SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 21, 2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION The subject property is a 9,609.99 sq. ft. non-conforming parcel located in an R-40 Zoning District. The parcel has a road frontage of 67.50 feet fronting Great Peconic Bay Blvd, along the southerly property line, then turns north for 152.14 feet along AJ Masters Road, a 30-foot Right of Way, then turns west for 70.20 feet before returning 151.05 feet south back to Great Peconic Bay Blvd. The property is improved with an existing one story residence with an attached garage and covered porch as shown on a survey prepared by Kenneth M. Woychuk, L.S., dated September 24, 2021 BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124; and the Building Inspector's December 7,2021 Notice of Disapproval based on an application for a permit to construct a covered front porch and screened porch additions to an existing single family dwelling, at; 1) located less than the code required minimum secondary front yard setback of 20 feet; 2) located less than the code required minimum rear yard setback of 35 feet; 3)more than the code permitted maximum lot coverage of 20%; located at 8385 Great Peconic Bay Blvd, Laurel, NY. ADDITIONAL INFORMATION• A Pre-CO was issued in 2013, #36588. The existing single-family dwelling is currently being renovated under building permit # 46653. The Board received several letters of support from neighbors of the subject applicant. The applicant indicated that her brother owns the 30-foot Right of Way AKA Masters Road,that constitutes her secondary front yard,and that a neighbor residing across the R.O.W. t was granted variance relief, but no other detail was offered. FINDINGS OF FACT/REASONS FOR BOARD ACTION• The Zoning Board of Appeals held a public hearing on this application on April 7, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law, &267-b(3)(b)(1) Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed front porch addition is approx. 3" from meeting the code required minimum secondary front yard setback and is the result of design considerations for the front elevation; it will not be discernable; and is de minimus in nature. The proposed rear screen porch is proposed in the only buildable location in the architectural rear yard of the existing dwelling on this corner lot, and has a larger setback from Masters Road (the R.O.W.) than the as built attached garage. The porch will not be habitable space and will remain open. The proposed lot coverage is not out of character in this neighborhood because all of the lots along this road are undersized and non-conforming, therefore these proposed additions will not change the makeup of the neighboring properties. 2. Town Law 5267-b(3)(b)(2) The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Due to the size of the property and the existing non- conformance, any additions or renovations to this house would require variance relief. 3. Town Law 5267-b(3)(b)(3) The variances granted herein for the rear yard setback and lot coverage are mathematically substantial: The rear yard setback of 26.4 feet for the propose screened porch represents approximately 12% relief from the code. The proposed lot coverage of 23. 6 % represents approximately 18% relief from the code. However, this property is situated in a neighborhood consisting of undersized, non-conforming lots, and it will not be any different than the existing houses along the private road in which it sits. The secondary front yard setback of 19.8 feet for the proposed open front porch is de-minimus and will in no way be discernable. 4. Town Law 5267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and conditions of this board. 5. Town Law 267- )(3)(b)(5), The difficulty has been self-created.
