The following action was taken by the Board of Trustees
during their recent meeting held on August 25, 1988 regarding the
above matter.
WHEREAS THE Southold Town Trustees personally viewed and are
familiar with the premises of John J. Gutleber, and
WHEREAS, THE Board has carefully considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located at 1325 Lupton Point
Road, Mattituck, fronting on deep Hole Creek.
2. The property is identified on the Suffolk County Tax Map as
District 1000, Section 115, Block 11, Lot 9.
3. In consideration of this request, the Board finds: (a) The
project will not adversely affect the wetlands of the Town. (b)
The project will not weaken or undermine the lateral support of
other lands in the vicinity,
NOW THEREFORE BE IT
RESOLVED to GRANT a WAIVER of the Wetland Ordinance in accordance
with ARticle II, 97-20 (B), in the matter of John J. Gutleber
to install a redwood gazebo on property located at 1325 Luptons
point Road, Mattituck.
PLEASE BE ADVISED THAT YOU SHOULD CHECK WITH THE BLDG. DEPT. FOR
A DETERMINATION ON THE NEED OF ANY OTHER PERMITS THAT MAY BE
REQUIRED FOR THIS PROJECT.
KINDLY REMIT THE REQUIRED $25.00 FEE FOR THIS PROJECT AT THIS
TIME.

A review has been mad-e~-~o~f~~y~.9our proposal to~fi~ p~ ~
leased on the information you have submitted, the New York State Department
of nvironrnental Conservation has determined that the parcel
project is:
Greater than 300' from inventoried tidal wetlands.
_ Landward of a substantial man-made structure
greater than 100' in length which was constructed prior to 9/20/77.
Landward of the 10' above mean Sea level elevation contour on a
gradual, natural slope.
Landward of the topographic crest of a bluff, cliff or dune which is
greater L-han 10' in elevation above mean sea level.
!'herefore, no permit is required under the Tidal Wetlands Acl (Article 25
;E the Environmental Conservation Law). Please be advised, however, that
no construction, sedimentation or disturbance of any kind may take place
seaward of the 10' contour or topographic crest without a permit. It is
;our responsibility to ensure that all necessary precautions are taken to
prevent any sedimentation or other alteration or disturbance to the
.!round surface or vegetation in this area as a result of your project.
such precautions may include providing adequate work area between the
10' contour or topographic crest and the project (i.e. a 15' to 20' wide
construction area) or erection of a temporary fence, barrier, or hay
bale berm.
Please note that any additional work, or modification to the project as
described, may require authorization by this Department. Please contact
this office if such are contemplated.
Please be further advised that this letter does not relieve you of the
responsibility of obtaining any necessary permits or approvals from other
agencies.
