Gillispie, Jr., Chairmen Robert Bergen Cherles Grigonis, Jr. Serge Doyen, Jr. Fred Hulse, Jr. r M I N U T E S SOUTHOLD TO{trN BOARD OF APPEALS October 11, 1973 A regular meeting of the Southold Town Board of Appeals was held at 7:3o P,M., Thursday, October 11, 1973, at the Town Office, Main Road, Southold, New Yorlc, There were present: Messrs: Robert SJ, Gillispie, Jr „ Chairman; Robert Bergen; Charles Grigonis, Jr,; Fred Hulse, Jr.; Serge Doyen, Jr. TI3E CHAIRMAN: On Appeal No. 1815, Evelyn Swisky, Bayview Road, Southold, New York, the proposal was to divide property with less than required area and frontage. After investigating the property, the Board of Appeals wrote to the Planning Board informing them that the Appeals Board had advised Mrs, Swisky that she would not be permitted to create or sell lots con- sisting of less than 40,000 sq. ft. However, if the Planning Board is willing to create two lots to the rear of Mrs. Swisky's residence property, the Board of Appeals would grant a variance on the remainder of the property, consisting of approximately 28,000 sq, ft„ on which her residence is located, as this lot is larger than the adjoining lot to the east, The Board of Appeals postponed decision on this Appeal until receipt of recommendations of the Planning Board. The Board of Appeals has now received a letter from Mr, John SJickham, Chairman of the Southold Town Planning Hoard advising us that at a meeting on October 1973, the Board \ voted to approve the creation of two lots to the rear of Mrs, Swisky's property facing the creek, leaving a balance of approximately 28,000 sq. ft, on which her residence is located, ~ ~ Southold Town Board of Appeals -2- October il, 1973 After investigation and inspection the Board finds that ~velyn Swisky, Bayview Road, Southold, New York, requests a variance for permission to divide property with less than required area and frontage, and for approval of access on property located on the north side of Bayview Road, Southold. The Board agrees with the reasoning of the applicant. After inspection, the Planning Board voted to approve the creation of two 40,000 sq. ft. lots. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED, Evelyn Swisky, Bayview Road, Southold, New York, be GRANTED permission to divide her property into two lots facing the creels, leaving a balance of approximately 28,000 sq. ft., on which her residence is located. The two lots on the creek shall each consist of 40,000 sq, ft. This permission is granted subject to the following conditions That applicant furnish a 15 foot right of way along the westerly boundary. That this permission is granted subject to the approval of the Building Inspector. Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Hulse, Grigonis, Doyen. ~ * ~ THE CHAIRMAN: Appeal No. 1820, S4illiam Grefe, New Suffolk Avenue, New York, because of an improper legal notice, the decision of the Board was postponed. After investigation and inspection the Board finds that applicant requests permission to operate a building contractors yard and to manufacture and store concrete products. The findings of the Board are that applicant is the owner o£ one acre of property and that according to the Ordinance the proposed use is basically for a contractor's yard with some manufacturing of concrete products, and that the plot size is adequate for a contractor's yard but does-not meet the 200,000 sq. ft. Bulk Requirements for "C-1" Industrial use as set forth in Section IX. ~ The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. - ~ _ . . SUPPLEME'?TARY SPECIAL CONDZTZONS The following conditions apply to all permits: ` A. If any of the permit conditions are unclear, the permittee shall contact the Division of Regulatory Affairs at the address and telephone noted below. B. A copy of this permit or approval and supplementary conditions shall be available at the project site whenever authorized work is in progress. _ C. The permit si;n enclosed with the permit or a copy of letter of approval shall be protected from the weather and posted in a conspicinus location at the work site until completion of authorized work. D. At least 48 hours prior to commencement of the project, the permittee shall complete and return the top portion of the enclosed receipt form certifying that he is fully aware of and understands all provisions and conditions of this permit. Tdithin one week of completion of the permitted work, the bottom portion of that form shall also be completed and returned. E. For projects involving activities to be accomplished over a period or more than one year, the permittee shall notify the Regional Permit Administrator in writing at least 48 hours to the commencement of resumption of work each year. F. If project design modifications take place after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. The permittee is advised that substantial modification may require sub- mission of a new application for permit. G. All necessary precautions shall be taken to preclude contamination of any wetlands or waterway by suspended solids, sediment, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other emriro~entally deleterious materials associated with the project work. H. Any failure to comply precisely with all of the terms and conditions of this permit, unless authorized in writing, small be treated as a violation of the Environmental Conservation Law. I. The permittee is advised to obtain any permits or approvals that may be required from the U.S. Department of Army Corps of Engineers, NY District, 26 Federal Plaza, New York, NY 10278, (Attention: Regulatory Functions Branch), prior to commencement of work authorized herein. J. The granting of this permit does not relieve the permittee of the responsibility of obtaining a grant, easement, or other necessary approval from the Division of Land Utilization, Office of General Services, Tower Building, Empire State Plaza, Albany, NY 12242, which may be required for any encroachment upon State-owned lands under water.
