No. 3939 Matter of GEORGE SCHNEIDER. Variance to the Zoning Ordinance, Article III, Section 100-32, for permission to construct a one family dwelling with attached garage, Bulk Area and Parking Regulations and insufficient sideyard setback. Property Location: 800 Sterling Road, Cutchogue, County Tax Map No. 1000, Section 104, Block O1, Lot 29. WHEREAS, a public hearing was held and concluded on May 15, 1990 in the matter of the Application of GEORGE SCHNEIDER, under Appeal No. 3939; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The premises in question is located along the north side of Sterling Road, Hamlet of Cutchogue, and is identified on the Suffolk County Tax Maps as District 1000, 104, Block O1, Lot 29. 2. This is an application for Variances from the Zoning Code Article III, Section 100-32, for permission to construct a one family dwelling with an attached garage. Bulk, Area and ` Parking Regulations and insufficient side yard setback. 1 Page 2 - Appl. No. 3939 Matter of GEORGE SCHNEIDER Decision rendered June 19, 1990 3. Article III, Section 100-32, No building,or premises shall be used and no building or part thereof shall be erected or altered in the Agricultural-Conservation District and in the Low-Density Residential R-80 District unless the same conforms to the Bulk Schedule and Parking Schedule incorporated into this chapter with the same force and effect as if such regulations were set forth herein in full, as well as to the following bulk and parking requirements: 4. The subject premises is located at 800 Sterling Road, Cutchogue and is improved with a one story framed house with an attached garage, the area is 24,217 sg. ft. in this R-40 Zone District. 5. In considering this application, the Board finds and determines: (a) the relief requested is not within the character of the immediate area and will be a substantial change, creating other precedents to follow; {b) the practical difficulties claimed are not sufficient to warrant the granting of the relief requested; (d) the circumstances of this property are not unique; (e) that in carefully considering the record and all the above factors, the interest of justice will be served by denying the relief granted and granting alternative relief, as further noted below. Accordingly on motion by Mr. Grigonis, seconded by Mr. Goehringer, it was RESOLVED to DENY the Variance with ALTERNATIVE RELIEF in the matter of the application of GEORGE SCBNEIDER under Appeal No. 3939, SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the attached garage not be any closer than 6 ft. 3 in. from the easterly property line. Vote of the Board: Ayes: Messrs. According to the Code of the Town of Southold, (Sections 100-281 and 100-284}, a building permit is needed for any construction of additions, accessary structures, alterations or new dwellings. We would like to bring to your attention that it is unlawful to occupy or use said structure until the Certificate of occupancy has been issued for that building permit. Schneider As you may have been aware, George T. Schneider appeared on Judge Price's May 22, 1991 calendar, which was held at 7:30 P.M., with regard to the Town's violation complaint pursuant to Section 100-284(A)(1) of the Town Code. Based on the previous discussions that we have had and because you have indicated to me that Mr. Schneider has corrected his problem in that he has removed a portion of his garage, the matter was adjourned in contemplation of dismissal (ACOD). Essentially, since it is our position that Mr. Schneider has now complied with the Zoning Law and has incurred some hardship and expense in so doing we requested that the Court adjourn the matter for six months. If within this six month period, Mr. Schneider again violates the Zoning Code of the Town of Southold, this particular matter will be revived; if Mr. Schneider does not violate the Code within the next six months, this matter will be dismissed. WHEREAS, a public hearing was held and concluded on May 15, 1990 in the matter of the Application of GEORGE SCHNEIDER, under Appeal No. 3939; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The premises in question is located along the north side of Sterling Road, Hamlet of Cutchogue, and is identified on the Suffolk County Tax Maps as District 1000, 104, Block O1, Lot 29. 2. This is an application for Variances from the Zoning Code Article III, Section 100-32, for permission to construct a one family dwelling with an attached garage. Article III, Section 100-32, No building, or premises shall be used and no building or part thereof shall be erected or altered in the Agricultural-Conservation District and in the Low-Density Residential R-80 District unless the same conforms to the Bulk Schedule and Parking Schedule incorporated into this chapter with the same force and effect as if such regulations were set forth herein in full, as well as to the following bulk and parking requirements: 4. The subject premises is located at 800 Sterling Road, Cutchogue and is improved with a one story framed house with an attached garage, the area is 24,217 sq. ft. in this R-40 Zone District. 5. In considering this applicatian, the Board finds and determines: (a) the relief requested is not within the character of the immediate area and will be a substantial change, creating other precedents to follow; (b) the practical difficulties claimed are not sufficient to warrant the granting of the relief requested; (d) the circumstances of this property are not unique; (e) that in carefully considering the record and all the above factors, the interest of justice will be served by denying the relief granted and granting alternative relief, as further noted below. Accordingly on motion by Mr. Grigonis, seconded by Mr. Goehringer, it was RESOLVED to DENY the Variance with ALTERNATIVE RELIEF in the matter of the application of GEORGE SCHNEIDER under Appeal No. 3939, Sl3BJECT TO THE FOLLOWING CONDITIONS: 1.
