The lights in the side yard should be physically removed so that there are just two lights per pole. The Board's position is based on the fact that it had requested a reduction in the intensity of the lights. To date, this has not been addressed. It is felt that the physical removal of the lights from the poles so that there are only two lights per pole in the side yard and one light per pole in the front yard will be a satisfactory compromise. He asked if a member of the Planning staff would go out with him. I accompanied him this afternoon. Following is a list of my observations. The observations are based on the October 12th inspection and field report: 1. The swale and low berm on the north side of the property (next to Markel's property) have notbeen installed. However, the topsoil for the berm is piled on-site and the work is scheduled to be done. 2. The lighting that was installed generally consists of two high intensity rectangular lights per stanchion. The lights are directed at the building and perpendicular to the building. Victor asked the site foreman (Tom McCarthy) to make sure the lights did shine off the property. I recommend a night inspection. 3. The entrance curbing appears to be in accordance with the Building and the Highway departments' request that the curbs not extend to the street. A memorandum has been sent to Ray Jacobs asking for his review. 4. The water tank at the northwest corner of the property was supposed to be removed at Victor's request, but had not been at the time of our inspection. The well will remain because it is for the irrigation system. 5. The slope of the parking area around the drain at the entrance of the building has been lessened to the extent possible. 6. The showroom has been deemed accessible to the handicapped by Victor. All handicapped parking spaces have been placed at the closest point of entry and adjacent to a ramp. 7. The front yard has been covered with sod. Street trees have been installed as per specifications. The side and rear yards will be seeded at a later date. The applicant has asked for a C. of O. by October 31st so that they can meet their scheduled opening date of November 1st. In April of this year, the Planning Board approved the site plan for the above-referenced building with ~ a ~I ~,.F,r, _ . for review prior to the issuance of a building permit. Ordinarily, this Board does not approve a site i plan with such a condition. Usually it requires that the lighting plan be submitted before it grants approval. In fact, this information had been requested in March (see enclosed copy of letter), but it was not provided. In this particular case, your representative, Tom McCarthy of Gray Construction, indicated that time was of the essence, and that there was every intention of complying with the Planning Board's concerns that the lighting not be intrusive. In the spirit of cooperation, the Planning Board agreed to approve the site plan with the condition that the lighting be addressed prior to construction. A copy of the approval resoluf.ion is attached for your information. Unfortunately, prior to the issuance of a building permit, but rather when construction was nearly completed. In October, a request for a Certificate of Occupancy was made. At that time, it was noted that the lighting that had been installed was not the same as that shown on the plan that had been submitted! At this point, the Board could have requested strict compliance with the submitted plans before recommending issuance of the Certificate of Occupancy. Instead, so that the scheduled opening date of the dealership would not be delayed, the Board, once again in the spirit of cooperation, recommended the issuance of the Certificate of Occupancy, with the condition that the lighting on the site be reduced in its intensity. Attached please find a copy of the Board's November recommendation to the Building Department. Given this Board`s efforts to accomodate your construction schedule, we find it puzzling that, to date, nothing has been done to ameliorate the unacceptable lighting. It would be most appreciated if the numbers and the intensity°of the lights would be reduced as noted in the Board's November 2, 1989 memorandum. Horton Lane, Southold SCTM # 1000-059-3-32.1 Dear Mr. Lucas, Sr. This letter is being sent in the hope of resolving a matter concerning your new building on Horton Lane in Southold. In April of this year, the Planning Board approved the site plan for the above-referenced building with a condition that a lighting plan be submitted for review prior to the issuance of a building permit. Ordinarily, this Board does not approve a site plan with such a condition. Usually it requires that the lighting plan be submitted before it grants approval. In fact, this information had been requested in March (see enclosed copy of letter), but it was not provided. In this particular case, your representative, Tom McCarthy of Gray Construction, indicated that time was of the essence, and that there was every intention of complying-with the Planning Board's concerns that the lighting not be intrusive. In the spirit of cooperation, the Planning Board agreed to approve the site plan with the condition that the lighting be addressed prior to construction. A copy of the approval resolution is attached £or your information. Unfortunately, a lighting plan was not submitted prior to the issuance of a building permit, but rather when construction was nearly completed. In October, a request for a Certificate of Occupancy was made. At that time, it was noted that the lighting that had been installed was not the same as that shown on the plan that had been submitted! At this point, the Board could have requested strict compliance with the submitted plans before recommending issuance of the Certificate of Occupancy. Instead, so that the scheduled opening date of the dealership would not be delayed, the Board, once again in the spirit of cooperation, recommended tie issuance of the Certificate of occupancy, with the condition that the lighting on the site be reduced in its intensity. Attached please find a copy of the Board's November recommendation to the Building Department. Given this Board's efforts to accomodate your construction schedule, we find it puzzling that, to date, nothing has been done to ameliorate the unacceptable lighting. It would be most appreciated if the numbers and the intensity of the lights would be reduced as noted in the Board's November 2, 1989 memorandum. ASTM E-b4$ CRITICAL RATDYANT FLUX PREPARATION AND CONDITIONING The carpet sample was cut into three sections 1(J" wide by 42°' Long and backed with 1/411 asbestos-cement board per para. 5.2,1 of the standar+3 prior to being firmly secured in the specimen tray. 'Phe sample panels were con.ditiorzed at 73,4 ± 5°F axad 50 * 5~ relative humidity uftd allawad L~ iuex~-i~ mvi~Lui•4 ~yuillbriurn. Nof.e, per Client's rec{uest, the carpet specimens were ad}aered directly to the asbestos-Bement board substrates. Carpet sample was identified by the Client as material intended for glue-down application. TEST~pR.OCEDIIRE The test chamber was pre-heated for l }sour and the radiant panel black body temperature verified to be within 5°C of the temperature established during calibration. The pilot Burner was ignited and the specimen inserted into the chamber. After a 2-minute pre-heat, the pilot burner flame was placed in contact with the specimen fox' 10 minutes, then removed. Tire test was continued until all flaming ceased.
