Bonura and Woody Egger , residing at 355 9°'' Street, Greenport, NY, 11944 , party of the first part; and Bruce Berger, residing at 425 9th Street, Greenport, NY 11944, party of the second part, WITNESSETH: WHEREAS, John F. Bonura and Woody Egger and Bruce Berger, the parties to this agreement are the present owners in fee of the adjoining parcels of improved real property and the parties wish to define and establish such boundary line for all time, it is agreed as follows: WHEREAS, John P. Bonura and Woody Egger, the parties of the first part are the owners in fee simple of the premises known as 355 9th Street, Greenport, in the Town of Southold, County of Suffolk, and State of New York, which property is more fully described in a certain deed in Liber 12073 Page 230 (See Exhibit A attached hereto), and also known as District 1000 Section: 048.00 Block: 01.00 Lot: 024.000 (hereinafter the "Egger" premises) and WHEREAS, Bruce Berger, the party of the second part is the owner in fee simple of the premises known as 425 91h Street, Greenport, in the Town of Southold, County of Suffolk, and State of New York, which property is more fully described in a certain deed in Liber 12928 Page 522 (See Exhibit B attached hereto) and also known as District 1000 Section 0048.00 Block 01.00 Lot 27.000, (hereinafter the "Berger" premises), which property is immediately adjoining on the south of the above referenced premises of the party of the first part, WHEREAS, the boundary line to the south of the "Egger" premises is also the north boundary line of the "Berger" premises; and therefore a "common boundary line". NOW THEREFORE, Bruce Berger, party of the second part, Covenants as follows: A. As party of the second part, has been shown a survey of the "Egger" premises made and certified by Brian A. Drucker Land Surveyor, dated June 15. 2023 which establishes the common boundary of the adjoining parcels in accord with the agreement of the parties to this agreement (See Exhibit C attached hereto and made part of this Agreement). B. Hereby certifies that he has agreed that the "Common boundary line" as depicted in the said Survey is accurate and true and that he makes no claim for ownership by adverse possession or otherwise to the portion of the land where the blacktop driveway and hedge and tree row extend about 3.5 feet to the north of the southwesterly corner of the "Common boundary line". C. Hereby certifies that himself, his heirs, distributes, executors, administrators, successors and assigns, make no claim of ownership to that portion of the "Egger" premises on which said blacktop driveway encroaches on the "Egger" property as shown on the Survey, by adverse possession or otherwise. D. Hereby releases any claim that he may have in and to the property located about 3.5 feet north of the southerly record line on the "Egger" premises. .E. That further holds Woody Egger and John F. Bonura and their successors in interest harmless from any claims arising out of the encroachment of the driveway on their premises. F. That my use of the blacktop driveway encroaching up to 3.5 ft north of the southerly record line of property of Egger is with the permission of said party of the first part and shall not be deemed adverse possession nor shall the use thereof be considered a granting of any interest whatsoever by Egger in said property. The continued use of said lands shall be by the permission of the party of the first part herein granted and as specifically set forth in this agreement. IT 1S MUTUALLY AGREED AND COVENANTED TO that this agreement shall run with the land and be binding upon and ensure to the benefit of the successors in interest of the parties.
