APPLICATION FOR CERTIFICATE OF OCCUPANCY INSTRUCTIONS
A. 'This application must be filed in typewriter OR ink and submitted to [he Building
Inspector with [he following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural ar Copographic features. '
2_ Final approval of IIealth Dept. of water supply and sewerage-disposal(S-9 form)-
3. Approval of electrical installation from Board of Fire Underwriters. ,
4_ Sworn statement from plumber certifying thaC solder used is system contains Iess
than 2/10 of 1Z lead.
5_ Commercial buildings, industrial buildings, multipte residences and similar.
buildings and insCallations, a certificate of cade compliance from the Architect
or Engineer responsible for the building.
5. Submit Planning Board Approval of completed site plan requirements.
8. For existing buildings (Prior to April 9, 1957 non-conforming uses, or buildings
and "pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, buildings and
unusual natural or topographic features.
2. A properly completed application, a consent to inspect signed by [he applicanC
and a certified abstract of title issued by a title company which shall
show single and separate ownership of the entire Lot prior to April 4, [957.
If a Certificate of Occupancy is denied, the Building Inspector shall state the
reasons therefor in writing Co the applicant.
3. Date of any housing code or safety inspection of buildings or premises, or other
pertinent information required to prepare a certificate.
C_ For Vacant Land Certificate of Occupancy:
1_ An application for vacant land Certificate of Occupancy shall be submitted,
and a certified abstract of CiCle issued by a title company showing single and
separate ownership of the entire lot prior to April 9, 1957 shall also accompany
the application. If a Certificate of Occupancy is denied, the Building Inspector
shall stare the reasons therefor in writing to the applicant.

Ordinance, Article III A, Section 100-30 A.3, for permission to
construct a deck ad ii-;on, construction exceeds permitted lot
coverage obis R-40 Zone District. Property Location: 780
Orchard Street and 1300-2nd Street, New Suffolk, County Tax Map
No. 1000, Section 117, Block 7, Lot 22.
WHEREAS, a public hearing was held and concluded on
December 19, 1989 in the matter of the Application of VINKO
NALETILIC under Appeal No. 3873; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the south of
Orchard Street, Town of New Suffolk, and is identified on the
Suffolk County Tax Maps as District 1000, Section 117, Block 7,
Lot 22.
2. This is an application for Variances from the Zoning
Code Article III A, Section 100-30 A.3, for permission to
construct a deck, proposed construction will have insufficient
lot coverage.

3. Article III A, Section 100-30 A.3, No building or
premises shall be used and no building or part thereof shall be
erected or altered in the Low-Density Residential R-40 District
unless the same conforms to the requirements of the Bulk
Schedule and of the Parking Schedule, with the same force and
effect as if such regulations were set forth herein in full.
4. In considering this application, the Board finds and
determines:
(a) that the circumstances of this apn~ication are
uniquely related to the premises and its Pstablished
nonconformities;
(b) that there is no other method for appellants to
pursue; and placing the proposed deck in any other location on
premises will still require other variance relief;
(c} that the area chosen for the deck is not unreasonably
located;
(d) that the variance will not in turn cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town;
(e) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the variance, as applied conditionally noted below.
Accordingly, on motion by Mr. Goehringer, seconded by Mr.
Dinizio, it was

RESOLVED, to GRANT a Variance in the matter of the
application of VINKO NALETILIC as applied under Appeal No. 3873,
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the deck remain open and unroofed.
2. That there be no further building, or expansion of
decks, etc, on this premises.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
Doyen, and Dinizio (P.bsent Joseph Sawicki). This resolution was
duly adopted.

avoid legal action.

During an inspection o£ your property on February 21, 1989
a new deck addition has been constructed and a Building Permit
has not been issued for same.
Your permit #156172 has expired and it did not include the
deck addition.
According to the Code of the Town of Southold Art. XXVIII
Chap. 100-281 a Building Permit is needed for a deck addition.
A Certificate of Occupancy, Chap. 100-284, is required before
the deck may be occupied or used.
In order to avoid any legal action, you must contact this
office and resolve the violation immediately.
