APPLICATION FOR CERTIFICATE OF OCCUPANCY
A. This application must be filled in by typewriter OR ink and submitted to the building
inspector with the following: for new building or new use:
1. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 €orm},
3. Approval o£ electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
~ less than 2/10 of 17 lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
' B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and
"pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and „
unusual natural or topographic features. "
~ 2. A properly completed application and a consent to inspect signed by the applicant.

Dear Mr. Duffy:
The following resolutions were adopted by the Southold Town
Planning Board at a meeting held on Monday, June 25, 1990.
RESOLVED, that the Southold Town Planning Board, acting
under the State Environmental Quality Review Act, do an
uncoordinated review of this unlisted action. The Planning
Board establishes itself as Lead Agency, and as Lead Agency
makes a determination of non-significance and grants a Negative
Declaration.
WHEREAS, James Duffy is the contract lessee of the property
known and designated as James Duffy Restaurant
SCTM#1000-121-2-2, located at County Road 48 and Sound Avenue;
in Mattituck; and
WHEREAS, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8), Part 617,
declared itself Lead Agency and issued a Negative Declaration on
June 25, 1990; and
WHEREAS, the site plan known as James Duffy Restaurant will
supersede the site plan for Walter and Marilyn Gata approved on
March 14, 1986; and
WHEREAS, only phase one as shown on the map will be built,
future proposed buildings will be subject to a future
application; and

RESOLVED, that the Southold Tawn Planning Board grant
conditional final approval, and authorize the Chairman to
endorse the final surveys dated May 31, 1990 subject to the
following conditions.
1. Black top paving must be installed in access road and
parking areas within one year from date of approval.
2. Subject to a one year review.
Enclosed please find a copy of the Negative Declaration for
your records.
