plan is for the proposed construction of a 60' x 100' (6,000 sq. ft.)
agricultural pole barn, including employee bathrooms, an office and storage with a 19-
space parking lot, and a 60' x 40' (2400 sq. ft.) agricultural storage barn on in the AC
Zoning District, Cutchogue; and
WHEREAS, on November 4, 2021, Jonathan Fabb, owner, submitted a Site Plan
Application for review; and
WHEREAS, at their work session on December 6, 2021, the Southold Town Planning
Board accepted the site plan application as complete for review; and
WHEREAS, on December 6, 2021, the Southold Town Planning Board, pursuant to
State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined
that the proposed action is a Type II Action as it falls within the following description for
6 NYCRR, Part 617.5(c)(3) agricultural farm management practices, including
construction, maintenance and repair of farm buildings and structures, and land use
changes consistent with generally accepted principles of farming; and
WHEREAS, on December 6, 2021, pursuant to Southold Town Code §280-131(H), the
Southold Town Planning Board agreed to waive the requirement for a public hearing
regarding this application which 'involves uses strictly related to agriculture; and
WHEREAS, pursuant to Southold Town Code §280-133(C) and as detailed in work
session staff report on December 6, 2021, the Planning Board agreed to waive certain
application requirements of§ 280-133 for this application which involves uses strictly
related to agriculture (but excepting retail winery operations); and
WHEREAS, on December 22, 2021, the Planning Board, pursuant to Southold Town
Code §280-131 C., distributed the application to the required agencies for their
comments; and
WHEREAS, on January 6, 2022, the Southold Town Fire Inspector stated there were no
objections to the proposed site plan; and
WHEREAS, on January 11, 2022, the Southold Town Code Enforcement officer verified
that there were no open violations on the subject parcel; and
WHEREAS, on January 13, 2022, the Southold Town Engineer reviewed the proposed
application and determined that the certain revisions were required in order for the
application to meet the minimum requirements of Chapter 236 for Storm Water
Management; and

WHEREAS, on January 25, 2022, the Southold Fire District determined that there was
adequate fire protection and access for the proposed action; and
WHEREAS, on February 4, 2022, the Suffolk County Department of Health Services
(SCDHS) granted a wastewater permit for an Agricultural Building @ 336gpd Ref#C-1 9-
0002; and
WHEREAS, on February 6, 2022, the Agricultural Advisory Committee provided
comments supporting the proposed project for approval; and
WHEREAS, on February 7, 2022, the Town of Southold Local Waterfront Revitalization
Program Coordinator reviewed the proposed project and determined it to be consistent
with the Southold Town LWRP policies with certain recommendations issued; and
WHEREAS, on February 10, 2022, the Architectural Review Committee reviewed the
proposed project and recommended items addressed by the Planning Board; and
WHEREAS, the NYS Department of Environmental Conservation (NYSDEC) issued an
approval for the installation of one 8" diameter agricultural irrigation well from February
2020 — February 2030; and
WHEREAS, the Suffolk County Farmland Committee granted an Agricultural
Development Permit and Special Use Permit (PFC2020016 and PFC2020017) to
conduct site disturbance associated with the installation of the electric utility
infrastructure, water utility/irrigation infrastructure, and sanitary system infrastructure, in
association with a nursery stock, fruits and vegetable operation; and
WHEREAS, on February 28, 2021, the Southold Town Planning Board determined that
with exception of revisions detailed in the work session follow up letter, all applicable
requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan Approval of
the Town of Southold have been met; and
WHEREAS, on May 12, 2022, Jonathan Fabb, owner, submitted revised site plans and
information as required; and
WHEREAS, on June 1, 2022, the Southold Town Chief Building Inspector reviewed and
certified the proposed Agricultural Storage Building as a permitted use in the A-C
Zoning District; therefore be it
RESOLVED, that the Southold Town Planning Board hereby waives the requirement for
a public hearing and certain application requirements as described above;

conditions, listed below, to the site plan entitled "WJF Farms, LLC' prepared by James
J. Deerkoski, P.E., dated April 8, 2022 and authorizes the Chairman to endorse the Site
Plan.
Conditions
1. All Suffolk County Farmland Committee requirements shall be met as issued for
Committee Resolution Number PFC2020016 and PFC2020017;
2. The four (4) approved exterior light fixtures shall be shielded so the light source
is not visible from adjacent properties and roadways and shall focus and direct
the light in such a manner as to contain the light and glare within property
boundaries and conform to §172 of the Town Code. Any future exterior lighting
must be approved by the Planning Board by letter prior to installation.

for the proposed construction of a 1,998 sq. ft. addition and interior alterations to the
existing dining building, all part of an existing continuing care retirement community on
144 acres in the Hamlet Density Zoning District. The property is located at 1500
Brecknock Road, Greenport. SCTM#1000-34-2-1

WHEREAS, this amended site plan is for the proposed construction of a 1,998 sq. ft.
addition and interior alterations to the existing dining building, all part of an existing
continuing care retirement community on 144 acres in the Hamlet Density Zoning
District, Greenport; and
WHEREAS, on August 24, 2021, Charles Cuddy, authorized agent, submitted an
amended Site Plan Application for review; and
WHEREAS, on September 13, 2021, the Planning Bound accepted the application as
complete for review; and
WHEREAS, the requirement for a Public Hearing was waived by the Planning Board
due to the de minimus nature of the amended site plan within the context of the existing
Life Care Community campus; and
WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that the proposed
action is a Type 11 Action as it falls within the!following description for 6 NYCRR, Part
617.5(c)(7) construction or expansion of a primary or accessory/appurtenant, non-
residential structure or facility involving less than 4,000 square feet of gross floor area
and not involving a change in zoning or a use variance and consistent with local land
use controls, but not radio communication or microwave transmission facilities; and
WHEREAS, on September 30, 2021 the Southold Town Trustees issued an approved
permit for the proposed action; and

WHEREAS, on October 5, 2021, the Planning Board, pursuant to Southold Town Code
§280-131)C., distributed the application to the required agencies for their comments;
and

WHEREAS, on October 28, 2021, the Southold Town Fire Inspector reviewed and

applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan
Approval of the Town of Southold have been met; therefore be it
RESOLVED, that the Southold Town Planning Board has determined that this proposed
action is consistent with the policies of the Town of Southold Local Waterfront
Revitalization Program;

Peconic Landing at Southold" prepared by Howard W. Young, L.S. dated January 29,
2021 and last revised March 17, 2021 and authorizes the Chairman to endorse the Site
Plan after the condition below is met.

1. Prior to endorsement of site plan, obtain a use certification from the Chief
Building Inspector as required by Town Code.
