The purpose of the inspection was to verify that the electrical service to the rear accessory building (east side of property) has been disconnected. The disconnection is being done to facilitate the demolition of this building. The inspection results are: 1 —Building power supplied through a sub panel located in the front end (west) of the accessory building. Panel opened and fuses removed. 2—No power feed to the accessory building from main house was discovered. 3 -Contractor to find and remove old underground feed daring demolition. P'ROP'ERTY FACTS/DESCRIPTION: The subject property is a non-conforming 64,825 square foot waterfront parcel located in the R-80 Zoning District. The parcel runs 88.11 feet along Marratooka Lake, runs 88.00 feet along Reeve Avenue, runs 747.32 feet on the North side and runs 730.54 feet on the South side. The parcel is improved with a two story frame house, a wood deck, and a one story frame garage and storage building. Part of the parcel is covered by wetlands. All is shown on a survey by Nathan Taft Corwin L.L.S., dated March 1, 2023, BASES Or APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's May 19, 2023 Notice of Disapproval based on an application for a permit to construct an accessory structure; at 1) less than the code required minimum side yard setback of 20 feet; located at: 345 Reeve Avenue, (Adj. to Marratooka Lake) Mattituck, NY. SCTM No. 1000-114-9-6. RELIEF REQUESTED: The applicant requests a variance to construct an accessory garage located 10 feet setback from the side yard property line where code requires an accessory structure have a minimum 20 foot side yard setback. ADDITIONAL rNFOKMATION;.. In a letter dated August 15, 2023 the Board of Trustees stated that the proposed construction is not within their jurisdiction. The survey that was provided with the application shows an existing accessory structure that will be removed. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board Finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhohood is a mixed neighborhood consisting of single family homes and a church. The lot is long and narrow and from tile street it appears to be smaller than it is, given the excessive lot depth. The granting of the variance will not have any change on the character of the neighborhood, 2. Town I §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by, some method, feasible for L Law the applicant to pursue, other than an area variance. The applicant could build an accessory stRICture with a code conforming side yard setback. However,the lot is narrow and there is an existing house,on the parcel. If the applicant builds the new garage with a code conforming side yard setback it will be partially placed behind the house which will make it difficuIrt to manuver an automobile inside the garage. 3. Town Law 6267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 50% relief from the rade. I lowever, 20 foot side yard setback requirement is for a 64,825 square foot lot. The lot is long and narrow and partially covered by unbuildable wetlands. The proposed non-conforming side yard setback is in scale with a 88 foot wide lot. 4. Town Law '267443)(b)(4). No evidence has been submitted to suggest that a variance in this residential conirriunity will, have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed accessory, garage will be readily accessible from the street, and will be constructed further away from wetlands than the existing accessory structure. Furthermore, it will be used for storage, only. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 267_b � Wa. . The difficulty has not been self-created. The applicant purchased the parcel after the Zoning (lode was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase, 6. Town Law 4267-b. Grant of tile requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage for storage only, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
